U.S. railroads may not be obligated under federal law to carry freight including crude oil and hazardous materials from Jan. 1 if they fail to meet a year-end deadline for implementing new train safety technology, according to a top federal regulator.

In a Sept. 3 letter to the Senate Commerce Committee, U.S. Surface Transportation Board Chairman Daniel Elliott says the common carrier obligation requiring freight railroads to honor reasonable requests for service from shippers “is not absolute, and railroads can suspend service for various reasons, including safety.”

The letter, reviewed by Reuters, presents the most tangible sign yet of what could lie ahead for rail carriers and their customers, if Congress fails to extend its Dec. 31 deadline for railroads to implement positive train control, or PTC.

The National Transportation Safety Board, which has been calling on railroads to adopt PTC since the late 1960s, says the technology would prevent major rail accidents such as the May 12 Amtrak derailment that killed eight people and injured more than 200 others.

The approaching deadline has prompted at least one major railroad company to look seriously at suspending service: billionaire investor Warren Buffett’s BNSF Railway Co (BRKa.N), the No. 2 freight railroad operator and the leading carrier in the $2.8 billion U.S. crude-by-rail market.

“BNSF confirmed that it will not meet the deadline and offered the possibility that neither passenger nor freight traffic would operate on BNSF lines,” Elliott said in the letter, which was addressed to the committee’s Republican chairman, Senator John Thune of South Dakota.

In a July 24 letter provided to Reuters by BNSF, railroad president and chief executive Carl Ice informed Elliott that BNSF is analyzing the possibility of a service shutdown and actively consulting with customers.

CSX Corp (CSX.N), the No. 3 U.S. freight handler, also told the board that it would not meet the PTC deadline but did not discuss possible decisions on whether to continue service, Elliott said.

A CSX spokeswoman said the company was working diligently to implement PTC but that a “seamless, safe operation is imperative to maintain the fluidity of the national rail network.”

Railroad officials in June raised the possibility of shutting down service as a way to avoid potential legal liabilities and fines for operating outside the law.

Elliott told Thune it was unclear whether railroads would be exempt from their obligation to provide freight service for cargo, including hazardous materials, under federal rules that say service cannot be denied simply because it is inconvenient or unprofitable for the carrier.

The Surface Transportation Board, a regulatory agency charged by Congress with resolving rail disputes over rates and service, had no immediate comment, nor did the Federal Railroad Administration, the main U.S. railroad regulator.

Up to now, the board has mainly handled common carrier obligation cases involving services that have complied with federal safety rules. “A carrier-initiated curtailment of service due to a failure to comply … would present a case of first impression,” Elliott wrote. “I cannot predict the outcome of such a case.”

PTC can avoid accidents by using a complex network of sensors and automated controls to slow or stop a train under dangerous conditions.

In 2008, Congress mandated that railroads implement the technology by the end of 2015. But only a small number of U.S. passenger, commuter and freight railroads will meet the deadline, according to an Obama administration report released last month. [ID: L1N11A275]. The report named BNSF as one of only three railroads that have provided regulators with a PTC implementation plan.

Railroad officials have complained about the cost and complexity of adopting PTC and have produced freight and commuter rail estimates showing full implementation could cost the industry nearly $13 billion.

A six-year transportation bill approved by the Senate last month would allow the Obama administration to extend the deadline for up to three years.

“The administration requested authority to extend the deadline for positive train control and the Senate subsequently advanced a bipartisan proposal to create accountability and set realistic deadlines,” said Frederick Hill, Republican spokesman for the Senate Commerce Committee.

“This provision in the surface transportation bill will address the concerns summarized in Chairman Elliott’s correspondence,” he added.

But the Senate measure is not expected to be taken up by the House of Representatives when lawmakers return from their summer break this week. Republican staff with the House Transportation Committee were not available for comment.

The Federal Railroad Administration plans to impose big penalties on railroads that fail to meet a year-end deadline to install a new collision avoidance system, including more than 70 percent of the nation’s commuter railroads.

Congress mandated Positive Train Control in 2008, but most of the nation’s commuter and freight railroads won’t have the system ready by Dec. 31. The technology is required for about 60,000 miles of track, including those that carry passengers or chemicals that are poisonous or toxic by inhalation.

A push in Congress to extend the deadline by three to five years has stalled, and lawmakers aren’t scheduled to return to the Capitol until next month.

In a Friday report to lawmakers, the FRA said it planned to enforce the mandate they set in 2008. As of Jan. 1, 2016, railroads that have failed to install Positive Train Control on the required track segments face fines up to $25,000 a day for each violation.

“The potential civil penalties that FRA could assess are substantial,” the agency wrote.

Only 29 percent of the nation’s commuter railroads will meet the Dec. 31 deadline, according to the American Public Transportation Association, and the rest may need one to five more years.

“Despite the commuter rail industry’s best efforts,” said Michael Melaniphy, the association’s president and CEO, “implementing PTC nationwide by the end of this year is not possible.”

FRA has requested funding from Congress every year since 2011 to help commuter railroads install Positive Train Control, including $825 million in President Barack Obama’s fiscal year 2016 budget. Lawmakers have only provided $42 million to date.

“Congress has not provided a guaranteed, reliable revenue stream for implementation on commuter railroads,” the agency wrote.

The agency has used other tools to help commuter railroads, including $650 million in grant funds, $400 million of which came from the 2009 economic stimulus.

In May, FRA issued a $967 million loan to the New York Metropolitan Transportation Authority, the nation’s largest commuter rail agency, to install Positive Train Control on the Metro-North and Long Island Rail Road.

Melaniphy said that commuter railroads have spent $950 million to date on the system, but need nearly $3.5 billion to get the job done.

The National Transportation Safety Board has recommended the system since 1969, but Congress didn’t require it until the Rail Safety Improvement Act of 2008.

Twenty-five people were killed in August of that year when a Metrolink commuter train smashed head-on into a freight train near Chatsworth, Calif.

Positive Train Control could have automatically stopped the train before it ran past a red signal. Metrolink is one of the few commuter railroads that will meet the Dec. 31 deadline.

In other more recent fatal crashes, trains approached curves at two or three times the appropriate speed, and the system could automatically have slowed them down.

Four people died in December 2013 when a Metro-North commuter train jumped the tracks north of New York City. The train was traveling 82 mph at a curve restricted to 30 mph.

In May, an Amtrak Northeast Corridor train barreled into a 50 mph curve north of Philadelphia at 106 mph and derailed. Eight people were killed.

Amtrak will meet the Dec. 31 deadline for installing Positive Train Control along the Northeast Corridor, which it owns. On other routes, it will depend on freight railroads, some of which will be ready, while some won’t.

According to FRA, only freight hauler BNSF and two commuter railroads, Metrolink and the Southeastern Pennsylvania Transportation Authority, have submitted safety plans required under the 2008 federal law.

Metro-North slammed by Blumenthal for sitting on $1 billion

NEW HAVEN – Sen. Richard Blumenthal (D-Connecticut) is steaming because Metro-North Railroad, loaned nearly $1 billion dollars of federal money to implement a train safety technology, is sitting on that money and will miss the Federal Railroad Administration’s year-end deadline to put it in place.

With 145 train accidents resulting in 300 deaths in recent decades, Blumenthal said Wednesday he doesn’t understand why Positive Train Control technology wasn’t in place long ago.

“We’ve known about this technology and there’s been calls to implement it since 1969, when a crash in Darien took four lives,” said Blumenthal, a member of the Senate Committee on Commerce, Science, and Transportation.

In a recent report, the FRA stated nearly all of the nation’s railroads will fail to meet the December 31 deadline.

“Tragically, our own Metro-North is failing to set a definite deadline for adopting it, which is unacceptable,” said Blumenthal.

Metro-North says the safety technology will be fully operational in 2018. All railroads not in compliance by the end of this year could be fined tens of thousands of dollars per day, until they adhere to the mandates.

A Metro-North spokesperson says “forcing fines on the MTA and other railroads, that have worked closely with the FRA to establish safe implementation timelines, distracts from our joint goal of installing PTC expeditiously.”

But, $1 billion dollars of federal money should get the wheels rolling much faster, according to passengers.

“What are they doing with the money?” asked Donielle Camerato of Branford. “Why are they waiting so long? There’s an awful lot of train accidents.”

In West Haven, in the spring of 2013, Robert Luden, of East Haven, who was a rail worker, was killed while working on the tracks.

“He would be alive today if this system had been in place because that train would’ve been stopped before it hit him,” said Blumenthal.

Shoreline East, Connecticut’s other commuter railroad, has an earlier version of Positive Train Control already in place on its tracks, which are operated by Amtrak.

Senate to Debate 3-Year Delay for Rail Safety System

WASHINGTON — Two months after the high-speed derailment of an Amtrak train killed eight people and injured hundreds more in Philadelphia, a Senate transportation bill headed for debate this week calls for a three-year delay of the deadline for installing a rail safety system that experts say would have almost certainly prevented the Pennsylvania accident.

Lawmakers from the Northeast and train safety experts expressed outrage over the provision, which is included in the 1,000-page legislation to finance highway and transit projects for the next three years. Several lawmakers vowed to fight the extension of the deadline to install the safety system, called positive train control, beyond December 2015.

“It should be done immediately. There shouldn’t be an extension,” said Senator Chuck Schumer, Democrat of New York. “Given the high number of accidents, and given the fact that P.T.C. is really effective, they should stick with 2015.”

Senator Richard Blumenthal, Democrat of Connecticut, said he was “deeply disturbed about yet another delay in a potential safety measure” until December 2018 and said the provision in the transportation bill “essentially makes the deadline a mirage.”

In 2008, after decades of delay, lawmakers gave railroad companies, including Amtrak, seven years to complete installation of the safety system, which monitors the speed of trains and automatically slows them down if they approach curves at dangerously high speeds.

The Amtrak train that derailed in Pennsylvania was going 106 miles an hour, more than twice the speed limit, when it careened off the tracks.

Since the accident, Amtrak has said it will meet the existing deadline for installing and activating the safety systems in the busy Northeast Corridor. Craig S. Schulz, a spokesman for the railroad, said Thursday that Amtrak “remains committed” to making good on that promise.

But many railroads across the country still have not installed and activated the necessary equipment and would face federal fines and other mandates if they continued operating past Dec. 31 without it.

The transportation spending measure in the Senate would require railroads to submit plans to the secretary of transportation that include installation of positive train control by the end of 2018.

The willingness to give railroads more time is especially galling to lawmakers from the Northeast, where the Pennsylvania accident highlighted the dangers to millions of riders in the most heavily traveled train corridor in the nation.

Mark V. Rosenker, a former chairman of the National Transportation Safety Board, which investigates train accidents, said he was outraged by the provision and blamed railroads’ lobbyists for pressuring lawmakers to include it.

“Obviously, the railroad lobbyists have gotten to Congress,” Mr. Rosenker said. “We just had a horrible accident. People died and people ended up becoming paralyzed when that technology was available to the railroad. I am very disappointed.”

Senator Bob Casey, Democrat of Pennsylvania, also commented on the timing of the proposal. “The idea that a provision to delay positive train control was slipped into this bill just a short time after the Amtrak 188 derailment is shocking and wrong,” he said. “Delaying P.T.C. is a bad idea, and this provision should be stripped out immediately.”

Officials at the Transportation Department are continuing to insist that railroads meet the current end-of-the-year deadline. And at the White House, the press secretary, Josh Earnest, spoke of concerns “about some of the safety provisions that are included in the bill” and said the administration would take a close look at those provisions.

But pressure is mounting in both parties to pass the transportation bill before the Highway Trust Fund runs out of money for road projects across the country. That could happen this summer if Congress does not approve a new long-term authorization for transportation spending. If the Senate passes its measure, it still must win passage in the House as well.

Several senators said concern about the rail safety provision could become a central part of the debate over the bill in the days ahead. Mr. Blumenthal said he disliked the language extending the deadline for railroads to install positive train control.

But in an interview, he said he might be able to accept a new deadline if Congress agreed to dedicate money from the Highway Trust Fund specifically for installation of the rail safety systems, especially for commuter train systems that are struggling to afford the equipment.

Mr. Blumenthal said he intended to propose amendments that would dedicate $570 million a year for three years to commuter-rail safety improvements. He said it was unclear whether Republicans, who control the Senate, would allow the amendments to be offered. And he said it was not certain how hard the Obama administration was willing to fight for them.

“I’m hoping they will lend the full weight of their authority,” he said. “It would make a difference.”

Backers of the deadline extension say they need it because the equipment is costly and time-consuming to install across thousands of miles of track.

They also say the provision gives the transportation secretary authority to reject railroad improvement plans on a case-by-case basis, which they said could leave some railroads subject to the current 2015 deadline. And they said the bill authorized the Transportation Department to prioritize money for rail safety even though it does not guarantee a specific amount of money to be spent from the trust fund.

Ed Greenberg, a spokesman for the Association of American Railroads, which represents freight and commuter systems, praised the provision, saying in a statement that it “sets a rigorous case-by-case framework with enforceable milestones that guarantees sustained and substantial progress, complete transparency and accountability, and a hard end date for full installation by 2018.”

But advocates of greater safety measures for trains said the railroads had been under orders to upgrade their safety systems for years and should have been able to meet the 2015 deadline, which was set by Congress after a California derailment in 2008 that killed 25 people.

Mr. Rosenker, who was acting chairman of the transportation safety board when the crash happened, said the seven-year deadline set by Congress after that crash should not be extended.

“Seven years, in my judgment, is a long time and an adequate time to do it,” he said. “The technology is out there. Let’s put it in.”
