Richmond residents, leaders warn of danger from Bakken crude by rail shipments

If you go to the website explosive-crude-by-rail.org and zoom in on Richmond, what you’ll find is disconcerting. According to the 1-3 mile buffer zone on the map, the entire city and its 107,000 residents are in danger if trains carrying crude oil explode.

Such is the concern of several Bay Area environmental groups in Richmond who have drawn the City Council into an escalating dispute with the Bay Area Air Quality Management District and Kinder Morgan, which operates a local crude by rail transfer station.

“The health and safety of the community is at stake here,” Mayor Gayle McLaughlin said during a City Council meeting. “We are encouraging the air district to review the process.”

Richmond City Council on Tuesday unanimously passed a resolution to “review” and “if feasible, revoke” the permit given to Kinder Morgan – the 5th largest energy company in the United States — to take in crude oil by rail. Based in Texas, the company was founded in 1997 by two former Enron executives.

The crude, from the Bakken Shale of North Dakota, ignites and explodes more easily than more traditional crudes. On the heels of a major oil boom, transportation of crude by rail in the North America increased by 423 percent between 2011 and 2012, and more crude shipped by rail was spilled in 2013 than in the four previous decades combined.

In 2012, a train carrying Bakken crude derailed and exploded in Lac-Megantic, Quebec, killing 47 people and decimating the small Canadian town. This, among other incidents, has prompted the U.S. Department of Transportation to label Bakken transport by rail as an “imminent hazard”.

Several community groups have rallied to ban the movement of crude shipments through Richmond. Megan Zapanta of The Asian Pacific Environmental Network said she’s worried that a lack of attention could have dire consequences.

“Bakken crude has not been well-documented here,” she said. “If there’s some disaster, how will we get the word out to our immigrant community?”

Evan Reis, a structural engineer for Hinman Consulting Engineers, released a report earlier this year assessing the probability of a crude-laden train derailing in the East Bay.

He estimates there is a six in 10 chance of derailment on the line running from San Jose through Richmond to Martinez within the next 30 years.

“Given the fact that these are highly urbanized places we are going through,” he said by phone, “A 60 percent probability would be of concern to me.”

McLaughlin pledged to support Communities for a Better Environment (CBE) as they consider appealing the air district decision to grant Kinder Morgan a permit to funnel crude through Richmond by rail cars. The city does not have the jurisdiction to revoke any licenses or permits from the company. The permit must go through the air district, where it can be reviewed with respect to the California Environmental Quality Act (CEQA)

In March, CBE filed a lawsuit against BAAQMD for failing to publicly disclose the permit to the residents of Richmond. The group only noticed the arrival of crude by rail because a local television station, KPIX, discovered that Kinder Morgan was bringing Bakken crude to its Richmond depot.

The Tesoro refinery in Martinez receives the Bakken shipments by truck after they are transferred from the rail depot in Richmond. Richmond’s Chevron refinery does not take in any of the Bakken crude.

In September, the lawsuit was dismissed on technical grounds because the complaint by the CBE was not filed within 180 days of the permit’s issuance.

The permit, which was filed by BAAQMD staff in 2013, drew ire from environmental groups because it was not subject to an environmental impact report, and was granted without review from the district’s board.

Andres Soto, a representative of Communities for a Better Environment in Richmond, appealed to Richmond leaders to counter the decision.

“Kinder Morgan issued an illegal permit to bring Bakken crude into Richmond without public notice or review,” Soto said.

Ralph Borrmann, public information officer for the BAAQMD, declined to comment until the end of the appeal period. The CBE has considered a challenge of the ruling.

The Kinder Morgan depot has been taking in ethanol by rail since 2010, but they have since diversified their intake to include Bakken crude. Kinder Morgan officials, though, say the concerns are overstated.

“We didn’t feel that the profile of the crude oil arriving was materially different,” Melissa Ruiz, a spokesperson for the Texas-based company, wrote in an email.

Charlie Davidson, a member of the Sunflower Alliance speaking on behalf of CBE, disagrees.

“They’re basically running tin cans on 100 cars,” he told Richmond City Council. “The flash point [of Bakken Crude] is so volatile that it could burn in Antarctica.”

Randy Sawyer, Chief Environmental Health and Hazardous Materials Officer in Contra Costa County, acknowledged the dangers but also downplayed the risk of a major disaster.

“It’s a hazardous material and there’s concern of derailment and fire,” he said in an interview by phone. “But if you put it in relation to other materials, it isn’t as hazardous as chlorine or ammonia. It’s equivalent to ethanol or gasoline.”

“The biggest concern with crude by rail is not so much than the hazard being worse, it’s just the huge amount of quantity that’s being shipped by rail,” Sawyer said.

Since the dismissal of the lawsuit, other municipalities in the North Bay have rallied against crude by rail. In Sacramento, a lawsuit by Earth Justice prompted the local air board to revoke a permit from Inter-State Oil Company on the grounds that they did not disclose the potential public health and safety concerns to local residents.

Suma Peesapati, a member of Earth Justice, drew similarities between Sacramento and Richmond.

“Kinder Morgan’s project in Richmond is virtually identical to the air district issued permits for unloading crude in Sacramento,” she said. “The [Bay Area] Air District made it clear they issued a permit in error, rather than engage in this formal process.”

Despite the resolution passing, Richmond Councilmember Jael Myrick expressed just as much weariness as concern for the issue.

“The frustration that we had the last time we talked about this is it just seems there is so little we can do to combat it.”

20 By 2020: A Pledge To Reduce Refinery Pollution

The Bay Area Air District has been working for the past two years to craft regulations that track and limit refinery pollution as oil companies begin bringing in extreme new types of crude oil that put workers and refinery fenceline communities at risk.  Facing much more pollution from refining extreme crude oil, like tar sands and Bakken crude, and in the aftermath of the massive August 2012 fire at Chevron Richmond, a number of community and environmental advocates got together with refinery workers at the start of the rulemaking effort.  (below, the Chevron refinery and tanks loom large over North Richmond; Photo Credit: Environmental Health News)

Chevron richmond homes.jpgWe came up with the Worker-Community Approach to not only ensure that pollution would not increase from refineries but to track crude oil used and achieve continual progress on air quality by reducing 20 percent of refinery pollution by 2020.

Our challenge to the Bay Area Air District and to all Chevron tankfarm homes.jpgfive oil companies with refineries in the region is that given the tremendous amounts of pollution pumped out by refineries and impacting the health of fenceline communities every day, will they work together to commit to cutting pollution by 20 percent by 2020?  Here are five things you need to know about refinery pollution in the Bay Area that help explain why Refineries in the Bay Area are much more polluting than other refineries and can easily reduce 20 percent of their toxic emissions over the next five years:

1)      According to US EPA Toxics Release Inventory (TRI) Data: Bay Area refineries, on average, report more than twice the toxic chemical releases reported by Los Angeles Area refineries.

2)      According to the California Air Resources Board, emissions inventory data, Bay Area refinery emissions are estimated to decrease by 50 percent or more by 2020, making a 20 percent reduction by 2020 seem easy.  But projections are one thing; we need a reliable commitment in writing.

3)      The CARB emissions inventory data also shows that Bay Area Refineries currently emit 7 times more nitrogen oxides (NOx), 3 times more sulfur dioxide and at least a third more organic hydrocarbons (like benzene) than Southern CA refineries, yet Southern California refineries collectively have over a third more capacity.

4)      According to regional air district data, the Chevron Richmond refinery is much more polluting than its El Segundo “twin” that has the same design; Chevron Richmond emitted more than twice as much organic hydrocarbon and particulate matter (PM) and eight times more toxic benzene than the El Segundo refinery in 2012.  Going back to TRI emissions, Chevron Richmond released over 80 percent more toxic air pollution than Chevron El Segundo in 2011.

5)      According to a 2013 Statewide Audit, on a rough per gallon of gasoline basis, Bay Area Refineries are 50 percent more climate polluting, twice as polluting for organic hydrocarbons and NOx, almost 20 percent more polluting for PM and leak over three times as much benzene and almost five times as much formaldehyde relative to gasoline produced in Southern California.

Wouldn’t it be great if Bay Area refineries – Valero, Chevron, Tesoro, Phillips 66 and Shell – took the 20 by 2020 pledge?  They could use the same modern pollution controls that refineries in Southern California have installed.  This kind of commitment to clean air, is not only doable technologically, it is a smart approach to being a good neighbor and supporting community health.  The proactive Worker-community Approach to improving air quality also ensures that we won’t see an increase in pollution as oil companies bring more extreme crude oil into the region.  In fact, we would like to see refiners take a good neighbor pledge not to bring any extreme, dangerous crude oil into the Bay Area at all.  At the very least, they should pledge a 20 percent reduction of toxic pollution by 2020.  They did it in Southern California; Bay Area communities deserve no less.

THE PLEDGE:  A Worker-Community Approach to Emission ReductionsIn order to address the ongoing health hazards in refinery-impacted communities and prevent any increases in pollution caused by changing crude oil, the refinery rule should require:

1)  Each refinery is required to decrease refinery-wide emissions of pollutants that create environmental health hazards by at least 20 percent below the refinery’s baseline by 2020, showing adequate incremental progress of at least two percent each year;

OR

2)  If these reductions aren’t possible, a refinery needs to show that they are using the best available emission control technology (BACT) throughout the refinery (i.e., eliminate “grandfathered,” “non-BACT” and “exempted” sources in the refinery).


Sources & Notes:
  1. Refinery Capacity vs. Throughput: Refinery comparisons were adjusted by capacity as reported to US EPA and to the California Energy Commission.  Although annual crude oil throughput would be a better comparison point, it is not publicly available.  Thus an imperfect assumption that most refineries utilize most of their capacity must be made in order to compare emissions.  According to CEC, Southern California has roughly 1 million BPD refining capacity and the Bay Area has roughly 700,000 BPD capacity.  “A rough per gallon” refined basis is relative to reported capacity not throughput or production.
  2. CARB emissions inventory queries were run for 2012 and the future projection year of 2020 for industrial sources, taking the sum of the Emissions Inventory Categories: 040-Petroleum Refining (Combustion) and 320-Petroleum Refineries.
  3. BAAQMD Emissions Inventory Data for each refinery was transmitted to NRDC via Public Records Request, August 28, 2014 for years 2011 through 2013.

The DEIR comments for the Valero Crude-by-Rail Project in Benicia closed on September 15, with a final landslide of important letters critical of the project arriving on the last day. Attorneys and others who have looked at the quality and quantity of the comments submitted believe at the very least the DEIR will have to be significantly revised to address the many serious issues raised, and then recirculated. They expect the analysis to take many months.

This is an example of an entire region coming together to respond to a serious threat to our safety and taking advantage of the California Environmental Quality Act (CEQA) process to voice our many concerns before the project proceeds. The process is respectful and orderly, and allows governmental agencies, environmental organizations, and individuals all to respond. The responses range from detailed technical analysis of many pages according to the expertise of the agency, often relying on expert scientists and sometimes policy, to more personal or general concerns from the public at large. In addition, public testimony was taken at three lengthy Planning Commission meetings in July, August, and September, all of which can be accessed at the city site below. Finally, the Benicia Planning Commissioners themselves submitted written comments.

CEQA is a stunning example of democracy in action, and in the case of the Valero Crude-by-Rail Project, all concerned parties utilized the channel available to them to look closely at the short and long-term impacts of Bakken Crude and tar sands bitumen entering the state of California via rail.

All comments are added to the public legal record and incorporated as part of the review of the DEIR, and thus all concerns must be addressed in the final EIR. Furthermore, any item entered in the record can be used in future litigation.

A few highlights of the hundreds of pages of commentary follow.

Governmental Agencies:
In the Sacramento region, our governmental agencies stepped forward on our behalf. Yolo County addressed the concern of the magnitude of an accident should one occur, among a range of other considerations about transport over the causeway. Read them here.

The Sacramento Area Council of Governments (SACOG) on behalf of 22 cities and 6 counties raised a series of concerns including advance notification to emergency operations offices of crude oil shipments, limitations on storage of crude oil tank cars in urbanized areas, funding for training and outfitting emergency response crews, installing the best brakes to minimize risks, funding for rail safety projects, installing Positive Tran Controls to prevent accidents, and prohibiting shipments of unstabilized crude oil that has not been stripped of the most volatile elements (including flammable natural gas liquids). The City of Davis concurred with the SACOG and County of Yolo letter concerns and added some specific considerations for trains passing through Davis. In particular, the letter states that the DEIR’s Project description is incomplete and misleading as written, given information about the use of 1232 tank cars and assumptions about “just-in-time” supply chain and the significant sidings that could be used for storage.

The letter also states that the DEIR inadequately describes the project setting as it gives no details about all the uprail cities the trains must pass through with their crude oil loads. Next, the DEIR improperly truncates its description of the project setting by ending the description at Roseville, when at the least the route should be studied to the California borders or better yet to the source of extraction. Clearly the source of the crude does pose a significant hazard to uprail communities that must be addressed in the DEIR.

The Project’s Significant Hazard Risk Requires Feasible Mitigation Measures which are not explored in the present version, and the Davis letter presents a list of possible mitigations. Finally, the City insists that the DEIR fails to analyze the cumulative impacts of the Project given the imminent plans for more daily crude oil trains. Read the full letter here.

The California Public Utilities Commission in conjunction with the Office of Spill Prevention and Response also commented at some length on the DEIR, submitting their letter on Governor Brown’s letterhead. The letter addresses issues about the length of track analyzed, the derailment and accident calculations, the legal enforceability of the Valero commitment to use CPC- 1232 tank cars, the total derailments attributable to the project, insufficient attention paid to potential consequences, assumption regarding the number of cars expected to derail and other areas.

Environmental Groups
The Natural Resources Defense Council Document is a must read for the environmental group letters submitted! It clearly lays out so many of the flaws with the DEIR! Rather than a summary, go right to the document here!

Individual comments
Finally, many dozens of residents did their best to add their voices commenting on their personal concerns, whether or not they attended the five workshops offered. Some wrote of living close to the railroad tracks and their worries of a derailment and explosion. Others pointed out the noise and vibrations of the daily mile-long trains of heavy tank cars. Others wrote about the potential danger of crude oil trains on tracks that run through areas with earthquake fault lines, and many asked probing questions about the liability and who would cover the costs of accidents and spills. Many were concerned about our water supply as trains cross the mountains and our major rivers. A few raised questions about the cumulative impact of the Valero daily trains in the context of the proposed daily train to Phillips 66 Santa Maria refinery in San Luis Obispo County whose DEIR is to be released this month.

Next Steps
The review period for the federal Department of Transportation proposed safety rules remains open to public comment through September 30. A petition from ForestEthics is available for signatures through September 21.

The DEIR for the proposed recirculated DEIR for the Phillips 66 Rail Spur Project for the Santa Maria refinery in San Luis Obispo that will bring 80 tank cars of crude oil through Davis each day will be released mid-September for a 60-day review period.
