Shipments of crude oil by rail are expected to increase in the Bay Area and the rest of the state in the near future. BNSF Railways is already transporting crude oil into Richmond, including the kind of oil that exploded from a derailment and killed 47 people in a Quebec town last year.

In response to concerns about the risks of crude by rail, the state’s other large rail company, Union Pacific, began to boost its rail inspection program by dispatching vehicles with lasers that can find tiny track imperfections, as the Sacramento Bee reports:

The new cars will patrol the main mountain routes into the state, Union Pacific officials said. Northern California sites will include Donner Pass, the Feather River Canyon and grades outside Dunsmuir. The state has designated all those areas high hazards for derailments.

The Bee’s Tony Bizjack spoke with Mina Kim about the program, which began last month. Bizjack explained that Union Pacific is particularly worried about California’s mountain passes because they’re considered more high-hazard areas, “often because they’re curving, they’re on slopes, and they have to deal with more extreme weather,” he said.

Bizjak rode on one of the track inspection vehicles. He said they’re equipped with ultrasound to look into the rails to find weaknesses and lasers to measure variations in rail height and alignment.

In the last five years, Union Pacific has had about 180 derailments in California, Bizjack said. “Derailments are surprisingly frequent, but generally very minor,” he said. “Most of those derailments, however, the train cars ended up standing up, not falling over.”

About half of all derailments are caused by track problems, said Bizjack. Others are caused by human and equipments errors. “So tracks are important, that’s sort of the front-line of defense — PUC and FRA think — in reducing the chance these new crude oil shipments can derail, explode.”

Union Pacific is not yet bringing volatile Bakken crude to California. But there are plans in the works for Union Pacific to bring crude oil both to and through the Bay Area, Bizjak explains. A project at the Valero refinery in Benicia would bring two 50-car trains a day through Sacramento and along the I-80 corridor. Another proposal in Santa Maria, by Phillips 66, would bring trains through Sacramento, the East Bay, San Jose and down the coast.

“If you ask anybody in the Office of Emergency Services here in California, or first responders, fire departments, there is a real level of concern about the safety with more crude oil coming in,” Bizjak said.

Faced with public concern about the risks of crude oil shipments, the Union Pacific railroad last month boosted its rail inspection program on mountain passes in California and the West, dispatching high-tech vehicles with lasers to check tracks for imperfections.

UP officials say they have leased two rail inspection vehicles, called geometry cars, doubling the number of computer-based safety cars in use on the company’s tracks. The move comes amid mounting public concern about hazardous-material shipments, including a growing quantity of highly flammable crude oil from North Dakota being shipped to West Coast refineries.

The inspection cars will supplement similar geometry cars UP owns that it uses to inspect hundreds of miles of tracks daily on the company’s main lines west of the Mississippi River. Running at regular train speeds, the inspection vehicles can detect tiny deviations and wear on rail lines that could cause a derailment if allowed to grow, UP officials said.

The new cars will patrol the main mountain routes into the state, UP officials said. Northern California sites will include Donner Pass, the Feather River Canyon and grades outside Dunsmuir. The state has designated all those areas high hazards for derailments.

In Southern California, the inspection vehicles will patrol UP’s looping line over the Tehachapi Mountains, as well as the line on the Cuesta grade in San Luis Obispo County. The trains also will check mountain rails in Washington, Oregon, Utah and Nevada.

“We’re ensuring we keep crude oil trains on the track,” said David Wickersham, UP’s chief maintenance engineer in the West. “We are going to time it so we are hitting California every three months.”

State rail safety chief Paul King of the California Public Utilities Commission applauded the move. “It’s easy to maintain a straight (flat) railroad, but it’s not as easy to maintain a curved rail like you find in the mountains,” King said.

Grady Cothen, a retired Federal Railroad Administration safety official, said the type of high-tech inspections cars UP is using have become a must for major railroad companies. With more freight moving through limited rail corridors, especially mountains, the financial and political implications of a major derailment that causes damage are huge for railroads.

For more than a century, California has relied on assurances from railroad companies that thousands of rail bridges across the state, from spindly trestles in remote canyons to iron workhorses in urban areas, are safe and well-maintained to handle heavy freight traffic.

That era of trust is over. Concerned about the growing number of trains traversing the state filled with crude oil and other hazardous materials, the California Public Utilities Commission is launching its first railroad bridge inspection program this fall. Federal officials say it will be the first state-run review of privately owned rail bridges in the country.

The goal, the PUC says, is to end what a recent report called the “dearth of information on the structural integrity of California’s railroad bridges.” Almost all train bridges in the state are owned and maintained by private railroads. Federal rules require railroads to inspect those bridges annually.

One of those private bridges, the 103-year-old I Street Bridge in downtown Sacramento, sits in the heart of a heavily populated area, straddles an important public waterway, and also carries thousands of cars daily. Another, the dramatic Clear Creek Trestle in the Feather River Canyon, carries trains through remote, rugged terrain where the risk of derailment is relatively high. Both bridges are expected to be conduits for increased hazardous material shipments.

“I don’t mean to criticize the railroads’ programs, but for the public to have the confidence that bridges are in good shape, our role is to offer oversight,” said PUC Rail Safety Deputy Director Paul King. “Given the heightened risk of one of these crude oil trains derailing and given the projections of a significant increase in tonnage across these bridges, we need to fulfill this role.”

It will be a limited program, however. The PUC, which is responsible for assuring safe rail systems in California, is hiring two bridge inspectors this fall for the massive task of verifying the integrity of an estimated 5,000 bridges statewide. Those inspectors are expected to conduct visual inspections at bridges and to audit railroad companies’ inspection and maintenance programs.

They are among seven new rail safety division inspectors being hired from funds allocated this summer by Gov. Jerry Brown’s administration and state legislators. The funding is a direct result of growing fears at the state Capitol and in cities along the rail lines about the potential for derailments and explosions as more crude oil trains begin rolling through the state. A crude oil train explosion last year in Canada killed 47 people.

The other new hires will be used to bolster existing utilities commission teams of track, equipment and train inspectors. Track and rail car inspections are one of the few regulatory functions states are allowed in dealing with railroads, working in conjunction with the Federal Railroad Administration, which maintains regulatory control over rail operations nationally.

The launch of a bridge inspection program comes amid ongoing criticism of the PUC after a catastrophic 2010 gas line explosion in San Bruno in which eight people were killed and 38 homes destroyed. Critics say the PUC wasn’t adequately overseeing Pacific Gas and Electric Co.’s pipeline maintenance and inspection efforts. The National Transportation Safety Board cited “CPUC’s failure to detect the inadequacies of PG&E’s pipeline integrity management program.”

Mindy Spatt of The Utility Reform Network, a consumer advocacy group and PUC watchdog, said she is not familiar with the rail bridge inspection program, but that the commission needs to be proactive and independent to protect the public.

“We would hope one thing the PUC has learned is its job is not to trust utility companies, but to oversee them,” Spatt said. “When the PUC doesn’t do its job, there can be really disastrous results.”

Bridge failures are rare, safety officials say, but consequences are potentially huge. The largest chemical spill in California history, in Dunsmuir in 1991, involved a train derailment on the curving Cantara Loop bridge that poisoned more than 40 miles of the Sacramento River. The bridge structure did not fail, but it has since undergone major modifications to reduce chances of another derailment.

The PUC bridge inspection program faces a notable upfront challenge. The commission does not yet have a comprehensive list of railroad bridges in the state, and may struggle to come up with one that includes detailed design specifications and load capacities on all bridges. PUC officials are negotiating with Union Pacific and BNSF railroads to gain access to their in-house bridge inventories.

To help fill out its inventory, the PUC said it may resort to Google searches, including tapping an amateur bridge fan website, www.bridgehunter.com.

The two bridge inspectors likely will work as a team. PUC officials calculate that the two of them can view two bridges a day, two days a week. The other three days will be for travel and report writing. “At a rate of 98 bridges per year, it would take approximately 50 years to complete inspections,” the PUC said in a report last month on its bridge review plans.

Those numbers are “intimidating,” but the job is not as improbable as it seems, King said. The PUC inspectors, like federal bridge inspectors, will serve largely in a safety review role, making sure the railroad companies are doing their jobs. Although they will visit bridges and look them over, they will not have the time or equipment to conduct full, detailed inspections.

“This is an oversight situation,” King said. “We are looking at the railroads’ inspection program, trying to verify it. Our inspectors’ role is to do spot checks. We may find that we need more inspectors. It is hard to tell at this point. We are plowing new ground.”

For their part, Union Pacific and BNSF, the state’s two major railroads, say they spend substantial time and money making sure bridges are in good shape. Union Pacific said it has six full-time, two-person crews supported by more than 50 bridge maintenance employees in California.

“Safety is just as important to Union Pacific as it is to anyone,” the railroad said in an email. “Our hope is that the CPUC continues to recognize and support this important element of our safe and efficient freight transportation efforts.”

BNSF officials say they inspect their 1,100 railway bridges in California two or three times a year, more than required by the Federal Railroad Administration, as well as after major events such as earthquakes and storms.

“BNSF is committed to ensuring that we operate on a safe and reliable rail network and therefore invests millions of operating and capital dollars annually into routine and major rehabilitation, repair, and upgrading of railway bridges and structures in California,” BNSF spokeswoman Lena Kent said in an email.

The PUC plans to come up with a priority list by year’s end of 30 key bridges for initial visits next year. This list will include bridges that have the highest probability of failure based on age, materials, design, traffic and other risk factors, such as proximity to an earthquake fault. The PUC will merge that list with an analysis of which bridges have the highest potential for negative outcomes if they fail. Those may include bridges used frequently by trains carrying hazardous materials, as well as bridges near schools, hospitals and population centers.

The calculation also will include bridges that cross sensitive waterways, such as the Feather, American and Sacramento rivers that carry drinking water for Northern California.

PUC officials say they hope to have inspectors looking at the first 10 to 15 bridges in the first half of 2015. The rest in the priority group would be inspected by the end of 2015.

A Federal Railroad Administration official said his agency welcomes California’s decision to inspect bridges.

“California already has the largest involvement in our safety program and we welcome the addition of more state assistance,” said spokesman Michael Booth. “It’s what we call a force multiplier.”

California officials challenge Benicia crude oil train plan

Brown administration officials say Benicia has underestimated the risk posed by oil trains planned to run through Sacramento and other parts of Northern California to the city’s Valero refinery, and is calling on the city to redo its safety analysis before allowing oil shipments to increase.

A letter sent to the city last week by the state’s Office of Spill Prevention and Response and the California Public Utilities Commission expresses concerns similar to those detailed in recent letters to Benicia from the Sacramento Area Council of Governments and the cities of Sacramento and Davis.

Sacramento regional leaders have accused Benicia of not adequately exploring the explosion and fire risks of a Valero Refining Co. plan to run two 50-car trains daily through downtown Roseville, Sacramento, West Sacramento, Davis and other cities to the Benicia refinery.

Julie Yamamoto, chief of the state spill prevention agency’s scientific branch and a member of the governor’s rail safety team, said state officials felt compelled to push for Benicia to do deeper study prior to project approval.

“We felt the risk analysis was sufficiently flawed and underestimates the risks,” Yamamoto said.

In its draft environmental impact report, issued earlier this summer, Benicia only analyzed oil spill possibilities on the rail line between Roseville and Benicia, even though the trains will travel from other states or even Canada. “That is a pretty big shortfall in not considering the rest of the track to the California border, and even beyond that,” Yamamoto said. State officials also have questions about how Benicia came up with the assertion that a derailed train might spill oil only once every 111 years, and therefore the risk was insignificant.

“The derailment rate looks to us to be low compared to national data,” Yamamoto said.

Benicia city officials declined to respond this week to the concerns raised by the state and local governments, but previously indicated that they limited their spill analysis to the Roseville-Benicia track section because they do not know yet which rail lines the Union Pacific Railroad may use east or north of Roseville to bring the oil into California.

State officials countered that there are only a handful of rail lines that could be used to bring the oil into the state, and all should be included in Benicia’s project risk analysis. The state noted that those rail lines pass through “high-hazard areas” where derailments are more common. In Northern California, those hazard sections are at Dunsmuir, the Feather River Canyon and near Colfax.

By issuing its letter, the state secures legal standing to sue Benicia if that city approves the project without redoing its risk studies. State officials this week declined to address the question of whether they would consider a lawsuit.

The letter from the state is one of hundreds Benicia officials said they received in the past few months in response to their initial environmental study. Benicia interim Community Development Director Dan Marks said the city and its consultants would review the comments and prepare responses to all of them, then bring those responses to the city Planning Commission for discussion at an as-yet undetermined date.

Under the Valero proposal, trains would carry about 1.4 million gallons of crude oil daily to the Benicia refinery from U.S. and possibly Canadian oil fields, where it would be turned into gasoline and diesel fuel. Valero officials have said they hope to win approval from the city of Benicia to build a crude oil transfer station at the refinery by early next year, allowing them to replace more costly marine oil shipments with cheaper oil.

Crude oil rail shipments have come under national scrutiny in the last year. Several spectacular explosions of crude oil trains, including one that killed 47 residents of a Canadian town last year, have prompted a push by federal officials and cities along rail lines for safety improvements.

SACOG and the cities of Sacramento and Davis have called on Benicia to require UP to give advance notice to local emergency responders, and to prohibit the railroad company from parking or storing loaded oil tank trains in urban areas. Local officials want the railroad to use train cars with electronically controlled brakes and rollover protection. Sacramento also has asked Benicia to limit Valero to shipping oil that has been stripped of highly volatile elements, including natural gas liquid.

Others in the Sacramento region, however, point out that rail safety is a federal issue, not one that cannot legally be dictated locally. In a joint letter, Stanley Cleveland and James Gallagher of the Sutter County Board of Supervisors said SACOG is overreaching, and a better approach would be to work with federal railroad regulators, as well as with Valero and UP, on safety issues.

The Union Pacific Railroad also has challenged the SACOG and Sacramento city perspectives, arguing that federal law pre-empts states and cities from imposing requirements on the railroads. “A state-by-state, or town-by-town approach in which different rules apply to the beginning, middle and end of a single rail journey, would not be effective,” UP officials said in a letter this month to SACOG.

State Sen. Ted Gaines, who represents much of Placer County and other rail areas, said the Valero project has his “full support.” Benicia’s analysis, he wrote, “affirms that this project is beneficial environmentally and economically and can be done safety given the prevention, preparedness and response measures in place by both Valero and Union Pacific Railroad.”

Among other commenters:

•  350 Sacramento, a local climate change group, warned that oil trains would cause an increase in carbon emissions and slow efforts to convert to renewable energies.

•  The Capitol Corridor passenger train authority, which would share tracks with the oil trains, voiced concern about the safety of passengers, crews and communities, saying the Benicia analysis doesn’t look at the impact crude oil trains would have on Capitol Corridor or Amtrak passenger trains.

• The Sacramento Metropolitan Air Quality Management District said Benicia could ask Valero to fund local mitigation programs to reduce polluting impacts of trains in the region.

•  UC Davis noted that the rail line passes through campus near the Mondavi Center and the UC Davis Conference Center, and called for additional training and equipment for Davis to deal with the possibility of a derailment and fire.
