Putnam Legislature Opposes Oil Trains, MTA Tax

With little ado, the Putnam County Legislature last Wednesday (April 8) opposed two train-transit practices, one involving freight traffic — the unsafe shipping of incendiary crude oil along the Hudson River; and the other involving commuter lines — the levying of taxes to support the Metropolitan Transportation Authority, whose trains carry numerous county residents to work every day.

By 8-0 votes (with one member absent), the legislature urged New York State to revoke permits that allow volatile oil to travel on the Hudson and to reverse its finding that expanding an Albany oil transportation terminal raises no “significant” concerns. It likewise sought the repeal of the MTA taxes on payrolls and vehicles.

In other business at its formal monthly meeting, the legislature unanimously opted to legalize limited use of sparklers, popular Fourth of July “pyrotechnic” devices.

Barges and ‘bomb’ trains

In addressing the so-called “bomb” train question, the all-Republican legislature added its voice to a growing, bipartisan chorus of local governments in the Hudson Valley opposing the use of rail lines along the river, as well as barges, to move highly explosive oil without adequate safeguards. The legislature devoted much of a committee meeting in February to a background discussion of the issue. (See County Committee to Draft Call for Action on Bomb Trains.)

Its resolution, to be sent to Gov. Andrew Cuomo and state legislative officials, refers to use of “unacceptably dangerous” rail cars to move Bakken shale oil and heavy tar-sands oil, which originate in North Dakota and Alberta, Canada, and are more hazardous than other forms of fuel. The resolution says that daily two to three oil trains, each with 3 million gallons, travel down the western side of the Hudson, opposite Putnam. It points out that recent oil-train derailments in the United States and Canada caused “loss of property and significant environmental and economic damage” as well as, in one case, 47 deaths.

The resolution notes that one oil company, Global Partners LP, proposes to expand its oil terminals in Newburgh and New Windsor, across the Hudson from Putnam County, which could “double the number of trains and marine vessels” carrying such dangerous fuel along the Hudson, despite the presence of designated Significant Coastal Fish and Wildlife Habitats in the Hudson Highlands, Fishkill Creek and elsewhere. A similar expansion is proposed for an Albany facility, the legislature stated.

The resolution also declares that:

  • Under present laws, “no collaboration must take place between the railroads and the towns through which these rail cars [go].”
  • “There have been no spill-response drills in Putnam County waters.”
  • “Putnam County’s shorelines include private residences and businesses, public parks, and critical public infrastructure at significant risk in the case of a crude-oil spill” and that “tourism based on a clean environment is an important part of Putnam County’s economy.”

The legislature asked the state “to immediately revoke permits … allowing for the transport of up to 2.8 billion gallons per year of crude oil on the Hudson River [and] order full environmental impact studies, including the potential impacts of a crude oil spill in the Hudson River affecting Putnam County shoreline property, environmental resources, and drinking water.”

It similarly urged the state to rescind a “negative declaration of significance” on expansion of Albany oil operations and “order a full, integrated environmental impact study of the proposed expansion” of oil terminals in New Windsor and Newburgh, as well as Albany. Under present laws, “no collaboration must take place between the railroads and the towns through which these rail cars [go].”

“It’s not understood” how much risk the transport of volatile oil brings, said Carl Albano, the legislature’s chairman. “It’s a major, major issue in our backyard.”

Legislator Barbara Scuccimarra, who represents Philipstown, observed that the “bomb” trains run along the Hudson “over crumbling bridges and through towns and villages,” compounding the potential for devastation.

“There are really no safeguards in place and it’s scary. If we were to have an explosion, it would be catastrophic,” Legislator Dini LoBue added.

Dangerous Trains, Aging Rails

A CSX freight train ran off the rails last month in rural Mount Carbon, W.Va. One after another, exploding rail cars sent hellish fireballs hundreds of feet into the clear winter sky. Gov. Earl Ray Tomblin declared a state of emergency, and the fires burned for several days.

The Feb. 16 accident was one of a series of recent fiery derailments highlighting the danger of using freight trains to ship crude oil from wellheads in North Dakota to refineries in congested regions along America’s coastlines. The most recent was last week, when a Burlington Northern Santa Fe oil train with roughly 100 cars derailed, causing at least two cars, each with about 30,000 gallons of crude oil, to explode, burn and leak near the Mississippi River, south of Galena, Ill.

These explosions have generally been attributed to the design of the rail cars — they’re notoriously puncture-prone — and the volatility of the oil; it tends to blow up. Less attention has been paid to questions surrounding the safety and regulation of the nation’s aging network of 140,000 miles of freight rails, which carry their explosive cargo through urban corridors, sensitive ecological zones and populous suburbs.

Case in point: The wooden trestles that flank the Mobile and Ohio railroad bridge, built in 1898, as it traverses Alabama’s Black Warrior River between the cities of Northport and Tuscaloosa. Oil trains rumble roughly 40 feet aloft, while joggers and baby strollers pass underneath. One of the trestles runs past the Tuscaloosa Amphitheater. Yet when I visited last May, many of the trestles’ supports were rotted and some of its cross braces were dangling or missing.

The public has only one hope of finding out if such centenarian bridges are still sturdy enough to carry these oil trains. Ask the railroads. That’s because the federal government doesn’t routinely inspect rail bridges. In fact, the government lacks any engineering standards whatsoever for rail bridges. Nor does it have an inventory of them.

The only significant government intrusion into the railroads’ self-regulation of the nation’s 70,000 to 100,000 railroad bridges is a requirement that the companies inspect them each year. But the Federal Railroad Administration, which employed only 76 track inspectors as of last year, does not routinely review the inspection reports and allows each railroad to decide for itself whether or not to make repairs.

The railroad that operates the Tuscaloosa bridge, Watco Companies, and the Federal Railroad Administration assured me it was safe. But shortly after my reporting was published on the websites of InsideClimate News and The Weather Channel, Watco announced that it would make $2.5 million in repairs. And the Department of Transportation’s inspector general said it would begin a review of the F.R.A.’s oversight of rail bridges.

Even where federal engineering standards do exist, it’s unclear how much safety they provide. For instance, federal track safety standards allow 19 out of 24 crossties to be defective along any 39-foot stretch of the lowest grade of track, where the speed limit is 10 m.p.h. These crossties stabilize the rails. On the best of tracks, which have a speed limit of 80 m.p.h., the standards allow half of the crossties to be decayed or missing.

Five oil trains have exploded in the United States in the last 16 months. Miraculously, there have been no deaths. Canada, however, hasn’t been so lucky. In July 2013, an oil train carrying North Dakota oil burst into flames in the Quebec town of Lac-Mégantic, about 10 miles from the Maine border, killing 47 people.

After that accident, federal officials promised to develop sweeping new regulations to make sure nothing like it happens in the United States. In the interim, the Department of Transportation issued an emergency order requiring railroads to get federal permission before leaving trains unattended with their engines running, a major factor in the Lac-Mégantic explosion. And the railroads agreed to a number of voluntary steps, including keeping oil trains under 50 m.p.h.

But more than a year and a half after Lac-Mégantic, new regulations have yet to be finalized as the railroad and oil industries argue about various proposed provisions. The emergency order didn’t end the practice of railroads’ leaving oil trains on tracks with their engines running; it simply required companies to have a written plan for doing so. And without regulations, reporting or penalties, the public has only the railroads’ word they are complying with the 50 m.p.h. speed limit.

For trackside communities, the stakes are obviously high. New hydraulic fracturing technology has allowed oil developers to tap vast amounts of deeply buried oil in parts of North Dakota, Montana and Canada. Without significant new pipeline capacity, the only way to get the oil to refineries is by train. Rail car shipments of crude oil rose from 9,500 in 2008 to more than 400,000 last year.

To protect communities and the environment, the Transportation Department needs to act quickly to require more resilient rail cars, improve the safety of rail infrastructure and operations, and reduce the volatility of oil at the wellhead, before it is loaded onto trains.

Instead, the debate over regulations inches along as oil trains continue to roll through downtown Philadelphia, suburban Chicago and along the Hudson River in New York and the Schuylkill in eastern Pennsylvania, passing close to a nuclear power plant.

Before leaving office last year, Deborah A. P. Hersman, the chairwoman of the National Transportation Safety Board, questioned whether industry representatives and regulators had a tombstone mentality when it came to oil trains. If nobody dies, she suggested, there’s no pressure to act. So far, the tombstones have all been in Canada.

Fed Measures on Crude Oil Fall Short, Put Hudson River at Risk

Last May, we wrote about how the Hudson River Valley has become a virtual pipeline for the transport of highly flammable Bakken crude oil in unsafe DOT-111 railcars–the same tankers whose derailment has caused numerous explosions across the U.S. and the death of 47 people in Lac-Megantic, Canada.

Since then, very little has changed, which means the situation has just gotten worse.

Each day, more than 320 of these oil-laden cars continue to pass through our communities and along the shores of the Hudson River, one of the world’s most biologically diverse tidal estuaries. To date, we’ve escaped disaster, although three trains pulling empty DOT-111s have derailed in the Hudson Valley. Each time a rail accident occurs in the region, as it did just last week, the environmental community holds its breath, expecting the worst.

What will happen if cars full of Bakken crude do go off the tracks? The federal Pipeline and Hazardous Material Safety Administration (PHMSA), quoting the National Transportation Safety Board (NTSB), recently provided the answer: They “can almost always be expected to breach,” making them “vulnerable to fire.” The result would be catastrophic to the public health, vital natural and historic resources, and drinking water supplies of a region stretching from Albany to New York Harbor. It would cause long-lasting, if not permanent, damage to the estuary’s entire ecosystem and the foundation of a vibrant, $4.75-billion tourism economy.

Both Scenic Hudson and Riverkeeper have been advocating vigorously for increased federal protections, including an immediate ban on the use of DOT-111s for transporting crude. Therefore, we were bitterly disappointed and frankly frustrated by new draft regulations proposed by the PHMSA regarding tanker redesign and other measures for reducing the risks of explosions and spills from these “bomb trains.” They just don’t go far enough fast enough, meaning our communities remain at grave risk. It also means the proposed rules don’t comply with federal law, which requires strict safety upgrades that will protect the public.

In formal comments on the regulations our organizations submitted jointly, we outline how the PHMSA’s rules are replete with loopholes and weak safety proposals.

  • Despite acknowledging the safety hazards of DOT-111s, the proposed regulations would very slowly phase out their use for transporting Bakken crude and allow 23,000 of these outdated, dangerous cars to remain on the rails for shipping heavy Canadian tar sands crude, which presents different but equally serious safety and environmental risks.
  • The regulations fail to require full disclosure of rail traffic information to first responders, and instead ask the industry if it would prefer to keep this information confidential.
  • The regulations fail to require the most protective braking improvements or speed restrictions, and fail to even consider limits on the length of trains that could reduce accident risks and impacts of a derailment.
  • The regulations would allow railroads to continue operating 120-car trains of Bakken crude oil without requiring any train-specific spill response plans–despite the fact that a 120-car train carries as much oil as an oil barge or tanker, both of which must have spill response plans approved by the Coast Guard.

Put simply, these rules defer to the rail and oil industries at every turn–and they won’t stop the next bomb train disaster. As the NTSB warned in its official comments on these proposed rules, “Each delay in implementing a new design requirement allows the construction of more insufficiently protected tank cars that will both increase the immediate risks to communities and require costly modification later.” Further, the NTSB concludes that the government’s proposed standards for new and existing tank cars offer options that “do not achieve an acceptable level of safety and protection.”

We deserve real protection for our communities and the environment. And we deserve it now.

For these reasons, Riverkeeper and Scenic Hudson have called on the PHMSA to issue an emergency order requiring immediate adoption of the most stringent tank car standards, speed restrictions and use of electronic controlled pneumatic braking in all trains carrying crude, as well as closing loopholes in the rule that leave heavy tar sands crude and trains carrying fewer than 20 cars of Bakken crude completely unaddressed. (Scenic Hudson also has called for rules requiring Bakken crude to be processed at its source in North Dakota, making it much less volatile for shipment. This is done at many Texas oil fields.)

In addition, we are calling on federal rail regulators to designate the Hudson River Valley, as well as other similarly situated regions, highly important natural and cultural resources under PHMSA routing regulations. This means that the natural and cultural resources within this federally designated National Heritage Area (one of only 49) and Estuary of National Significance (one of 28) require special protection from potential explosions and spills. Rerouting bomb trains away from such specially designated regions would avert a disaster-waiting-to-happen to prime assets along their rail lines. In the Hudson Valley, those assets include six drinking water intakes; 91 state, county and municipal parks; 40 Significant Coastal Fish and Wildlife Areas; nine colleges; 69 public schools and 80 medical facilities.

The federal government has the responsibility to ensure the public’s safety. Until Washington steps up and fulfills this obligation, we’ll have to keep on holding our breath.
