Housing Update should be adopted with “Environmentally Superior Alternative”

Protecting Historic Benicia

This Tuesday (Jan. 24) at 6 p.m. the Benicia City Council will consider adopting the Environmental Impact Report for the mandated update of the Housing Element of the General Plan. You may not realize what this means.

Let me explain.

In the City of Benicia the need for housing is being addressed substantively, urgently and comprehensively pursuant to state law. But it need not be an either-or-choice between protecting historic districts, places and needed housing. In fact, proposed overlay zoning on historic districts and places is deemed an environmentally cultural resource significant impact for the Housing Element.

The proposed overlay zoning is a significant impact on the historic districts listed on the National Register, the highest ranking in the United States.

The Housing Element Update Environmental Impact Report provides a remedy which is to avoid the impacts to cultural resources by adopting the Environmentally Superior Alternative.

The Environmentally Superior Alternative avoids impacts not just to historic districts and places (city cemetery) but also reduces impacts to aesthetic resources, energy, geology and soils, greenhouse gas emissions, hazards and hazardous material, hydrology and water quality, public services, population and housing, and transportation when compared to the proposed project (i.e. Housing Element).

There are substantial reasons to adopt the Environmentally Superior Alternative so why wouldn’t the staff and Planning Commission recommend that alternative to the council?

One reason might be because based on recommendations from the Association of Bay Area Governments to meet the State Housing Community and Development guidelines is to have a 15% “buffer” number of rezoned parcels to meet the mandated housing units of 750. It is calculated that removing all the historic districts, the city cemetery and Jefferson Ridge and Park Road projects would still provide 50% percent over the mandate.

Another reason might be that applying the zoning overlay for multifamily/mixed use on Southampton neighborhoods would be a harder local political fight than targeting the historic districts and places.

Another reason might be that by adopting the maximum number well beyond the mandates and buffer, that future development and land uses are cast now beyond the reach of future councils. Once the sites are identified in the housing element this time they are “forever” sites going forward and subject to less public review.

But reasons to adopt the Environmentally Superior Alternative go beyond avoiding significant impacts to historic districts and places and reducing environmental impacts listed including air pollution, and greenhouse gas emissions. It sends a signal that when the Seeno or so-called Eastern Gateway project is assessed we could count on the council adopting the environmentally superior alternative rather than a Seeno-preferred project.

Or what about a Valero Refinery project? Can we count on the council adopting an environmentally superior alternative?

If not now, when?

Benicia has experience with public participation for the needed future community planning for the proposed infill development. Indeed, the General Plan Oversight Committee in the late 1990s used this approach to find common ground between those who opposed and advocated for affordable housing. The accord reached was to include the neighborhood in the process. Dialogue is better than majority rule because it fosters solution-based conversations and in the end better planning (e.g. East 5th Street process).

More compact infill development in the Housing Element’s Environmentally Superior Alternative reduces the impacts to the climate by reducing vehicle miles traveled because the development is within the city’s core. This is consistent with Benicia’s General Plan, which proudly is based on sustainable development.

We can thoughtfully plan our community based on the Environmentally Superior Alternative — instead of sliding into the “development by right” that enables developers to potentially avoid needed environmental assessment for some areas.

Albert D. Seeno Jr., left, has sued his son alleging that Albert D. Seeno III, after his appointment in July 2020 as chief executive officer of his father and uncle’s businesses, improperly spent money and tried to shut them out from their own companies.

As Albert D. Seeno III seeks to strike a deal with Concord officials to lead the Bay Area’s largest development project, his father is trying to fire him as CEO of five companies in the family’s building empire.

In a stunning public airing of the internal fight for control of the businesses, Albert D. Seeno Jr., 78, has sued his son alleging that Seeno III, after his appointment in July 2020 as chief executive officer, improperly spent money and tried to shut out his father and uncle from their own companies.

While this court battle may seem like an internal business and family dispute, the allegations about Seeno III’s behavior and finances should concern members of the Concord City Council as they consider whether to partner with him for 40 years to develop the Concord Naval Weapons Station site.

Seeno Jr. says his son previously had taken hundreds of millions of dollars without permission from his father and his father’s companies, has debt of over $100 million, bullied his father to hire him as CEO under threat that he would otherwise never see his grandchildren, and has been abusive and misogynistic toward employees.

North Study Area

The North Study Area visioning project aims to solicit public input on potential future land use options for the North Study Area property. Community input, together with an economic analysis and evaluation of the property conditions, will be used to develop several mixed-use concepts for further public review. Once completed, the landowner may determine whether to move forward with initiating land use applications which must include a “Master Plan” (i.e., Specific Plan) as required by the Benicia General Plan and Zoning Ordinance.

The study area is a 527-acre undeveloped property in the northeast corner of the city. The property is within the City’s urban growth boundary and fronts on Lake Herman Road and East Second Street.  Although a number of site development proposals have been considered over the years, most recently in 2016, none have come to fruition. The property is currently zoned Limited Industrial (IL) and General Commercial (CG).

Visioning Process

The City wants to partner with the community to envision the future of this area, which is the last remaining large tract of privately-owned undeveloped land within Benicia.

There will be a variety of opportunities to learn more about this effort and to provide feedback over the coming year. The City will solicit public input through a series of community meetings, public events, and on-line engagement opportunities. The North Study Area Community-Led Visioning Process is divided into the following primary tasks:

  • Existing Conditions Review: Review of background materials and existing conditions information relevant to the visioning process.
  • Economic Analysis: Analysis of real estate market conditions, financial feasibility of land use alternatives, and net annual fiscal impacts of land use alternatives.
  • Issues and Options: Evaluation of key issues and options associated with development options.
  • Mixed-use Concepts: Consideration of alternative land use concepts for the property.
  • Summary Report: Summary of public input received and areas of consensus that emerged from the visioning process.

The City has formed an advisory group for the North Study Area project to help distribute information about the project, provide feedback on project materials, and to bring together diverse community perspectives. The advisory group consists of one representative selected by each of the following City committee/commissions and community organizations.  Meetings are open to the public.

Susannah Delano: Recruiting a Legislature that looks like California (finally)

For the first time, a majority of our legislators are women, people of color or LGBTQ+

Successful groups know that recruiting great talent is essential.

College teams invest in scouting to find the kid who could be tomorrow’s star center. Major corporations recruit year-round to hit growth targets. Organizations recruit to ensure their teams reflectthe communities they serve.

In politics, though, recruitment is often left to chance, or to the good old boys network.

The 2022 U.S. Senate races reveal how decisive candidate recruitment is. Underwhelming contenders recruited by former President Trump failed in Pennsylvania, Arizona and Nevada, and the GOP lost its chance to control the Senate.

While California has the fourth largest economy on the planet, its Legislature ranked 23rd nationally in women’s representation before the 2022 election.

That’s why Close the Gap called on progressive organizations years ago to join us in prioritizing a shake-up. Investing in diverse women early was the only way we could convert the opportunity we saw on the horizon — 90+ seats opening 2022-2028 due to term limits.

With allies across the state, we identified women who would make excellent legislators, and invited those who rose to the top to run. By the time our Legislature’s “Great Resignation” increased the number of open seats five-fold this year, higher numbers of more diverse women than we’ve ever seen were ready in targeted districts.

We had to disrupt the paradigm of candidates handpicked by insiders to elect a more representative legislature.

I’m happy to report that it worked: This week, the most diverse Legislature in California history will be sworn into office.

In a dramatic 92% increase since 2017, 50 women (the majority women of color) now serve, an historic high-water mark of 42%. For the first time, a majority of our legislators are women, people of color or LGBTQ+ – just like California is proud to be.

Here are five Bay Area examples of the new talent transforming the legislature.

Lori Wilson (AD 11) served as Suisun City mayor before winning a special election to succeed Assemblymember Jim Frazier. She is the new chair of the Legislative Black Caucus and the first Black Assemblymember to represent Solano County.

Gail Pellerin (AD 28) was chief elections officer in Santa Cruz County for nearly three decades. As county clerk, she says she “managed the office of love and voting.” She is the first woman from Santa Cruz to serve in the Assembly.

Aisha Wahab (SD 10) is the daughter of Afghan refugees who served as chair of the Alameda County Human Relations Commission and as Hayward City Councilmember. She is the first Afghan-American legislator, and will join the Renter’s Caucus.

Liz Ortega (AD 20) was the first Latina to lead the Alameda County Labor Council. She is the daughter of immigrants who were previously undocumented.

Dawn Addis (AD 30) has served as a classroom teacher, co-founder of her local Women’s March, and Morro Bay Councilmember. She flipped a formerly Republican-held seat blue in a new district stretching up to Capitola.

When women run, they win just as often as men. What’s been missing is enough female candidates competing, and the infrastructure to prepare and sustain them against hand-picked good old boys. If all it took was a cultural moment or many open seats, women would have hit parity decades ago.

A strong, diverse, effective team doesn’t just happen – you need to recruit for it.

With 50 more seats opening in the next six years, there’s a robust effort already underway to ensure our state house can raise the nation’s bar for equitable governance this decade.

Heads up to the good old boys: there’s no pushing us off the path to parity now.

BENICIA – At the December 6 City Council meeting, newly elected Councilmembers Terry Scott and Kari Birdseye were sworn in to serve the next four years.

Former Councilmembers Lionel Largaespada and Christina Strawbridge were honored for their service to the City and gave speeches thanking the community, fellow councilmembers and City staff for all of their hard work and collaboration.

The Council is now made up of Mayor Steve Young, Vice Mayor Scott, Tom Campbell, Trevor Macenski and Birdseye.
