Flawed tests play down crude oil’s explosiveness

The current testing regime was not designed for unrefined crude and, as a result, can play down the dangers of shipping some light crude oils, according to industry and transportation experts. A United Nations panel on hazardous materials shared similar concerns last week when it announced that it would review international standards for shipping crude oil, including how crude is tested and classified, in response to a string of recent accidents in North America.

With the accuracy of the tests in question, there is suspicion that some shipments of Bakken crude may be more volatile than officials believed. It also raises the possibility that light crude oil drawn from other locations in North America is as potentially explosive as crude from the Bakken – but has not been receiving the same level of scrutiny.

The devastating fire in Lac-Mégantic, Que. last July, began when a train carrying Bakken crude jumped the tracks and exploded in the centre of the small town, killing 47 people. A Globe and Mail investigation showed that oil from the Bakken formation, which straddles North Dakota, Saskatchewan and Manitoba, is more volatile and prone to exploding than conventional forms of crude.

Crude oil with a high concentration of light ends – such as methane and propane – is “most at risk” of being mischaracterized in standard testing procedures, according to a recent report commissioned by Transport Canada. Those light ends are potentially dangerous because they can ignite and magnify the size of an explosion.

The inaccuracies underscore how little is known about the risks of shipping crude oil by rail, a practice that has increased dramatically during the past five years and now accounts for an estimated 230,000 barrels of oil a day in Canada. Oil is widely known to be flammable, but regulators did not believe until recently that it had the potential to explode and cause the kind of destruction it did in Lac-Mégantic.

Flash point and boiling point tests, which are required for crude shipments in Canada and the U.S., both have difficulty measuring samples that contain significant concentrations of light ends, according to the report to Transport Canada. Another common test, known as the Reid Vapour Pressure test, has also been criticized for use on crude oil because it can allow light ends to easily vapourize at the time samples are collected from highly volatile crude.

“When you try to apply [current tests] to samples that have light ends, they don’t work as well,” said Bob Falkiner, a director for the Canadian Crude Quality Technical Association who also works for Imperial Oil. “You get biased results reported from those test methods because of the lost light ends.”

A spokesperson for Transport Minister Lisa Raitt said the minister is aware of concerns about the crude-testing regime and Transport Canada is “looking at options” related to volatility tests. Speaking with The Globe after an event in Toronto last week, Ms. Raitt also welcomed the UN panel’s decision to study crude shipments and testing.

Producers in the Bakken are expected to stabilize crude oil before shipping it, in a process meant to remove many of the light ends from the rest of the product. Those light ends can be sold separately, but limited transportation infrastructure in the fast-growing Bakken area has led some producers to flare the products instead – which means they simply burn them on the spot. In some cases, flaring has become a “de facto stabilization process,” said Bill Lywood, founder and president of Crude Quality Inc.

However, several industry experts said there is a financial incentive for producers to leave some light ends in the crude – rather than burning them off or selling them separately – because they can increase the overall volume of the crude they are selling. At the same time, because of testing limitations, it can be difficult for producers, shippers and buyers to determine whether enough of the volatile light ends have been stripped away before crude oil is transported across the country.

In an effort to address the problem, some companies and industry experts are advocating the use of a newer vapour pressure test that uses a sealed, pressurized cylinder to prevent light ends from escaping when a sample is taken.

Refinery plans to ship 100 train cars of crude oil through Sacramento

A Bay Area refinery’s plan to run up to 100 train cars of highly flammable crude oil daily through Sacramento is prompting a late push by area leaders to protect cities on the rail line.

Sacramento officials say they only recently learned that a proposed rail terminal at the Valero company’s refinery in Benicia could dramatically increase the number of trains carrying crude oil through the region, including through populated downtowns. They say they are scrambling to fashion a joint statement to Valero officials expressing concerns.

The trains would travel on the Union Pacific line that runs through both the Roseville and downtown Sacramento railyards, as well as through downtown West Sacramento and Davis. Those are the same tracks that carry Capitol Corridor passenger trains between Sacramento and the Bay Area.

The Valero rail terminal is one of several being proposed by refineries responding to a major shift in how crude oil is transported nationally. Currently, the Benicia refinery receives most crude via pipeline and ships. But Valero and other companies are moving quickly toward more rail transport to align with the boom in hydraulic fracturing, or fracking, in inland areas like North Dakota, where much of the new oil is a lighter, more flammable type from the Bakken oil fields.

“These rail shipments are the wave of the future,” Sacramento city official Fran Halbakken said, “but there is not much information out there.”

Data compiled by the California Energy Commission shows crude oil shipments into the state via rail from other states jumped from  1 million barrels in 2012 to more than  6 million in 2013. Local fire officials, who would be the first responders in case of crashes or derailments, say they do not receive detailed information on how many of those train cars come through Sacramento.

“We’re trying to figure what is the baseline that comes through now,” said Davis city official Mike Webb. “All jurisdictions would want to know.”

Union Pacific officials say their company, one of the major rail transporters in California, shipped less than 1,000 carloads of crude oil statewide on a monthly basis last year – or 33 cars a day. A UP spokesman declined this week to say how much of that goes through Sacramento. “We are not currently breaking out how much crude we move through a specific community,” UP’s Aaron Hunt said. “We are only giving out our state number.”

BNSF, the other major rail transporter in California, also declined to discuss crude oil routing information.

Valero’s terminal project description offers a brief but clear statement on plans for major shipments through Sacramento: “(Union Pacific Railroad)-operated locomotives would haul up to 100 crude oil rail cars a day from the UPRR Roseville railyard to the refinery,” the report states.

And more rail shipments could be on their way: Phillips 66 says it intends to begin deliveries of crude by rail sometime next year to its coastal refinery in Santa Maria. Union Pacific would deliver as many as five 80-car trains a week of oil “from a variety of sources in North America.” One route could pass through Sacramento.

Officials with the state Office of Spill Prevention and Response say refineries around the state may ultimately have the capacity to process up to 143 million barrels of crude shipments via rail a year, far more than the  6 million shipped last year.

Last year, a train carrying Bakken crude oil derailed in a Quebec town, sparking a massive fire that killed 47 people and leveled the town center. Subsequent derailments in Alabama and North Dakota, though not fatal, caused fires and evacuations and showed that disaster could strike again.

While such incidents are rare, local fire officials say the pressure is on to be more prepared for that possibility.

“Any time you increase numbers, you increase the probability of problems that would come with that,” said Sacramento City Interim Fire Chief Dan Haverty.

Last week, The Sacramento Bee reported that McClellan Business Park is being used as a transfer station where oil, including Bakken crude, is being moved from rail cars to tanker trucks. Local safety officials told The Bee they knew little about the McClellan operation.

Valero and Benicia officials are expected to publish a draft environmental impact report later this month on the company’s planned rail terminal next to Interstate 680 just north of the Benicia-Martinez Bridge. Sacramento officials say they likely will issue a joint statement to Valero on what they think should be done to increase safety in “up-line” cities.

The Sacramento Area Council of Governments is planning a meeting of its 32 local cities and counties on April 22 to discuss the issue.

West Sacramento Fire Chief Rick Martinez said officials may ask that Valero be required to finance extra emergency training and safety equipment for up-line communities, and that there be tight rules on when or whether trains are allowed to sit on track sidings.

He said the emerging national discussion about rail safety may provide a platform for cities to push for other safety improvements, such as better “real-time” information on what materials are coming through town, so fire and hazardous materials crews know what they are getting into as they head to a call.

“As they look at this Bakken oil, is there a way through technology to get more information to local agencies?” Martinez said. “We are trying to take advantage of the interest to pose the questions that may guide” future regulations.

Aides to Rep. Doris Matsui, D-Sacramento, say she has begun exploring the issue as well. Matsui’s office issued a statement this week, saying “it is imperative that the rail cars are safe and that local agencies are prepared for the increased risk.” Aides said Matsui sent a letter to the Department of Homeland Security recently, “seeking additional federal funding for first-responder training, arguing that the increased risk posed by these oil cars warrants additional federal funds.”

Although the federal government regulates rail shipments, federal rules haven’t caught up to the surge in oil traffic on the nation’s rail network. That’s left local leaders and community activists in cities around the country at the forefront of pushing for changes in state and federal laws.

Last week, the city councils of Berkeley and Richmond voted to oppose crude shipments on rail lines through their cities. The resolutions call for state lawmakers and members of Congress to seek tougher regulations.

Several environmental groups filed a lawsuit last week against pipeline operator Kinder Morgan and the Bay Area Air Quality Management District. The groups said the agency quietly issued a permit to Kinder Morgan for a crude-by-rail facility in February without reviewing potential environmental and health impacts.

“We don’t accept that as a foregone conclusion,” said Diane Bailey, a senior scientist with the Natural Resources Defense Council, one of the groups in the lawsuit.

A group of community activists in Benicia and Martinez has been trying to stop Valero and another refiner, Tesoro, from expanding their crude oil deliveries by rail. And they’re pressing local, state and federal officials to push for tougher oversight of crude oil shipments by rail.

“People are afraid that anybody along the rail line could become the next (Quebec),” said Andres Soto, a community activist in Benicia.

Oil industry officials say fears of derailments and fires are overstated. The Association of American Railroads, an industry group, says 99.997 percent of hazardous materials shipped by rail reach their destination without incident.

Charles Drevna, president of the American Fuel & Petrochemical Manufacturers Association, dismissed the movement to oppose new terminals and additional rail shipments, saying “you’re always going to see the anti-fossil fuel mentality in California.” He said, given the cost savings, “the vast majority of Californians will be happy to get Bakken crude.”

SSAN MATEO (KCBS) – Last summer’s oil train accident in Quebec that killed 47 people has lawmakers and others in the Bay Area concerned that it could happen here as the volume of crude oil from fracking and other petroleum products arriving from North Dakota and Canada to local refineries surges.

On Monday’s 25th anniversary of the 1990 Exxon Valdez spill in Alaska, State Sen. Jerry Hill (D-San Mateo) said he fears the response to major oil spill will [fall] far short.

“Some of the trains that coming in—the tanker trains that crude oil will have 2.7 million gallons of oil on those trains,” he said.

In 2011, about 9,000 tank cars filled with crude oil were shipped into California by rail. In the next two years, that number is expected to jump to more than 200,000, according to the California Energy Commission.

About 10 percent of the oil will be headed to the five Bay Area refineries.

While most agree the response to water-born spills is good – the Cosco Busan tanker that struck the Bay Bridge in 2007 as an example – inland spills, however, are inherently different.

“When this oil is coming through California at the volume that it’s coming and the magnitude … we want to make sure that our citizens are adequately protected. We really don’t have the resources in place to do it,” Hill said.

Gov. Jerry Brown’s budget calls for a new 6.5 cents per barrel rapid response fee, but that’s for overland crude oil shipments only.

“Ethanol is just as toxic, hazardous chemical and there’s nothing in place to deal with that type of a spill.”

Curt Clumpner is a member of the Fairfield-based International Bird Rescue and got his experience during the 1990 Exxon Valdez spill in Alaska. He said the trains that traverse California do so alongside our rivers.

“It obviously increases the risk in terms of the environment and wildlife,” he said.

KCBS KPIX 5 and San Francisco Chronicle Insider Phil Matier said there are environmental activists who are against oil as a rule and will use such a possibility to scare people while the oil industry will likely oversimplify the issue by saying there is no need for concern.

“The truth is somewhere in between. We’ve had ethanol and we’ve had crude oil come around before but not in this volume.”

Oil is flooding into the Bay Area – in rail tank cars that amount to potential environmental disasters on wheels.

In 2011, about 9,000 tank cars filled with crude oil were shipped into California by rail. In the next two years, thanks to the oil boom in North Dakota and Canada, the number is expected to jump to more than 200,000, according to the California Energy Commission.

About 10 percent of the oil will be headed to the five Bay Area refineries, which means traveling through Contra Costa and Solano counties. The question is, are we prepared to handle the spills or fires if there is a derailment?

“No,” said state Sen. Jerry Hill, D-San Mateo, after listening to 2 1/2 hours of testimony from emergency responders the other day at a hearing in Sacramento.

In a nutshell, the state has plenty of money for responding to waterborne accidents like the Cosco Busan oil spill in the bay in 2007 – but virtually nothing for handling spills on land.

“It’s not that crude oil is any more dangerous than ethanol or other products that we currently see on the rails,” said Chief Jeff Carman of the Contra Costa County Fire Protection District. “It’s just that with the sheer volume that will be coming in, we are going to see more accidents.”

First on the scene of any accident is likely to be the local fire department – but in Contra Costa and Solano, some agencies have closed fire stations in recent years or reduced the number of personnel per shift to deal with budget cuts.

Contra Costa Fire, for example, is down to 75 on-duty firefighters a day to cover 400 square miles and 600,000 people, compared with the 90 firefighters a day just two years ago.

To give an idea of the potential scale of an accident, the amount of oil that spilled from the Cosco Busan equals about 1 1/2 tank cars of crude. A full train could carry 60 times that amount.

“There is a potential for very serious problems and very disastrous problems,” Hill said.
