 2 Investigates: Safety concerns over trains carrying volatile crude oil to Bay Area

RICHMOND, Calif. – California used to receive all of its crude oil imports by ship and pipeline, but trains loaded with tanker cars full of oil are rolling through Bay Area neighborhoods with increasing frequency. And it’s a growing safety concern among experts who say rail imports will become much more common in the next few years, bringing millions of gallons of crude to local refineries.  Much of that crude is a more volatile type of oil that has been linked to multiple derailments, fires, and deadly accidents.

And the railroad is not required to tell local officials how many of those cars are carrying a more volatile oil from the Bakken shale formation, which stretches from North Dakota and Montana into Canada.

The transport of Bakken crude by rail has been at the center of federal investigations and calls for increased safety standards. It’s delivered to the Kinder Morgan rail yard in Richmond, but local officials complain that they receive no notification of which trains are carrying Bakken crude.

Increased deliveries and increased danger

“These are trains that have up to 100 tank cars and those are filled with Bakken crude,” said Kelly Huston, Deputy Director with the Governor’s Office of Emergency Services (OES). “That’s an entire train full of a much more volatile type of crude oil than we typically see on rail.”

In January, the U.S. Department of Transportation issued a warning that Bakken’s light, sweet crude oil is prone to ignite at a lower temperature than traditional crude oils. Experts say lighter crudes contain more natural gas, and the vapors given off by the oil can ignite at much lower temperatures.

But the oil industry pushed back with its own study that disputed the government warning. The North Dakota Petroleum Council, which represents more than 500 oil companies operating in North Dakota and Montana, commissioned a $400,000 study of Bakken crude. It determined the oil’s characteristics are within the safety margin for the current fleet of rail tankers.

However, the state’s Rail Safety Working Group –convened by the Governor’s Office of Emergency Services (OES) – wasn’t convinced. It released a report that warns about the dangers of increasing the shipments of Bakken crude to California refineries. The report points to at least eight major train accidents involving Bakken crude trains in 2013 and 2014 alone.

Some of the most notable accidents include a derailment in Lac-Mégantic, Quebec on July 6, 2013. Sixty-three tank cars of crude oil exploded, killing 42 people. Five other people were also presumed to be dead, but were never recovered.

In 2012, about one million barrels of crude oil were delivered to California by rail. But by 2013 that number had jumped to about 6.3 million barrels.  The California Energy Commission estimates that volume could increase by up to 150 million barrels, or 25% of total crude imports, by 2016.

According to the California Public Utilities Commission (CPUC), the primary source of the crude oil coming into California was from North Dakota, in early 2013. But by the end of that year, the state was receiving a dramatic increase in imports from Canada.

Old tanker cars

For more than twenty years, the federal government has been aware of major flaws in one of the most common tanker car designs used to transport crude oil across America.

According to a 1991 safety study from the National Transportation Safety Board (NTSB), the DOT-111 tanker has a steel shell that is too thin to resist puncture during an accident, is vulnerable to tearing, and has exposed fittings and valves that can easily snap off during a rollover.

Torn DOT-111 Tanker Car And DOT-111s make up nearly 70 percent of oil tanker cars currently in use in the U.S., according to the NTSB. Critics say that shipping volatile Bakken crude in these tankers poses an “unacceptable risk” to public safety.

In his Congressional testimony in February, NTSB board member Robert L. Sumwalt cited multiple train accidents and derailments involving Bakken crude transported in DOT-111 tanker cars.

“The NTSB continues to find that accidents involving the rupture of DOT-111 tank cars carrying hazardous materials often have violent and destructive results,” Sumwalt said.

“Federal requirements simply have not kept pace with evolving demands placed on the railroad industry and evolving technology and knowledge about hazardous materials and accidents.”

This past summer, the DOT announced that it would propose stricter rules for transporting flammable materials by rail car, including Bakken crude. The plan calls for DOT-111 tanker cars to be phased out, unless they can be retrofitted to meet the new standards.

Last month, Jack Gerard, president of the American Petroleum Institute, said that his group and the Association of American Railroads would jointly ask the DOT for six to 12 months for rail tank car manufacturers to prepare to overhaul tens of thousands of cars, and another three years to retrofit older cars.

But critics say the government’s plan doesn’t act swiftly enough.
Devora Ancel, a staff attorney with the Sierra Club, said the group has multiple concerns about Bakken crude trains coming into California, in particular in regards to the age of DOT-111 fleet.

“It is extremely alarming and the public should be concerned,” said Ancel. “It’s being carried in rail cars that are unsafe. They were designed in the 1960’s. They were not meant to transport highly volatile crude.”

The Sierra Club and Earthjustice submitted a petition to the DOT seeking an emergency order to ban the transportation of Bakken crude in DOT-111 tank cars. The petition acknowledges that the DOT’s proposal for stricter rules is a step in the right direction, but stresses that two years is too long to phase out the DOT-111 cars.

“The last few years have witnessed a surge in shipments of highly flammable crude from the Bakken region, mostly in unit trains with dozens and often more than 100 tank cars carrying explosive cargo. The growth in the number and length of trains carrying crude oil is staggering,” the petition said.

But the fire officials tells KTVU that they’ve been reassured by Kinder-Morgan that the DOT-111 tank cars that make deliveries to Richmond have undergone additional safety modifications. Every individual tanker car carries more than 28,000 gallons of crude oil.

Tracking routes

Trains entering the Bay Area carrying crude oil from Canada and North Dakota must pass through parts of California that are considered hazardous routes, according to Huston.  In the California Public Utilities Commission’s (CPUC) annual railroad safety report, released in July, the agency said California has had 58 train derailments in the last five years, and primary cause has been a problem with the track at so-called “hazard sites.”

The state’s OES report on rail safety also voiced concerns about risky routes being used to transport Bakken crude.  The Rail Safety Working Group complained that crude oil rail transportation is not regulated adequately.

The report states that crude oil is “not transported with the level of protection mandated for the degree of hazard posed,” and also stressed there are “inadequacies in route planning to avoid population centers and environmentally sensitive areas, and a need for auditing rail carriers to ensure adequate response.”

One of OES’s biggest concerns is that it receives very little information about the Bakken crude trains’ schedules, and none of the data it does receive is in real time.

“Just like you would know where an Amtrak train is and whether is late to a station or not,” said Huston. “We should be able to know that about volatile substances like Bakken crude coming across our rail lines.”

Emergency response

The growing worries over the volatility of Bakken crude are particularly important for firefighters and other emergency responders who have to deal with derailments and possible fires.
According to the OES, the biggest areas of concern lie in the rural areas of Northern California, where emergency response crews are far from remote rail lines and wouldn’t be able to respond to a spill or fire quickly.

The OES report states that while there are emergency crews prepared to handle a crude tanker disaster in urban areas, “none are located near the high hazard areas in rural Northern California.” And HazMat teams that are located in more remote regions “are equipped to perform only in a support rather than lead role during a major chemical or oil incident.”

“If you get one of those trains derail and that stuff goes into the river that could affect an entire population’s water supply, which is, in some cases, worse than having a derailment in a population center,” said Huston.

They simulated a leak on an oil tanker car and practiced using foam to quell the vapors. A small group of Richmond firefighters will attend a similar training in December, according to the Richmond Fire Marshall.

The Valero-Benicia refinery is seeking a permit to bring in crude-by-rail shipments. They would join Richmond and a planned refinery in San Luis Obispo that would also be supplied with crude carried by train through the Bay Area.

But the idea is meeting resistance from worried neighbors.
Benicia’s city council must decide whether to approve a draft environmental impact report on the proposal. The $70 million terminal would receive two 50-car trainloads, carrying a total of about 70,000 barrels of crude oil, every day. The company has said that it will use newer tanker cars instead of the aging DOT-111s that have been involved in past accidents.

Chief Bateman insists that his crews are prepared if the worst should happen with a trainload of Bakken crude traveling through the Bay Area.

“I understand that it’s a big increase. I understand the public is concerned by that,” Chief Bateman said. “If you look at some of the other rail cars that are already on the tracks today… we’ve been shipping commodities for a long time.” Bateman points out that some of those other substances are more volatile than crude oil, such as liquefied petroleum gas.

Placard 1267 Signifies Crude OilWhen first responders arrive at chaotic train accident scene, all the black tanker cars essentially look the same. The contents are distinguished by a red, diamond-shaped placard on the side of the car that displays a four-digit code. The code for crude is 1267, but there is no way for emergency crews to tell if the oil inside is the volatile Bakken variety.

In April, Canada banned the older tanker cars and ordered the controversial design be phased out within three years. Last month, another train carrying crude oil derailed in Saskatchewan, involving the same kind of rail cars. There were no casualties in that accident.

Canada may require new electronically controlled brakes (and other measures) for oil trains … by 2020

The federal government is mulling a plan to require new electronically controlled air brakes for rail cars that haul dangerous goods such as crude oil and ethanol after a series of explosive oil-train derailments in Canada and the United States.

A consultation document sent to the railway transportation industry last month laid out Transport Canada’s proposal for a new class of tank car, including the new air brake system and full head shields to prevent punctures. Older-model DOT-111 tank cars have been heavily criticized as prone to puncture and corrosion.

Electronically controlled air brakes are favoured by some rail-safety advocates because they allow an engineer to apply the brakes on all of a train’s cars at the same time – regardless of how close they are to the locomotive.

In contrast, traditional air brakes rely on a signal that begins from the locomotive and moves car by car toward the back of the train. On longer unit trains such as those typically used to haul crude oil, rail cars near the back of the train won’t receive the signal as quickly, increasing the risk of a derailment when the brakes are applied suddenly.

Don Ross, who led the Transportation Safety Board’s investigation into last year’s rail disaster in Lac-Mégantic, Que., said the agency generally supports the use of the electronically controlled brakes because they can improve rail safety, particularly on longer trains. “It’s encouraging, now, that they’ve got out for discussion a very good standard,” Mr. Ross said in a recent interview.

“We would be very happy to see the industry adopt that.”

Transport Minister Lisa Raitt told The Globe and Mail on Friday that she had already begun consultations on the matter, but has so far heard that the industry does not believe electronically controlled air brakes are necessary. “The ones that I’ve been speaking to say it’s too difficult to implement in the North American market,” Ms. Raitt said, adding, “That’s the consultation so far, but we’re still gathering information right now.”

One concern with electronically controlled brakes is that the system would need to be installed on all of a train’s cars for it to function properly, a factor that would limit railways’ flexibility in assembling longer or mixed trains.

In addition to the new air brake system, the proposed new standard includes full head shields to prevent puncture, improved top-fitting protection for the pressure release valve, mandatory thermal jackets to prevent overheating, and new standards for bottom outlet valves to prevent leaks during an accident.

The standard goes beyond requirements announced in April for a three-year phaseout or retrofit of pre-2011 tank cars used to haul crude oil. Those rules included half-head shields, top-fitting protection and thicker steel.

The new proposal would give industry until May, 2020, to start using the next-generation cars to move the most dangerous flammable liquids, classified as Packing Group 1. New or retrofitted cars would be required for moderately dangerous flammable liquids by May, 2022, and for all flammable liquids by May, 2025.

A spokesperson for Canadian Pacific said on Friday that the company is evaluating Transport Canada’s proposal, but did not comment on any specific aspect of the proposed change. Canadian National said it is reviewing the proposal and would provide comments to the regulator as part of the consultation process.

Last month, U.S. regulators issued three possible requirements for next-generation DOT-111 tank cars.

The toughest standards proposed by the U.S. are similar to the Transport Canada proposal and include electronically controlled air brakes.

Crude Oil by Rail Opponents Stage Protests

SACRAMENTO – Activists concerned about the danger of crude oil train shipments through populated areas took part in a national day of action Wednesday, including events in Sacramento and Davis.

Laurie Litman heads up 350 Sacramento, a group concerned about global warming. She notes that shipments of crude oil in California have increased 1,300 percent over the past four years.

Litman circulated a map at a rally outside a federal building in Sacramento showing neighborhoods and schools that would be affected by a fiery oil spill like the one that killed 47 people in Quebec, Canada a year ago.

“These are not fires that can be put out. They need to burn out, so if that happens when a train comes through the middle of Sacramento, we are in trouble” Litman said.

Sacramento Assembly Member Roger Dickinson addressed the gathering, telling them that emergency agency need to know what volatile oil shipments are being transported and when. He has authored a bill requiring rail companies to provide that information and have access to real time communications gear to get information to local officials.

Several rail spills occurred in areas where emergency responders had no little information of what was spilled.

“To assure that we get the information that we need, and the information that we need in a timely way,” said Dickinson.

Many at the rally were advocating a reduction in the use of crude oil as a long term solution to the threat of oil derailments.

“It’s not if, it’s when because it has happened before,” David Link, of the Sacramento Electrical Vehicle Association, said Wednesday.

Activists in Davis are particularly concerned about a plan to run 100 oil tank cars a day through Downtown Davis to a Valero refinery in Benecia. If approved, the trains would go from Roseville thorough Sacramento past Davis.

They handed out leaflets and circulated petitions at the Davis Rail Station.

Feds: Oil train details not security sensitive

BILLINGS, Mont. (AP) — U.S. transportation officials said Wednesday that details about volatile oil train shipments are not sensitive security information, after railroads sought to keep the material from the public following a string of fiery accidents.

The U.S. Department of Transportation has ordered railroads to give state officials specifics on oil-train routes and volumes so emergency responders can better prepare for accidents.

Railroads have convinced some states to sign agreements restricting the information’s release for business and security reasons.

But the Federal Railroad Administration determined the information is not sensitive information that must be withheld from the public to protect security, said Kevin Thompson, the agency’s associate administrator.

Thompson added that railroads could have appropriate claims that the information should be kept confidential for business reasons, but said states and railroads would have to work that out.

Montana officials said they intend to publicly release the oil-train information next week.

The move is mandated under the state’s open records law and will help protect public safety by raising community awareness, said Andrew Huff, chief legal counsel for Gov. Steve Bullock.

“Part of the whole reason the federal government ordered that this information be given to states is to protect the communities through which these trains roll,” Huff told The Associated Press. “If there’s not some federal pre-emption or specific regulation or statute that prevents release of this information, then under our records laws we have to release it.”

Washington state officials also have said the oil-train details should be made public under state law. Last week, they gave railroads 10 days to seek a court injunction challenging the release of the information.

An oil-train derailment and explosion in Quebec last July killed 47 people. Subsequent derailments and fires in Alabama, North Dakota, Virginia and New Brunswick have drawn criticism from lawmakers in Congress that transportation officials have not done enough to safeguard against further explosions.

In response to the accidents, Transportation Secretary Anthony Foxx said in last month’s order that railroads must provide the details on routing and oil-train volumes to states. The order covered trains hauling a million gallons of oil or more from the Bakken region of North Dakota, Montana and parts of Canada.

The Bakken’s light, sweet crude is more volatile than many other types of oil. It’s been involved in most of the major accidents as the crude-by-rail industry rapidly expanded during the past several years.

Some states have agreed to requests from BNSF Railway, CSX and Union Pacific to keep the information confidential after the railroads cited security concerns. Those include California, New Jersey, Virginia, Minnesota and Colorado.

Officials in New York, North Dakota and Wisconsin said they still were weighing whether restrictions on the information would violate state open-records laws.

State officials who questioned the confidentiality agreements sought by the railroads have said the notifications about oil trains were not specific enough to pose a security risk.

BNSF — the main carrier of crude oil in many western states — was notified late Tuesday of Montana’s intentions. A representative of the Texas-based company had said in a June 13 letter that BNSF would consider legal action if Montana moved to release the details on oil shipments.

“We must be cognizant that there is a real potential for the criminal misuse of this data in a way that could cause harm to your community or other communities along the rail route,” wrote Patrick Brady, BNSF’s director of hazardous materials, in a letter to a senior official at the Montana Department of Environmental Quality.

Company spokesman Matt Jones said Wednesday that at this time BNSF has no plans to ask a court to intervene.

While it’s important for emergency planners to have the information, Jones added, BNSF will “continue to urge discretion in the wider distribution of specific details.”

A second railroad, Montana Rail Link, submitted notifications earlier this month revealing that its tracks were carrying three oil trains a week along a route from Huntley, Montana, to Sandpoint, Idaho. The railroad said the trains pass through as many as 12 counties across southern and western Montana and through Bonner County in Idaho, according to copies of the documents obtained by the AP.

U.S. crude oil shipments by rail topped a record 110,000 carloads in the first quarter of 2014. That was the highest volume ever moved by rail, spurred by the booming production of shale oil from the Northern Plains and other parts of the country, according to the Association of American Railroads.
