Valero’s Promise to Benicia: We’ll only have an environmental disaster once every 111 years.

Actually, that’s kind of worrisome, especially considering that if you don’t experience that disaster yourself, your kids probably will.  This is one of the many absurd elements showing Valero’s cavalier attitude toward public safety in the draft Environmental Impact Report (EIR) for its proposed crude by rail project, for which public comments were due this week.  The hazard analysis in this report is also a serious underestimate, according to the State among many others: The California Public Utilities Commission notes the serious failure of Valero to address the “potential for tragic consequences of crude oil tank car ruptures” from its proposed Crude by Rail Project.

This dangerous crude project is so riddled with problems that many communities up-rail are now voicing serious concern.  The City of Sacramento highlights the high concentration of people around the rail freight lines (“more than 147,000 City residents live within ½ mile”) serving the “Valero Benicia refinery [which] is one of two California refineries that are in the process of securing permits to build rail terminals to import Canadian tar sands and Bakken crude oils.” (emphasis added)  And the City of Davis suggests that the “highest levels of protection [be implemented] before disasters such as hazardous material releases and explosions occur [so that] we can avoid having such disasters in the first place.”

Benicians for a Safe and Healthy Community explain why the project is fatally flawed with 132 pages of concerns.  Valero’s crude by rail proposal is like so many other projects popping up all over the nation in a mad rush to access cheaper, extreme and dangerous crude oils, with little regard for public health or safety.  This project is a total disaster (based on NRDC, CBE and other comments) because it brings:

  • More Refinery Pollution: Bringing in extreme crudes like tar sands and fracked Bakken crude will only increase refinery pollution.  Valero’s Benicia refinery already releases 70 percent more toxic chemicals than the average for California.
  • Toxic Plumes Along Rail Lines: This thing called “crude shrinkage” happens during transport, where entrained gases escape, leading to a 0.5 to 3 percent loss of crude oil.  It’s a big problem for volatile crude oils like Bakken, and coupled with the high benzene levels found in some North American crudes (up to 7%), it creates a serious toxic plume around rail lines.  For instance, we estimate over 100 pounds per day of excess benzene emissions from the Valero proposal in the Bay Area (or 1800 times more than the draft EIR reports).
  • Extreme Crudes are Dangerous: Valero and other oil companies pretend that they can mix extreme crudes like tar sands and fracked Bakken into the ideal “Alaskan North Slope look-alike” crude, which sounds great, except that it doesn’t work that way in reality.  Both Bakken and tar sands carry their dangerous properties into any crude oil blend making it more volatile, toxic, and corrosive.
  • CBR Terminals at Refineries Amplify the Hazard: Valero proposes to site its crude by rail unloading facility within 150 feet of a number of very large refinery tanks that store highly flammable and potentially explosive material.  If a derailment occurred at the terminal, it could set off a chain reaction of fire and explosions at the refinery.  And there have been three derailments in Benicia outside the Valero refinery in the past year; luckily those trains were carrying petroleum coke, not crude oil.
  • Risk of Catastrophic Accidents All Along the Rail Route:  Valero’s “Barkan report” that estimates a release only every 111 years from the proposed 100 daily tank cars carrying crude is absurd for many reasons.  Most egregious is that it fails to consider recent data, like the six major crude oil train accidents over the past year that have resulted in massive fireballs and destruction, including 47 casualties in Lac Mégantic. The safety risks to tens of thousands of people living around these freight rail lines remains grave.

The oil industry has been promoting “look-alike” crudes that attempt to mimic conventional crude by blending extreme bottom of the barrel crudes.  The mile-long trains laden with these extreme crudes are a Trojan horse that puts millions of Californians at risk and threatens to undo several decades of environmental progress.  We need a moratorium on all new crude by rail projects, including Valero-Benicia, until the state can assess the cumulative impacts of these projects, make sure environmental impacts are fully mitigated and assure communities that they will be safe.

A bill by Sacramento Assemblyman Roger Dickinson requiring more disclosure about crude oil rail shipments has passed the Legislature and has been sent to the governor for his consideration. The bill is the last of several steps taken by the Legislature this summer to deal with safety concerns about the growing phenomena of 100-car oil trains rolling through Sacramento and other California cities on their way to coastal and Central Valley refineries.

The bill, AB 380, orders railroad companies to provide state and local emergency officials with information about oil and hazardous materials that may be shipped through their jurisdictions. It also also requires carriers, when shipping volatile Bakken crude oil, to provide the state with information about the volume of oil and timing of the shipment beforehand. The law also directs carriers to furnish the state with copies of the carrier’s hazardous material emergency response plan.

“The risk of catastrophic injury to life and property by rail accident has grown dramatically,” said Dickinson. “State and local emergency response agencies face new challenges when dealing with this amount of hyper-flammable or heavy crude oil. In order to prepare our emergency response agencies and protect our communities, it is essential that emergency response agencies have the information they need about the crude oil cargo in order to minimize any damage from an accident.”

A series of derailments and explosions has thrown a spotlight on the increasing numbers of crude oil train shipments in the United States. State energy officials say at this point only small amounts of California’s crude oil is arriving via trains from North Dakota and other areas of North America, but the amount is growing. Oil companies are building the capacity to accept as much as 23 percent of the state’s oil needs via train in 2016.

Reacting to statewide concerns, the Legislature and governor passed two budget bills in June to bolster state spill prevention and response efforts. One bill funded seven new rail and rail bridge inspectors for the state Public Utilities Commission. A second budget bill applied a fee to oil companies’ rail shipments to fund a state Office of Spill Prevention and Response program protecting inland waterways.

A last-minute bill, SB 1319, sought to impose a second fee on rail transports to support emergency hazardous materials response training. It died after oil industry officials complained the legislation duplicates other state and federal safety efforts, and that there was not adequate time to discuss and vet the bill.

Currently, only one rail company, BNSF, is transporting more than 1 million gallons of Bakken crude oil per train into California. According to reports the railroad is required to file with state emergency officials, a train carrying Bakken travels through Redding, Sacramento and Stockton on its way to a transfer station in the Bay Area several times a month, perhaps as often as weekly. The train uses the tracks that run through midtown Sacramento between 19th and 20th streets. BNSF has declined to offer more details about those shipments.

Sacramento leaders question Benicia’s crude oil rail project

Sacramento leaders will send a letter to Benicia today formally challenging the Bay Area city to do a better job of studying train derailment risks before it approves an oil company’s plans to ship crude oil on daily trains through Sacramento-area downtowns to a Benicia refinery.

Acting collectively through the Sacramento Area Council of Governments, which represents 22 cities and six counties, Sacramento representatives say they are protecting the region’s interests in the face of a proposal by Valero Refining Co. to transport an estimated 2.7 million gallons of crude oil daily on trains through Roseville, Sacramento, West Sacramento and Davis. Valero officials say the oil will be refined into gas for cars in California, as well as diesel fuel and jet fuel.

“We are not taking a position on whether the project should proceed,” said Don Saylor, a Yolo County supervisor and SACOG member. “We are pointing out, as we have the responsibility to do, the public safety issues in our region. There are ways those issues can be identified and mitigated.”

Benicia officials have been collecting public comments and questions about their environmental review of the Valero project plans, and said they will respond to all comments after the comment period closes Sept. 15.

The SACOG group also is drafting a letter to federal regulators, encouraging them to make hazardous materials transport on rail safer, particularly shipments of volatile crude oil produced in North Dakota’s Bakken region. Crude oil train shipments have increased dramatically in recent years, leading to several derailments and explosions, including one that killed 47 in a Canadian town last year.

Railroad officials nationally say derailments are very infrequent. A study commissioned by Benicia determined that a derailment and spill would be a rare occurrence on the line between Roseville and Benicia. But Sacramento leaders contend Benicia has underplayed derailment possibilities, and has not adequately studied the consequences of a spill and fire.

“We think there are serious safety concerns that should be addressed by Benicia, not downplayed,” said Sacramento Councilman Steve Cohn, chairman of the SACOG board.

The Benicia trains would travel on tracks just north of downtown, through the downtown Sacramento railyard, and over the I Street Bridge.

Elk Grove Mayor Gary Davis was one of two SACOG members who voted to oppose sending the letter. “I thought it is a little outside our scope. It’s a slippery slope,” he said.

SACOG’s main role is to serve as the region’s transportation planning agency and to administer a portion of the region’s federal transportation funding allotment.

Sutter County Supervisor James Gallagher also voted against sending the letter, saying many safety issues are in the federal government’s purview, not Benicia’s. He said he doesn’t want to discourage production of domestic oil that creates jobs and reduces reliance on foreign oil.

The 28-member Board of the Sacramento Area Council of Governments (SACOG) met on August 21, 2014, and listened to 15 community member comments from Davis, Sacramento, Dixon and Benicia who thanked them for their thorough and well-documented letter on uprail concerns not adequately addressed in the Benicia Valero Crude-by-Rail Project DEIR.  All urged the Board to submit the letter.

In addition, SACOG counsel Kirk Trost, who researched and wrote the letter, explained his efforts to execute their directions and stood by his letter.  A spokesperson from Valero claimed that many of the requests in the letter should be directed to the federal government due to federal preemption.  Union Pacific offered to serve as an information resource as they are not technically involved; however their letter to SACOG (also submitted to the DEIR) stresses federal preemption and states outright, with citations of similar cases, that ”neither SACOG nor its member agencies has authority to  impose the mitigation measures or conditions proposed in the draft Comment Letter on Valero Crude by Rail Project Environmental Impact Report.”

The SACOG Board held to their original plan to submit the letter which they commended and believed stated the truth of the inadequacies of the DEIR.   With just one substitute Director attempting to dismiss or weaken the letter unsuccessfully, the rest of the Board voted to submit the letter.

In the next item on their agenda, the SACOG Board agreed to look at the comments developed by Mr. Trost on the federal DOT Rule-making document presently open for public comment through the end of September.   (For information on how to send your comment to the Pipeline and Hazardous Materials Safety Administration, see Two-month comment period starts for new federal oil train rules.)

It remains to be seen how this all plays out legally, as Valero and UP are powerful players who are used to winning.

The Sacramento Air Quality Management District will shortly send their letter, another strong one, but more narrowly focused on air quality issues.  Also, watch for letters from the cities of Davis (city council on Sept. 2), Sacramento, Roseville, and Colfax.
