PORTLAND, Ore. (AP) — Federal investigators are blaming a fiery oil train derailment along the Oregon-Washington border on Union Pacific Railroad, saying the company failed to properly maintain its track.

The Associated Press obtained preliminary findings on the June 3 derailment in the Columbia River Gorge in advance of their Thursday release.

The wreck spilled 42,000 gallons of crude oil and sparked a massive fire that burned for 14 hours.

The government’s findings raise questions about why Union Pacific didn’t detect the broken bolts that triggered the accident when they inspected the tracks just before the derailment.

Federal Railroad Administrator Sarah Feinberg says more advanced brakes could have reduced the number of tank cars that derailed, preventing the one that first burst into flames from being punctured.

Mosier Mayor Arlene Burns says the report on the June 3 wreck in Mosier raises questions about why Union Pacific didn’t find the problem when it inspected the tracks three days before the derailment.

Officials say Union Pacific faces potential penalties for safety violations.

A spokesman for Union Pacific Railroad says the company’s rail fastening system has an outstanding safety history.

Spokesman Justin Jacobs’ responded to the Federal Railroad Administration’s preliminary report thatt blamed Union Pacific for not properly maintaining its tracks and missing problems with bolts that fasten the rail ties to the rails.

Jacobs says the company will replace all the lag bolts with rail spikes, which will make problems easier to detect on inspections.

He also says an upgraded braking system called for by the Federal Railroad Administration wouldn’t have made a difference in the severity of the derailment.

Sens. Ron Wyden and Jeff Merkley, D-Ore., issued the following joint statement after the Federal Railroad Administration released its preliminary report on the June 3 oil train derailment near Mosier:

“The preliminary findings released today by the Federal Railroad Administration confirm the deep concerns we have regarding track safety in the Columbia River Gorge. Union Pacific has not done enough to regain the confidence of Oregonians shaken by the Mosier derailment to restart oil shipments through this area,” the senators said in a joint statement.

“We reiterate our call for federal rail regulators to put in place an emergency order, and to continue examining issues related to lag bolts and track fastening systems that appear to have caused this accident.”

In a letter sent Wednesday, the senators asked the FRA to halt crude oil traffic on this rail segment until the causes of the accident have been fully analyzed and necessary steps to prevent a similar derailment have been taken.

Governor Kate Brown released the following statement regarding the Federal Railroad Administration’s Preliminary Factual Findings Report on the derailment of Union Pacific’s unit crude oil train:

“The Federal Railroad Administration’s preliminary Mosier derailment report calls attention to serious safety concerns and the need for improved track inspections. I expect the final investigation report to be completed quickly and again call on rail operators to halt oil trains in Oregon until the strongest safety measures are put in place by federal authorities to protect Oregonians.”

PORTLAND, Ore. — The Federal Railroad Administration released its preliminary factual findings report on the June 3 derailment of a Union Pacific unit oil train at Mosier, OR. The FRA’s investigation determined the derailment was caused by broken lag bolts leading to wide track gauge.

According to FRA’s findings, “multiple lag bolts in this section of Union Pacific track were broken and sheared, leading to tie plates loosening from ties. The loosened tie plates allowed for the rails to be pushed outwards as trains moved across them, eventually resulting in an area of wide gauge, leading to the derailment.”

Further, FRA’s preliminary determination is that Union Pacific’s “failure to maintain its track and track equipment resulted in the derailment.”

This report comes on the heels of yesterday’s announcement by Union Pacific that it would resume transporting volatile Bakken crude oil through the Columbia River Gorge this week, contrary to requests for a moratorium on oil trains by members of the Oregon congressional delegation, Governor Kate Brown of Oregon, and the Columbia River Gorge Commission. Elected officials have called on FRA to halt the transport of oil by rail through the Columbia River Gorge National Scenic Area until safety issues are properly identified and addressed.

“This is a stinging indictment from a government agency that doesn’t typically call out the railroad companies. Union Pacific’s assurances of safety have just been derailed,” said Kevin Gorman, Executive Director of Friends of the Columbia Gorge. “We knew that Bakken oil is unsafe at any speed and now we discover the tracks are, too. We need to end the shipment of Bakken oil through the Columbia River Gorge National Scenic Area.”

Union Pacific also announced yesterday that it is postponing a public hearing on its proposed rail expansion around the town of Mosier from July 5 to Sept. 6. The proposed four miles of new double track would allow more oil trains to move at higher speeds through the Columbia River Gorge and the town of Mosier. The National Scenic Area permit application is under review by Wasco County. Friends provided detailed comments on the application, cited numerous violations of the National Scenic Area Act, and called for the project to be denied.

And to round out a trying week for Union Pacific, on Tuesday night the railroad spilled up to 1,500 gallons of diesel fuel near Bridal Veil in the Columbia River Gorge National Scenic Area. According to Union Pacific, the spill was caused by a faulty fuel filter ring

Stop Dangerous Oil Trains Today!

Leadership requires action. Now is the time to stand up for the health and safety of our people. The June 3, 2016 train derailment in Mosier, Oregon, highlights the risks we all face every time an oil train travels through our communities and along our waterways. We applaud leaders for their calls to stop oil train traffic pending the completion of a full investigation, but even more can and should be done.

We are on the front line. It is our children who are in schools next to the train tracks. Our homes are at risk. Our livelihoods, health, and drinking water are on the line when a spill happens.

The oil industry has shown that it is not able to transport their product safely by rail. New proposals would increase the number of trains. It is unacceptable to allow oil train traffic to continue.

We call on Governors Kate Brown and Jay Inslee to use the full power of the state to reject any permit or lease for state land or water that would allow more oil to come through our region.

CSX train derails in Northeast Washington DC, leaking three different hazardous chemicals and disrupting travel

A CSX freight train derailed in Northeast Washington early Sunday, spilling hazardous chemicals along a busy rail corridor. The wreck stranded some residents away from their homes, forced the closure of a Metro station and snarled traffic as emergency personnel sought to contain the leaks and clear the wreckage.

Officials said 14 rail cars of the 175-car train left the tracks. A rail engineer and a conductor had been aboard the train but were accounted for, authorities said. No evacuations were ordered, and no one was injured.

The cause of the wreck is under investigation, and the Federal Railroad Administration was at the scene Sunday.

Red Line service was suspended between Metro’s NoMa-Gallaudet and Brookland stations, and the Rhode Island Avenue station was closed. At least six blocks of Rhode Island Avenue NE were closed for much of the day.

The derailment occurred about 6:40 a.m. as the train was passing through Washington from Cumberland, Md., en route to Hamlet, N.C., CSX said. The crash site was near Ninth Street NE and Rhode Island Avenue NE. CSX said 94 cars were carrying mixed freight and 81 were empty.

The derailment, about 70 cars into the train, spilled half the liquid contents of a 15,500- gallon tanker containing sodium hydroxide, D.C. Fire and EMS Deputy Chief John Donnelly said. The liquid spilled onto the tracks and seeped into the ground below it.

Officials said there were no air- or water-quality issues at the scene.

CSX spokeswoman Melanie Cost said the company did not have a timeline on the cleanup or restoration of the tracks.

“First let me apologize to the community for the inconvenience and the alarm that the derailment caused this morning,” she said. “Every decision that we’re making is focused on the safety of the responders and the community.”

CSX described sodium hydroxide as a chemical “used to produce various household products, including paper, soap and detergents.” It is a chemical component similar to bleach or Drano, officials said. Two other rail cars were leaking chemicals that officials described as less hazardous.

By mid-morning, D.C. Mayor Muriel E. Bowser (D) said the chemical leak was contained. But more detailed inspections revealed further leaks, according to CSX. In addition to the tank car leaking sodium hydroxide, another tank car was found to be leaking calcium chloride, described as “non-hazardous,” while a third was leaking ethanol “slowly from the base of a valve,” CSX spokeswoman Kristin Seay said.

The wreckage was visible from high-rise apartments near the crash site: A zigzag pattern of mangled tankers and overturned freight cars sat beside the tracks below the Rhode Island Avenue Metro station. A set of wheels, still intact but missing its freight car, sat upright beside the track bed.

Weekdays, the affected tracks are shared by Amtrak, MARC and CSX trains. The tracks also run parallel to the Metropolitan Branch Trail, popular with cyclists and runners. On Sunday, the trail was closed near the site of the derailment, and officials said it would remain closed indefinitely.

Metro spokesman Dan Stessel said barring any unforeseen circumstances, Red Line service would be restored Sunday night.

Stessel said CSX was working to upright a rail car that was leaking ethanol. When the leak is mitigated, he said, the Metro tracks would be turned back over to the agency, which would run test trains and probably restore service soon thereafter.

If for any reason CSX is not able to turn over the scene, Stessel said, “that could affect service into the morning.”

MARC announced major service disruptions for its Brunswick Line on Monday because of the derailment. Its trains will run as far south as Silver Spring, where Metro will accept passengers at no charge to continue their commutes into the District. In addition, the Amtrak line from Washington to Chicago will not run Monday, but the Northeast Corridor lines will run as normal, officials said.

According to the Centers for Disease Control and Prevention, the effects of exposure to sodium hydroxide can include irritated eyes, burning skin, loss of hair and swelling of the lungs. The odorless solid is white or colorless and is usually in flakes, beads or a granular form. Sodium hydroxide is especially dangerous when mixed with water, because the toxin when wet creates heat that can ignite flammable products. It was raining heavily Sunday morning near the crash site.

Donnelly said the amount that leaked did not put District residents at risk.

“The fumes should not cause you any problems, and you should not be able to smell them anywhere else,” he said.

In recent years, Washington residents and elected officials have voiced concerns about rail safety and the risk of having freight trains pass through residential neighborhoods and the seat of the federal government.

Residents of Navy Yard, a formerly industrial neighborhood that is now densely populated, fought a CSX plan to reconstruct the 110-year-old Virginia Avenue Tunnel in Southeast, a key piece of the region’s rail infrastructure that is just a mile away from the U.S. Capitol. CSX is now in the midst of the $170 million project, which includes twin tunnels built to allow for double-stacked trains.

One of the most hotly debated projects in recent years, the tunnel project revived concerns about the safety and security of the city’s railways, prompting the D.C. Council two years ago to allocate funding to conduct a comprehensive rail study that would provide an assessment of all rail service: passenger, commuter and freight.

Some residents say they fear they are at a greater risk of train derailments and that once the tunnel project is completed, CSX will increase the transportation of crude oil and other hazardous materials through the area.

CSX says it rarely transports crude oil through the District and does not carry hazardous substances such as compressed flammable gases and toxic and radioactive materials through the city.

In 2009, rainwater leaking into the Virginia Avenue Tunnel from the Southeast Freeway and Virginia Avenue weakened the earthen floor. A split rail caused the derailment of two locomotives and 13 loaded gondola cars transporting scrap metal. And in the spring of 2014, a CSX freight train derailed in downtown Lynchburg, Va., sending rail cars and burning crude spilling into the James River.

Monte Edwards, a trustee with the Committee of 100 on the Federal City, which serves as a watchdog on transportation and urban planning issues, said Sunday’s spill raised renewed concerns about the viability of shared freight and passenger tracks in the District.

Speaking for himself, he said the spill showed CSX’s disregard for rail safety and inspections in the District.

“This was a hydroxide that they spilled this time. Those are nasty things coming through,” he said, reflecting on what could have happened had the chemical spilled just a short distance south, near the Capitol.

“A spill like that [one] that just occurred here in Northeast, [if] that would occur near a grate or an entrance to a Metro station, it would flood the Metro station,” he said.

The spill underscores the need for the District to devise a comprehensive rail plan, similar to state plans required under the 2008 Passenger Rail Investment and Improvement Act, he said. The District Department of Transportation says it expects a rail plan to be completed as early as this summer.

“We would know what’s coming through,” Edwards said. “We would have inspectors. We would have rail safety officers.”

“We have said all along that derailments are very real and these trains are carrying hazardous materials,” said Maureen Cohen Harrington, a Navy Yard resident and member of DCSafeRails, the organization fighting against CSX transporting hazardous materials through the neighborhood. “And what happened today demonstrated that, and we are well aware that this could have been far worse.”

BOMB TRAINS – THE SCARIEST THREAT YOU DIDN’T KNOW ABOUT

They’re explosive. Pervasive. And their movements are cloaked in secrecy. Their nickname? Bomb trains. And they roll through the heart of Chicago.

They could not look more ominous. The long coal-black tubes announce themselves by their distinctive shape and color, their markings too small to read from the street. The 30,000-gallon tank cars roll, sometimes 100 at a time, in trains of up to one mile in length. Their cargo? Crude oil—as much as three million gallons per train. Nearly all of it is light sweet Bakken crude, a type that is particularly explosive. In whole, these trains constitute likely the biggest, heaviest, and longest combustibles to ever traverse America, and they do so routinely. More pass through Chicago than any other big metro area. Their blast potential has earned them a terrifying nickname: bomb trains.

Stand long enough at 18th and Wentworth, on the traffic bridge that separates the newer sections of Chinatown from the largely residential South Loop, and you will spot the tank cars wending their way across neighborhoods on the Near South and West Sides, past playgrounds, schoolyards, and row after row of houses. An estimated 40 of these trains cut through the metro area weekly. There’s no public information on exact routes or timetables; revealing their paths, the logic goes, might aid potential saboteurs, a real risk in an age of terrorism.

Until recently, crude on the rails was relatively rare. But since 2008, when Bakken oil began rolling out of newly active fields in the United States—North Dakota is the biggest producer—and toward Eastern refineries, the number of oil tank car shipments has grown 50-fold. That’s pushed the number of accidents up, too. According to U.S. government data, from 1975 to 2012, an average of 25 crude oil spills from tank cars occurred on the rails each year. In 2014, that number rose to 141. Most incidents are minor, such as small leaks. But in cases of a major derailment, the result can be catastrophic, even fatal (see “Terrifying Incidents,” below).

Chicago found that in the last three years there were 17 derailments of crude oil trains in North America significant enough to generate news coverage. In eight of them, the tank cars blew, sending fireballs hundreds of feet into the air, filling the sky with black mushroom clouds. In the most severe cases, the flames produced are so hot that firefighters almost inevitably choose to let them burn out, which can take days, rather than extinguish them. (The Wall Street Journal calculated that a single tank car of sweet crude carries the energy equivalent of two million sticks of dynamite.) Even when there are no explosions, the spills can wreak havoc on the environment: five of the 17 accidents resulted in the pollution of major waterways, affecting thousands of people across the continent.

Chicago is particularly vulnerable. As the Western Hemisphere’s busiest freight hub, the city has become a center for crude oil traffic, too. High volumes, combined with a densely populated urban setting, have watchdogs such as the Natural Resources Defense Council alarmed. Henry Henderson, the NRDC’s Midwest program director, sums up the threat this way: “Trains with highly explosive materials are traveling through the city on aging tracks in cars that are easily punctured, which can result in devastating explosions.”

Many of these trains cut through what were once industrial rail yards in the city and suburbs. Over the last 35 years, however, much of that property has turned into residential and commercial clusters. “You should assume that if you live in the Chicago area, near a railroad track, that there are trains carrying Bakken crude oil,” says Jim Healy, a member of the DuPage County Board.

Though Chicago has so far been spared a crude oil train crash, the potential of one presents a horrifying picture. One particular nightmare is emblazoned in the minds of first responders, and regulators. On July 6, 2013, a runaway crude oil train, which had been left unattended, sped through the center of the small Quebec town of Lac-Mégantic. Sixty-three cars derailed. Forty-seven people were killed, some literally incinerated while they drank at a bar.

Emergency responders in the Chicago area say they are confident any derailment here could be managed before it reached neighborhood-destroying levels. “Crude is not the threat that everyone says it is,” says Gene Ryan, chief of planning for Cook County’s Department of Homeland Security and Emergency Management. Ryan and a group of first responders looked closely at 29 major accidents across North America and found that “even though the crude is full of all kinds of volatile materials, the cars did not completely blow apart and hit homes,” he says.

But in a city as dense as Chicago, it takes only one freak incident to have a titanic effect on the urban landscape. Just last year, on March 5, on a stretch of track near Galena, Illinois, 21 BNSF Railway train cars carrying 630,000 gallons of Bakken crude derailed and tumbled down an embankment. Five of them burned for three days. At the time, James Joseph, director of the Illinois Emergency Management Agency, told the Chicago Tribune: “We’re fortunate this occurred where it did, in a remote area, and there were no homes around it.”

Experts believe the train was likely headed for Chicago, 160 miles to the east.


Historically, oil in America moved from south (think Texas and Louisiana) to north mostly through pipelines, the safest conduits for it. When newly deployed technologies such as horizontal drilling and hydraulic fracturing—or fracking—opened access to sources of oil in North Dakota and elsewhere in the West, few pipelines were in place to move the crude to the refineries back east that could handle it. (A proposed pipeline for Bakken crude running from Stanley, North Dakota, to Patoka, Illinois, has faced political and jurisdictional challenges.) With limited alternatives, oil producers and refiners turned to railroads. In 2014, trains carried 11 percent of the nation’s crude oil.

ChiMag_ImpactZoneSo what paths do these tank cars take? The exact routes are state secrets. But assuming 40 trains, carrying three million gallons of crude oil each, pass through the Chicago area weekly, that means more than 17 million gallons roll through the city daily. It’s an inexact count, and the NRDC has continued to push to get accurate information. “A lot of people don’t know their residences are adjacent to hazardous cargo,” says Henderson. “The issue should be subject to public discussion, but the public has been cut off from it.”

Using freight maps and firsthand reporting, the West Coast environmental advocacy group Stand has assembled a national map of the most common crude oil train routes and created an interactive website that allows users to determine how far any U.S. location is from these routes. For example, according to the site, half of Chicago’s Bridgeport neighborhood, home to 32,000 people and U.S. Cellular Field, falls squarely within a half-mile “evacuation zone,” established by the U.S. Department of Transportation for areas vulnerable to crude oil train explosions. Stretch that to the one-mile “impact zone” and you include the Illinois Institute of Technology, University of Illinois at Chicago, and Cook County Juvenile Court.

It’s not just Chicago proper that sees traffic from crude oil trains. They cut through Joliet, Naperville, Barrington, Aurora, and dozens of other suburbs. “I can look outside my office and see them passing through downtown,” says Tom Weisner, Aurora’s mayor. “About 120,000 tanker cars a year now come through our city.”

Last April, the U.S. Department of Transportation ordered a maximum speed for crude oil trains of 40 miles an hour in populous areas. The majority of railroads run them 10 miles slower than that, an acknowledgment, in effect, that the trains aren’t invulnerable. Most often, it is a flawed track, wheel, or axle that leads to a derailment, which can then cause tank cars to rupture.

Bakken crude was first shipped using tank cars designed for nonhazardous materials and ill suited to its volatility. (Most tank cars are owned not by the railroads but by the oil producers and refiners, such as Valero Energy and Phillips 66, that ship crude.) Those first-generation tank cars, called DOT-111s, have almost all been subjected to new protections, including having their shells reinforced with steel a sixteenth of an inch thicker than used in earlier models. Federal regulations passed in 2015 mandate that by 2025 haulers must replace all cars with new models featuring even thicker steel shells and other safety measures.

Railroads know the dangers. In addition to the human and environmental costs, one terrible accident could put a railroad company out of business. Montreal, Maine & Atlantic Railway, which ran the train that devastated Lac-Mégantic, could only cover a fraction of its hundreds of millions of dollars in liabilities and went bankrupt.

The big railroads hauling crude in the United States and Canada have spent heavily on new technology to make their lines safer, including an Association of American Rails app called AskRail, which identifies the contents and location of rail cars carrying hazardous materials. What railroad companies cannot yet do is reroute trains away from the populous areas whose growth their lines once spurred. There simply isn’t the infrastructure in place to do so.

And while the American Association of Railroads reports that rail companies have spent $600 billion since 1980 improving their current routes, even well-maintained tracks remain vulnerable. Department of Transportation accident data shows that broken rails were the main cause of freight derailments from 2001 to 2010. What’s more, the Federal Rail Administration, the agency charged with overseeing the integrity of America’s tracks, says it can only monitor less than 1 percent of the federally regulated rail system annually due to a shortage of manpower.

“There’s a lackadaisical attitude among people, including officials, about infrastructure that is not up to the threats against it, even as the threats are manifesting,” says Henderson. “You saw that in Flint, Michigan, and in other places with drinking water. And now with crude oil trains, which deal with very serious materials moving [on a system] not adequate to protect people from mistakes.”

Lac-Mégantic, Quebec

In the worst recent accident, 63 cars on a runaway train derailed in the heart of this Canadian town. The resulting blast and flames killed 47 residents and destroyed 30 buildings in the small downtown.

NOVEMBER 8, 2013

Aliceville, Alabama

Outside this tiny Southern town, 25 cars spilled nearly 750,000 gallons of oil into surrounding wetlands, creating an environmental nightmare.

Casselton, North Dakota

After two trains collided, 18 cars on the one carrying crude oil spilled nearly 400,000 gallons.
