“Uprail” government agencies critical of Valero Benicia environmental report

Safety still a primary concern with Valero rail transport plan

FAIRFIELD — Most of those who provided formal comments on the revised draft environmental impact report for the Valero crude-by-rail project in Benicia focused on a need for increased safety and possible mitigation measures.

The city of Benicia Planning Department received plenty of input leading up to last week’s deadline for submitting written comments on the revised report.

The proposed project would allow Valero to transport crude oil to its Benicia refinery on two 50-car freight trains daily on Union Pacific tracks that come right through downtown Davis on their way to Benicia. The trains also pass through Dixon, Fairfield and Suisun City.

The rail shipments would replace up to 70,000 barrels per day of crude oil currently transported to the refinery by ship, according to city documents. The Valero refinery would continue to receive crude by pipeline, the city said.

Among the written comments submitted on the revised impact report was an eight-page response from the Sacramento Area Council of Governments. The agency responded on behalf of the 22 cities and six counties in its jurisdiction, including the city of Davis and Yolo County.

“Our earlier letter expressed grave concern that the DEIR concluded that crude oil shipments by rail pose no ‘significant hazard’ to our communities, and we urged the city of Benicia to revise the DEIR to fully inform decision-makers and the public of the potential risks of the project,” SACOG said in its remarks.

The agency’s response included a list of eight measures its board of directors indicated that, at a minimum, should be followed.

Those directives include advance notification to county and city emergency operations offices of all crude oil shipments; limits on storage of crude oil tank cars in urbanized areas of any size; and appropriate security for all shipments.

Other directives outlined need for support, including full-cost funding for training and outfitting emergency response crews; and use of freight cars with electronically controlled pneumatic brakes, rollover protection and other features that mitigate what the agency believes are the risks associated with crude oil shipments.

Finally, the agency calls for the implementation of Positive Train Control to prioritize areas with crude oil shipments.

Solano County Resource Management Director Bill Emlen, a former Davis city manager, noted in his response that he had no specific comment on the revised report, but that the county stands behind its initial remarks about the original draft report.

In those remarks, dated Sept. 8, 2014, Emlen said the county wanted more done to address potential derailments.

The original draft EIR admitted the project “could pose significant hazard to the public or the environment,” but minimized the chances of that happening.

“Although the consequences of such a release are potentially severe, the likelihood of such a release is very low,” the report said.

Emlen disagreed that the accident risks associated with the crude-by-rail proposal are “less than significant” without mitigation.

Valero plans to use a type of tank car designated as CPC-1232 to transport oil between Roseville and Benicia and there will be a 40 mph speed limit through federally designated “high-threat urban areas,” including cities along the route, according to the draft report.

Emlen said it appears Valero’s use of the CPC-1232 tank cars is voluntary, rather than mandatory. He also pointed out that the federal designation for high-threat urban areas extends only 10 miles east of Vallejo and 10 miles west of Sacramento, which leaves out most of Solano County.

Emlen cited a derailment and spill that took place in Virginia with a train using CPC-1232 tank cars and traveling 23 mph.

“Therefore, the use of CPC-1232 tank cars at low speeds does not alone mitigate the potential impact from a train derailment,” he said.

Other cities that submitted a written response on the revised draft included Davis, Albany, Gridley and Briggs. Other counties that responded included Yolo, Placer and Nevada counties.

An original draft EIR was issued for the project in June 2014. Benicia said it issued the revised draft EIR in response to requests made in that original report. The city released the revised document Aug. 31 for a 45-day review period. It later extended the deadline for submitting written comments from Oct. 16 to Oct. 30.

The Benicia Planning Commission also gathered public input on the revised document at a Sept. 29 meeting.

The Valero project involves the installation of a new railcar unloading rack, rail track spurs, pumps, pipeline and associated infrastructure at the refinery, according to a city report. The crude would originate at sites in North America.

Union Pacific Railroad would transport it using existing rail lines to Roseville, and from there to the refinery, the city said.

Governor ties ruinous fires to climate change

CLEARLAKE, Lake County — The imminent danger from the devastating Rocky Fire in Lake County diminished Thursday and hundreds of residents began to return to their evacuated homes, but Gov. Jerry Brown made clear in a visit to the area that California is still in danger.

Brown traveled to the scorched hillside at Cowboy Camp, just off fire-ravaged Highway 20, and, as helicopters circled nearby, said the fire illustrates that climate change is both real and destructive.

“California is burning,” he said. “What the hell are you going to do about it?

“This is a wake-up call. We have to start coming to our senses. This is not a game of politics. We need to limit our carbon pollution. These are real lives and real people. This problem cannot be solved year by year.”

Nearly 3,600 firefighters have been fighting the fire, which was 45 percent contained Thursday and had burned 69,600 acres. Full containment is expected by late next week, but the California Department of Forestry and Fire Protection began letting roughly 800 of the more than 1,400 people who had been evacuated back into their homes.

Evacuation orders were lifted in the Wilbur Springs area on the northeastern side of the fire, off Highway 20. Only residents with identification will be allowed access to Wilbur Springs Road, near the border between Lake and Colusa counties, Cal Fire officials said. Residents on the south side of the fire, east of Highway 29 to West Jerusalem Valley Road, were also allowed to return home, officials said.

Still more evacuees, forced from their homes in the Spring Valley area, would probably be allowed back Friday morning, officials said.

Closures continue

Highways 16 and 20 remained closed Thursday except for a small portion of Highway 20 at Wilbur Springs, which is accessible only coming from the east off Interstate 5, officials said.

“Weather conditions across California are significantly improved compared to last week,” said Daniel Berlant, Cal Fire spokesman, who warned that the relief could be just a temporary phenomenon. He said weather forecasters are “expecting changing weather conditions over the next couple of days, with thunder systems moving in across Northern California.”

Red-flag warnings have been issued for dry lightning and gusting winds over the next couple of days, he said.

Brown received a briefing from officials overseeing the blaze, which has been burning for more than a week in Lake County and has spread to Yolo and Colusa counties. Forty-three homes have been destroyed and thousands of others threatened, and hundreds of local residents remained evacuated from their homes Thursday, according to Cal Fire.

While veteran firefighters said their efforts were business as usual, many stressed that this year’s blazes are out of the norm. The persistent drought, extremely hot weather and blustery winds all have the feel of something new and more dangerous.

Governor’s warning

“We are now in an extreme weather event,” Brown cautioned. “This is not the way these fires usually behave. If it continues year after year, California can literally burn up.”

Brown said he had talked to a resident who said he not only lost his home but also would find it difficult to rebuild because he had no insurance. Apparently, that’s not unusual. Insurance carriers sometimes decline to cover property in the steep, wooded canyons in the area.

The Rocky Fire is so pervasive that the Bay Area Air Quality Management District warned Thursday that smoke from the wildfires might impact areas in Marin, Napa, Sonoma and Solano counties. Air quality, however, is expected to be in the “good” or “low moderate” categories and is not expected to exceed air quality health standards.

Although climate change can be a hot-button political issue, Brown continues to use the California fires as an object lesson for climate change deniers. This isn’t theory, he said, gesturing to the moonscape scene behind him.

“This is credible enough to change some minds,” he said.

Mark Repetto, a firefighter from Sacramento’s Metro Fire Department, said the fire was a perfect storm of the worst conditions.

“Hot, dry and windy,” Repetto said. “Today is a little cooler, which means the humidity is higher. Monday the humidity was in the teens. That and hot weather pre-heat the fuel. It’s already hot before the fire gets there.”

Surge still possible

Although fire officials predict the Rocky Fire will be fully contained by next week, another hot, windy, low-humidity day could easily spark another fiery surge. Along Highway 20, hot spots still sent up plumes of smoke.

Brown said the worst is yet to come.

“We have people acting like (if the Rocky Fire is contained) it’s the end,” he said. “Unfortunately, we know that historically August and September are worse than July. So fasten your seat belt.”

Over the weekend, Cal Fire reported more than 100 dry-lightning-sparked fires in remote reaches of Northern California. In Humboldt County alone, 75 blazes have burned more than 4,000 acres since July 31, with just 35 percent containment reported Thursday.

The cause of the Rocky Fire has not been determined. Fire officials fear lightning could prompt additional lands to burn and complicate the suppression effort.

Conditions around California are ripe for a lightning fire after four dry years, said Daniel Swain, a Stanford University researcher studying climate.

“Things will ignite even if they get a little water from the storm,” Swain said. “This is a concern over the next 48 hours.”

Davis Enterprise: Garamendi calls for greater Bakken oil-by-rail safety

Garamendi calls for greater Bakken oil-by-rail safety

Rep. John Garamendi, D-Walnut Grove, called for less volatile Bakken crude oil — which is transported across the country by rail — on Wednesday morning, using the backdrop of the Davis Amtrak station to drive his point home.

Garamendi introduced the Bakken Crude Stabilization Act on March 26 in a bid to protect what he said are 16 million Americans living and working near railroad shipment lines. If approved, the bill will require lower vapor pressure for transported Bakken crude to reduce its volatility, a practice currently required in Texas and to some degree in North Dakota.

Vapors like propane and butane add to the unstable nature of Bakken crude during train derailments.

On Wednesday, Garamendi and other government officials explained why requiring more safety for railroad tank cars is essential to communities along rail lines like Davis and Fairfield, should there be an explosion. As if on cue, freight trains carrying black tank cars rumbled by as Garamendi spoke.

“You’d wipe out downtown Davis and possibly hundreds of people,” he said, adding that stripping out volatile vapors would prevent a fireball rising what he said was a hundred feet in the air.

Solano County Supervisor Skip Thomson said there are refineries and pipelines in his county, but also populations along rail lines and an environmentally sensitive marshland.

“If we de-gas the oil, that is a huge thing for safety,” Thomson said. “We need to ask that legislation be passed. … We need to move this quickly.”

Environmental groups say Bakken crude oil is transported through Yolo and Solano counties along Union Pacific Railroad lines that run through Davis, Dixon, Fairfield and Suisun City on their way to the Valero oil refinery in Benicia. A proposal is pending before the Benicia City Council that could increase the number of rail tank cars moving through those cities, increasing shipments to about 70,000 barrels of oil a day in two, 50-car-long shipments.

So-called “up-rail” community groups are fighting the proposal, and local governments in Yolo and Solano counties are working for better safety and oversight of the Valero project, which is still in the environmental review process.

Davis Mayor Dan Wolk said local agencies’ goal in the Valero project is not to stop commerce, but to ensure that adequate safety measures are in place.

Meanwhile, at the state level, a warren of rules protecting rail commerce prohibit states and localities from enacting restrictions on rail traffic, leading to calls for the federal government to step in.

However, laws protecting railroads, some more than a century old, ensure that railroads have a strong hand in approving any new regulations that the federal Department of Transportation or the Federal Railroad Administration may impose on their industry. Most regulations are created by consensus with the railroads.

Garamendi said a legislative approach is the quickest way to get the railroads to implement safety standards.

“Every day we delay the implementation of a stronger safety standard for the transport of Bakken crude oil by rail, lives and communities are at risk,” the congressman said in a prepared statement released at the news conference.

“We need the federal government to step in and ensure that the vapor pressure of transported crude oil is lower, making it more stable and safer to transport. We also need to upgrade and ensure the maintenance of rail lines, tank cars, brake systems and our emergency response plans.”

Getting railroads to help beef up local safety planning is a big part of what state and local governments are trying to wring out of the rail industry. One key demand is to get the railroads to disclose to emergency first responders what is inside their tank cars.

In a March 3 letter to the U.S. Department of Transportation written by Garamendi and Congresswoman Doris Matsui, D- Sacramento, the pair said the need for safer train cars has long been documented and is overdue.

“DOT began working on updated rules in April of 2012 and from 2006 to April of 2014, a total of 281 tank cars derailed in the U.S. and Canada, claiming 48 lives and releasing almost 5 million gallons of crude and ethanol,” the letter reads.

“Serious crude-carrying train incidents are occurring once every seven weeks on average, and a DOT report predicts that trains hauling crude oil or ethanol will derail an average of 10 times a year over the next two decades, causing billions of dollars in damage and possibly costing hundreds of lives.”

Asked Wednesday what the chances are of a railroad safety bill passing through a Republican-controlled Congress, Garamendi said “excellent,” evoking some chuckles from other government officials standing by.

What does a Central Coast oil refinery have to do with Davis?

In communities up and down the West Coast, groups of environmentalists, neighbors and local governments are doing whatever they can to mitigate or outright stop railroad terminals being built at coastal refineries at the end of rail lines that cut through cities and sensitive environmental areas.

Davis residents joined the fight earlier this year against the Valero oil refinery in Benicia, and now are adding their voices to a chorus opposing a Phillips 66 facility in San Luis Obispo County.

A local collection of environmental watchdogs called the Yolano Climate Action Group was one of the first to realize the potential public safety threat of Bakken crude oil trains traveling from out of state, through Roseville, Davis and to Benicia.

The group successfully petitioned the city of Davis Natural Resources Commission in January to oppose the Valero project. The commission then was successful in persuading the City Council a few months later to begin monitoring the project and round up support from government agencies like Yolo County and the Sacramento Area Council of Governments to lobby Benicia for a more complete environmental impact report.

“It was Davis that alerted the entire region,” said Lynne Nittler, a coordinator for the Yolano Climate Action Group.

Meanwhile, Davis’ state and federal representatives have been doing what they can, within the limits of strong federal pre-emption laws for railroads.

Trains carrying the hazardous materials have derailed and exploded in recent years, most notably in Lac-Mégantic, Quebec, where a July 6, 2013, derailment caused a fire and wiped out a portion of the town, killing 47 people and forcing 2,000 others to flee. A subsequent derailment and explosion just outside Casselton, N.D., in January also alarmed the public.

If the Valero refinery railroad terminal is built at Benicia, Davis would see trains estimated to be 100 cars long filled with volatile Bakken shale crude oil traveling straight through downtown along the same route the Amtrak Capital Corridor uses to carry commuters.

Phillips 66 terminal

But Davis faces another possible threat, as well.

Far to the south and west of Davis are the Central California coast communities of San Luis Obispo County, housing the Phillips 66 oil refinery near the Nipomo Mesa and — potentially — another rail terminal.

That terminal would attract more trains filled with Canadian tar sands crude oil, traveling through Roseville, Davis, Oakland, San Jose and Salinas to Phillips 66. While somewhat less volatile than Bakken shale crude, tar sands crude is mixed with chemical thinners that make it potentially explosive.

The county is leading the environmental review process for the railroad terminal. Yolano Climate Action Group, the city of Davis and SACOG have submitted their concerns, as well.

Shinderman said Nittler has been helping from the start, giving advice to the Mesa Refinery Watch Group.

The mission among the Davis group is to get people to go from NIMBY to NOPE, or from saying, “Not In My Back Yard” to “Not On Planet Earth,” Nittler said.

It represents a shift in thinking from opposing a particular project to a wider understanding of what environmentalists consider a dangerous trend of oil by rail along the West Coast.

In San Luis Obispo County, the rail line that would carry the oil runs through the Cal Poly SLO campus and over a bridge adjacent to a county drinking water treatment facility.

“The reality is there is human error, there are guys who are going to fall asleep at the switch,” Shinderman said. “You can’t mitigate for human error. The railroad is hiding behind the skirt of federal pre-emption and saying, “Ah, you can’t do anything.’ ”

Federal protection

Under federal code, any laws governing railroads must be uniform across the country, “to the extent practicable.”

That forbids the vast majority of local tinkering, but a small “savings clause” says a state may regulate some railroad activity provided the situation is geared at a local, but not statewide, safety hazard; is not in conflict with federal law; and does not “unreasonably” restrict railroad commerce.

The party claiming federal pre-emption has the burden of proof in any case.

In the matter of the railroad terminals, local cities and counties are ostensibly in charge of the approval — or disapproval — of the projects.

Even there, federal law may give the oil companies and the railroads a recourse in court if the terminals aren’t built.

According to the Association of  American Railroads, rail safety is a top priority. In accordance with a 2014 emergency order from the federal Department of Transportation, rail companies are required to notify state emergency response agencies about the routes of trains carrying large amounts of Bakken crude.

The association also notes that railroads train thousands of first responders, including using a $5 million specialized crude-by-rail training and a tuition assistance program, which is estimated to serve 1,500 first responders in 2014.

“If an incident occurs, railroads swiftly implement well-practiced emergency response plans and work closely with first responders to help minimize injuries or damage,” reads a position statement on the association’s website.

The association said the industry is also advocating for safer rail cars that are less prone to disaster. The association claims that in 2013, freight railroads “stepped up the call for even more rigorous standards for tank cars carrying flammable liquids” that included asking that existing tank cars be retrofitted to meet higher standards or be “phased out.”

Nittler said that was a smokescreen, and the federal government does not impose rules the industry doesn’t agree to first.

Even according to AAR, the federal Railroad Safety Advisory Committee that develops safety standards for rail transport uses a “consensus process” to impose new safety standards.

Legislative help

Davis’ Democratic congressman, Rep. John Garamendi, is a member of the House Committee on Transportation and Infrastructure. He said the committee is in the process of crafting new rules for railroads.

“I have and will continue to push them to write the strongest possible guidelines,” Garamendi said in an email.

At the state Capitol, state Sen. Lois Wolk, D-Davis, is part of efforts to pass laws that levy taxes on railroads to provide money for first responders.

“The volume of crude oil being imported into California has increased 100-fold in recent years, and Valero has plans to ship 100 train cars of crude oil per day through the heart of my district to its refinery in Benicia,” Wolk wrote in an email.

“… Currently, local governments along these transport corridors don’t have sufficient funding to protect their communities. When the Legislature reconvenes in January, I will push for funding for developing and maintaining adequate state and local emergency response to accidents and spills involving rail transports of crude oil and other hazardous materials.”

Union Pacific and Burlington Northern Santa Fe railroads filed suit against the state in October, claiming that California or any other state does not have the authority to impose safety requirements on them because federal law already does that.

That may put a damper on a new North Dakota law passed Thursday that requires companies to stabilize the volatility of Bakken crude before shipping it out of the state. Texas already requires such handling.

In the meantime, Nittler is busy trying to drum up support for a letter-writing campaign to the SLO Board of Supervisors before a 4:30 p.m. deadline Monday for comments on its draft environmental review.

“If they don’t build it, they won’t come,” Shinderman said.
