Rail defect, tank car valves implicated in West Virginia oil train fire

— Outlet valves underneath four tank cars in a February oil train derailment in West Virginia were sheared off and the 50,000 gallons of crude oil they released ignited in a fire that subsequently caused several nearby rail cars to explode, according to a federal report.

The report also identified the initial cause of the Feb. 16 derailment in Mount Carbon, W.Va., as a broken rail on track owned and maintained by CSX and said more than 362,000 gallons of crude oil were released. The fires and explosions from the derailment kept 300 residents away from their homes.

The report, which appeared Thursday in the Pipeline and Hazardous Materials Safety Administration’s hazardous materials incident database, highlights another issue with the design of the tank cars used to carry crude oil and their ability to resist damage from derailments and fire exposure.

The Mount Carbon derailment was one of four oil train derailments since the beginning of the year that resulted in large fires. On March 5, an oil train operated by BNSF derailed near Galena, Ill. Two other oil trains derailed in Ontario on Canadian National, one in February and one in March.

Last week, the National Transportation Safety Board issued recommendations that tank cars used to transport flammable liquids must have thermal insulation to protect them from the kind of fire exposure that can result in explosions.

Federal regulations require tank cars to survive 100 minutes of fire exposure. However, eight tank cars failed within 90 minutes after the derailment, their contents exploding in giant fireballs, according to the NTSB.

The NTSB recommendations did not address the apparent cause of the initial fire: the failure of the bottom valves on the cars used in unloading.

A set of new regulations on tank car construction the government may release in the next few weeks include requirements to remove bottom valve handles or to protect them from opening in a derailment. But they would not require the valves’ removal altogether.

Removing the valves would mean expensive modifications at unloading facilities that have popped up across the country as a surge in energy production has moved by rail in recent years.

Members of Congress impatient with the pace at which new regulations have moved have begun introducing legislation to require more robust tank car construction. Regulators and lawmakers also are pushing for increased track inspections.

The particular type of internal defect that led to the broken rail in West Virginia, called a vertical split head, can be difficult to detect with a visual inspection, according to Sperry, a company that makes vehicles that perform ultrasonic rail inspections.

Federal law requires that railroads inspect most mainline track twice a week, with at least one calendar day between inspections. A CSX regional vice president told reporters a day after the derailment that the track in Mount Carbon had been inspected three days earlier.

Rob Doolittle, a CSX spokesman, said in an email Thursday that the company looked forward to learning more about the Federal Railroad Administration’s accident investigation.

“Safety is CSX’s highest priority and we carefully evaluate the ascribed cause of each incident to apply whatever lessons are available to make our operations safer,” he said.

Garamendi calls for greater Bakken oil-by-rail safety

Rep. John Garamendi, D-Walnut Grove, called for less volatile Bakken crude oil — which is transported across the country by rail — on Wednesday morning, using the backdrop of the Davis Amtrak station to drive his point home.

Garamendi introduced the Bakken Crude Stabilization Act on March 26 in a bid to protect what he said are 16 million Americans living and working near railroad shipment lines. If approved, the bill will require lower vapor pressure for transported Bakken crude to reduce its volatility, a practice currently required in Texas and to some degree in North Dakota.

Vapors like propane and butane add to the unstable nature of Bakken crude during train derailments.

On Wednesday, Garamendi and other government officials explained why requiring more safety for railroad tank cars is essential to communities along rail lines like Davis and Fairfield, should there be an explosion. As if on cue, freight trains carrying black tank cars rumbled by as Garamendi spoke.

“You’d wipe out downtown Davis and possibly hundreds of people,” he said, adding that stripping out volatile vapors would prevent a fireball rising what he said was a hundred feet in the air.

Solano County Supervisor Skip Thomson said there are refineries and pipelines in his county, but also populations along rail lines and an environmentally sensitive marshland.

“If we de-gas the oil, that is a huge thing for safety,” Thomson said. “We need to ask that legislation be passed. … We need to move this quickly.”

Environmental groups say Bakken crude oil is transported through Yolo and Solano counties along Union Pacific Railroad lines that run through Davis, Dixon, Fairfield and Suisun City on their way to the Valero oil refinery in Benicia. A proposal is pending before the Benicia City Council that could increase the number of rail tank cars moving through those cities, increasing shipments to about 70,000 barrels of oil a day in two, 50-car-long shipments.

So-called “up-rail” community groups are fighting the proposal, and local governments in Yolo and Solano counties are working for better safety and oversight of the Valero project, which is still in the environmental review process.

Davis Mayor Dan Wolk said local agencies’ goal in the Valero project is not to stop commerce, but to ensure that adequate safety measures are in place.

Meanwhile, at the state level, a warren of rules protecting rail commerce prohibit states and localities from enacting restrictions on rail traffic, leading to calls for the federal government to step in.

However, laws protecting railroads, some more than a century old, ensure that railroads have a strong hand in approving any new regulations that the federal Department of Transportation or the Federal Railroad Administration may impose on their industry. Most regulations are created by consensus with the railroads.

Garamendi said a legislative approach is the quickest way to get the railroads to implement safety standards.

“Every day we delay the implementation of a stronger safety standard for the transport of Bakken crude oil by rail, lives and communities are at risk,” the congressman said in a prepared statement released at the news conference.

“We need the federal government to step in and ensure that the vapor pressure of transported crude oil is lower, making it more stable and safer to transport. We also need to upgrade and ensure the maintenance of rail lines, tank cars, brake systems and our emergency response plans.”

Getting railroads to help beef up local safety planning is a big part of what state and local governments are trying to wring out of the rail industry. One key demand is to get the railroads to disclose to emergency first responders what is inside their tank cars.

In a March 3 letter to the U.S. Department of Transportation written by Garamendi and Congresswoman Doris Matsui, D- Sacramento, the pair said the need for safer train cars has long been documented and is overdue.

Asked Wednesday what the chances are of a railroad safety bill passing through a Republican-controlled Congress, Garamendi said “excellent,” evoking some chuckles from other government officials standing by.

ALBANY >> Senator Charles Schumer said Thursday there’s an urgent need for more federal railroad bridge inspectors, saying the combination of old infrastructure and oil trains is an accident waiting to happen.

Schumer said there are 3,000 rail bridges in New York, most of them privately owned, and only one federal inspector assigned to monitor them for safety purposes. The inspector is also responsible for overseeing rail bridges in 13 other states.

“New York as you know has some of the oldest and most frequently used infrastructure in the nation hands down and that is particularly true when it comes to rail,” he told reporters in a conference call. “Part of the reason is we are an older state. Another reason is New York has always been a vital geographic link between the Midwest and the East Coast.”

Schumer said that adding $1 million to the Federal Railroad Administration budget would double the number of available inspectors. He said public roadway bridges in New York must be inspected every other year, and private rail bridges must be inspected by their owners annually, subject to federal oversight.

But he said the FRA doesn’t have the resources to properly oversee the rail system.

“It’s not that expensive a price for safety,” Schumer said. “The bottom line we all know is simple: We should not be waiting for a derailment or a horrific collapse to do something to make sure our train bridges are safe, privately owned or otherwise.”

He said 2,158 of the 3,000 rail bridges are in upstate New York, including 281 in the Capital Region, 261 in Central New York and 307 in the Hudson Valley. Even in the sparsely populated northern region of the state, there are 144 privately owned rail bridges.

“For years agriculture states in the Midwest have been transporting their products on New York rail lines, but recently, of course, oil producing states like North Dakota have been shipping millions of gallons of crude oil across New York to the east Coast and Canadian refineries as extraction has surged from the Bakken formation,” Schumer said.

He said the shipments and the wear and tear on New York rail infrastructure “should caution us to make rail infrastructure safety a priority. Especially our rail bridges which are the most vulnerable to deterioration and present the greatest risk.”

“So far we’ve been lucky … [but] it’s very likely many of the bridges are deteriorating and some of them may be deteriorating fast.”

He said bridge failures and derailments could occur, and cited the accidents in Lac-Mégantic, Quebec, in July 2013 that killed 47 people and a more recent explosive oil train disaster in Lynchburg, VA.

Schumer also released a letter Thursday to the FRA pledging support for increasing funding for rail safety. The letter said there are an estimated 70,000-100,000 privately owned rail bridges in the U.S.

Oil train traffic has increased annually in New York each year as production in the western U.S. and Canada has boomed. Experts say the U.S. in on track to replace Saudia Arabia and Russia as the world’s biggest oil producer by 2017.

Besides oil, other dangerous substances are shipped by rail, including liquefied natural gas and ethanol. A 2009 derailment of 13 ethanol cars in Illinois killed one person and caused 600 homes to be evacuated and $8 million in damage.

BISMARCK — Democrats slammed House Republican budget writers Wednesday for stripping a proposed state-run rail safety program from the Public Service Commission budget, calling it a broken promise that leaves residents at risk of more accidents like the fiery oil train derailment near Casselton in 2013.

The House Appropriations Committee voted 16-5 late Tuesday to approve a PSC budget that cuts about $970,000 for two rail safety inspectors and a rail safety manager to complement efforts by the Federal Railroad Administration in the next biennium.

The Senate approved the funding when it passed Senate Bill 2008 by a 46-0 vote in February.

Rep. Ron Guggisberg, D-Fargo, stressed the importance of the positions given the skyrocketing increase in crude-by-rail traffic in North Dakota and across the country.

Nationwide, crude-by-rail shipments increased from an average of 55,000 barrels per day in 2010 to more than 1 million barrels per day in 2014, with Bakken crude making up 70 percent of last year’s volume, according to the U.S. Energy Information Administration.

“This is where it’s coming from, so we need to set an example and make sure it’s safe,” Guggisberg said.

Rep. Roscoe Streyle, R-Minot, said a state rail safety program is unnecessary. He said the FRA has increased its presence in North Dakota in recent years, and BNSF Railway announced additional safety measures on March 27, including increased track inspections, better electronic monitoring of railcars and reduced speeds and other new operating procedures for trains carrying crude oil.

“I just don’t think having a couple of state inspectors running around out there is going to make a hill-of-beans difference,” he said.

The committee’s chairman, Rep. Jeff Delzer, R-Underwood, indicated he feels a state program would be duplicative.

“The feds are already doing it. We’re just expanding government,” he said.

Public Service Commissioner Julie Fedorchak, a Republican who touted the proposal during her successful election campaign last summer against Democratic state Sen. Tyler Axness of Fargo after he had advocated for a state-run inspection program, said she was disappointed the funding was stripped from Senate Bill 2008 but is hopeful it’ll be restored.

“I will continue to push for this,” she said.

Fedorchak said that while the FRA has 10 staffers in North Dakota, only two are rail inspectors, and they cover parts of South Dakota and Montana in addition to all of North Dakota — about 5,000 miles of track in total. A mechanical inspector also covers parts of Montana and Wyoming.

“The federal inspection program is spread too thin,” she said, adding the volume of hazardous materials moving on North Dakota rail lines demands the state step in and help the feds “on behalf of the citizens living next to this infrastructure.”

Streyle said some committee members also worried about a state-run program making the state liable in rail accidents, a concern Fedorchak said is unfounded and hasn’t been a problem in the 30 states that have their own rail inspection programs.

The committee rejected Guggisberg’s amendment to restore the rail safety positions. He said he now plans to bring a minority report when the bill reaches the full House, which if approved would fund the rail safety positions and three hazardous liquid inspector positions cut by the Senate. Those inspectors would oversee intrastate oil pipelines.

House Majority Leader Al Carlson, R-Fargo, said the issue will be sorted out in a House-Senate conference committee.

“That’s just a long way from over,” he said.
