Dayton pressures railroads to pony up for safety upgrades across Minnesota

ST. PAUL, Minn. — Gov. Mark Dayton gave railroad companies and Republicans a public tongue-lashing Friday for their resistance to his tax plan to fund safety improvements across Minnesota’s railroad network.

Seven trains haul North Dakota crude across Minnesota daily — an influx that has contributed to backlogs of agricultural shipments and raised safety concerns after a string of recent explosive derailments.

With a throng of officials from towns dealing with the headaches of heavier train traffic behind him, Dayton called it “totally unacceptable” that railroads would oppose contributing more money to the state’s safety efforts. The governor and other fellow Democratic lawmakers have proposed a series of tax increases and annual fees on railroads to upgrade railroad crossings and ease congestion across Minnesota.

“That is the responsibility of the railroad,” Rep. Paul Marquart, DFL-Dilworth, said of improvements.

By taxing train cars and levying an annual fee on Minnesota’ four major freight railroads, the state would net $330 million over the next decade, mostly for improvements at railroad crossings. Dayton’s plan would also fund increased training for first responders, including a new statewide training facility.

The governor is also planning to carve out $76 million from a bonding bill this year to build underpasses or overpasses in Moorhead, Prairie Island, Coon Rapids and Willmar, where passing trains block crossings for hours every day.

Railroad companies such as BNSF Railway, the state’s largest freight railroad and a major shipper of Bakken crude, balked at the governor’s proposal. In a statement, spokeswoman Amy McBeth said the company believes Dayton’s proposed taxes violate federal law “because they single out railroads for discriminatory taxation.”

The other three major freight railroads operating in Minnesota are Canadian Pacific, Union Pacific and Canadian National.

Majority House Republicans have also signaled they’re not on board with the tax increases.

“While the governor and I agree that our railroad crossings need improvements, the funding source is still the main issue,” said Rep. Tim Kelly, the Republican chair of the House Transportation Finance committee.

Dayton criticized Republicans for not supporting his plan, but he saved his strongest words for the railroad companies.

The governor said state officials believe they’re on solid legal ground to foot railroads with a larger tax bill. And he remained defiant in the face of a possible lawsuit from railroads if his proposal goes ahead.

“We’re going to do what we know is right for Minnesota. If they want to take us to court, that certainly shows their true colors,” Dayton said.

Washington – Reacting to a safety threat both regional and national, U.S. Sens. Chuck Schumer and Richard Blumenthal announced new federal legislation Sunday to improve safety at rail crossings like the one at which six people died in an accident on Metro-North’s Harlem line in Valhalla, Westchester County, earlier this month.

“The pain is still fresh … and Sen. Blumenthal and I feel compelled to act,” Schumer said as the two Democratic senators announced the bill at a Grand Central Station news conference. “We must improve safety at rail crossings for the sake of our drivers and our rail passengers.”

In 2013, more than 200 people died nationwide in 2,096 rail-crossing accidents, and the rate has held steady at about 2,000 accidents a year for several years. Over the decade from 2005 to 2014, there were 341 accidents in New York state, causing 59 deaths and 96 injuries, according to Federal Department of Transportation records.

The legislation would provide about $800 million over four years to local governments, states and the federal railroad and highway administrations to improve crossing safety, by focusing on engineering fixes, public education and safety enforcement.

Among the bill’s provisions is $100 million a year for four years to revive a tool provided to the Federal Railroad Administration by Congress in 2008 — but never implemented. It is a grant program designed to provide funding to states for specific engineering and technological fixes, public education and targeted law enforcement.

“It’s very unfortunate that Congress has neglected these programs,” Blumenthal, of Connecticut, said in an interview later Sunday. “Programs that the federal government had instituted to remedy these gaps … have gone unfunded and ignored.”

Blumenthal said that of the 212,000 rail crossings nationwide, nearly half have no active warnings — no lights, sounds or barricades, just a stop sign. “What you have are death traps for the unwary and unwarned,” he said. “We’re using 19th-century technology in the 21st century.”

He said the Federal Railroad Administration and the Federal Highway Administration have failed to focus on the problem. “They have not sounded the alarm,” he said. “They have been as silent about this danger as the unprotected crossings themselves.”

The bill would also:

  • Reauthorize yet another defunct FRA program to help states and communities relocate rail lines to fix glaring safety problems, providing $25 million per year for four years;
  • Increase funding for the Federal Highway Administration’s Railway-Highway Crossing Program, which provides for “separation or protection of grades at crossings, the reconstruction of existing railroad grade crossing structures, and the relocation of highways to eliminate grade crossings.” The $50 million per year for four years provided by the bill is in addition to the fund’s current budget of $220 million per year.
  • Increase FRA’s manpower to focus on grade-crossing issues;
  • Require the FRA to analyze new technology the public can use to report grade-crossing dangers;
  • Strengthen the federal government’s collaboration with Operation Lifesaver, a nationwide nonprofit dedicated to rail-safety education.

Blumenthal has been one of the Senate’s most strident advocates of increased rail safety, particularly since a spate of injuries and fatalities in accidents on Metro-North in 2013. He has been sharply critical of enforcement lapses at FRA, which regulates passenger and freight rail safety.

Schumer and Blumenthal are optimistic that the bill will find bipartisan support. “Many of these crossings are in states with Republican senators,” Blumenthal said. “And this bill can more than pay for itself if it reduces accidents. The 2,000 accidents each year — nearly one every three hours — cost $2.2 billion in property damage alone.”

“Too many innocent victims, drivers, train passengers and railroad employees have died,” Blumenthal said Sunday. He said these tragedies “are preventable … but without the decisive steps we urge, rail grade crossings will continue to be accidents waiting to happen.”

Gov. Jay Inslee directed state agencies Thursday to tackle mounting public safety concerns and develop an oil spill response plan as train traffic continues to increase, particularly in Southwest Washington.

He announced the directive at a meeting of The Columbian’s editorial board in Vancouver.

“The Pacific Northwest is experiencing rapid changes in how crude oil is moving through rail corridors and over Washington waters, creating new safety and environmental concerns,” the directive reads.

The governor asked the Department of Ecology to work with other state agencies, the Federal Railroad Administration and tribal governments to “identify data and information gaps that hinder improvements in public safety and spill prevention and response.”

Specifically, the governor’s directive asks agencies to:

  • Characterize risk of accidents along rail lines.
  • Review state and federal laws and rules with respect to rail safety and identify regulatory gaps.
  • Assess the relative risk of Bakken crude with respect to other forms of crude oil.
  • Identify data and information gaps that hinder improvements in public safety and spill prevention and response.
  • Begin development of spill response plans for impacted counties.
  • Identify potential actions that can be coordinated with neighboring states and British Columbia.
  • Identify, prioritize, and estimate costs for state actions that will improve public safety and spill prevention and response.

He set an Oct. 1 deadline for Ecology to respond.

He also said he’ll reach out to other states to develop coordinated oil transportation safety and spill response plans, and pledged to ask the 2015-17 Legislature for money for oil train safety.

The directive comes as the state Energy Facility Site Evaluation Council is reviewing an application by Tesoro Corp. and Savage Companies to build an oil shipping terminal at the Port of Vancouver. Bakken crude would arrive at Vancouver by train from North Dakota and leave by ship or barge via the Columbia River.

As governor, Inslee will have the final say on the Tesoro-Savage permit. Inslee said he had to be “very guarded” in his comments about the oil terminal while the review is happening. “We will make the right decision at the right time,” he said.

“I can tell you we have very serious concerns with safety associated with oil trains,” he said.

The governor said he would be “heavily invested in understanding the full ramifications” and plans to be as well-versed as anyone in the state on the topic.

Schools and bridges

The interview was wide-ranging; Inslee also talked about the need to close tax loopholes in order to find additional revenue to fund the state’s public schools.

“We have a sort of Swiss-cheese tax code because some lobbyists have been successful in getting some special favors over the decades,” Inslee said. “Some of those make sense … They are not uniformly virtuous.”

In this coming legislative session, he said, he will push lawmakers to increase the state’s minimum wage.

“I do believe minimum wage is one of the tools that are useful to give working people a fair break,” he said.

And, he said, the state continues to have a lot of “unmet needs” when it comes to transportation.

“Many of them are here (in Southwest Washington), the (Columbia River Crossing) just being one of them. We know there are other needs as well,” Inslee said.

Inslee said once the region has “legislators that really want to find a solution for Southwest Washington,” the area would be better represented in any transportation package.

Inslee was asked about Republican efforts to organize a new bistate bridge coalition. He said the only thing he’s heard is “there have been some discussions.”

It’s an effort spearheaded by Sen. Ann Rivers, R-La Center, and Rep. Liz Pike, R-Camas. Yet another bridge plan is being promoted by Republican County Commissioner David Madore, who vows to open his bridge to traffic in five years.

“The last bridge took, I think, 10 to 13 years to get all the permitting done,” Inslee said. “This is an arduous, lengthy, multijurisdictional process … There might be 1,000 other plans.”

A new bridge is “pivotal to the entire state” and he planned to spend his day in Vancouver talking to “people of good faith and open minds” to discuss the best way to move forward.

The first-term Democrat spent all day Thursday in Vancouver. He presented awards to state Department of Transportation employees, and visited a local technology firm, Smith-Root, that is expanding. Thursday evening he gave the commencement address at the Washington School for the Deaf’s graduation ceremony.
