Laurel Norlander grew up down the road from train tracks that trace the edge of Lake Wissota outside Chippewa Falls.

She’d been crossing those tracks her whole life, but that didn’t help the night of Jan. 3, 2013. The 60-year-old was returning to town after a visit to her parents’ home. She stopped at the stop sign before the tracks, but didn’t see or hear an oncoming Canadian National train. The train conductor told investigators he blew the whistle, but Norlander says she’s sure the train never did. They collided, leaving her with a totaled car and a bruised leg.

“It was very bizarre, and I’m grateful to be alive,” she said. “But at an uncontrolled intersection, it would sure be nice if they would blow the horn.”

Norlander’s crash was the first of 60 crashes between trains and highway users in 2013, the highest number Wisconsin has seen in five years. Injuries are at a six-year high, at 21. In addition, there were three deaths.

One possible factor in the rise is increased train traffic in the state, a result of recent booms in sand mining in Wisconsin and crude oil from shale in North Dakota.

Products of the state’s sand mining operations, which have grown from a handful in 2010 to well over 100, are used in hydraulic fracturing, or fracking, a process for extracting oil and natural gas. Crude oil, some of which passes by rail through Wisconsin, has similarly exploded. According to the American Association of Railroads, railroads nationwide transported 9,500 carloads of crude in 2008. In 2012, that number jumped to 234,000, and the most recent estimates for 2013 are around 400,000.

Trains on the tracks where Norlander was struck used to be few and far between, Norlander said, but a new sand plant in town has changed that.

“There’s been quite an increase in train traffic,” she said.

Jeff Plale, the state’s commissioner of railroads, said it seemed as if trains and cars were crashing every time he turns around.

“We have more trains going through the state, they’re heavier, they’re longer. Stop playing with the trains,” he said. “I’m just tired of it, because these (accidents) are so preventable.”

Plale said that besides increased train traffic, some railroads that weren’t in use have been revived, so people aren’t accustomed to seeing the trains.

“All of a sudden you’ve gone from having no trains or very few, and now you have a whole bunch of them. It’s a matter of being cognizant and safe,” he said.

Much of the sand mining activity in Wisconsin has occurred in the region governed by the Western Central Wisconsin Regional Planning Commission, which includes Chippewa County. Train-highway incidents there are at their highest in more than a decade.

According to a Milwaukee Journal Sentinel analysis, there were 11 crashes with trains at highway crossings in Barron, Chippewa, Clark, Dunn, Eau Claire and St. Croix counties. It hasn’t been that high since 2001, a year when the state saw more than 100 rail-highway incidents.

Rail accidents at road crossings have been steadily declining since a peak in the late 1970s, when the annual totals for Wisconsin were 450 and higher. In contrast, there were just 33 crashes in 2010.

Federal Rail Administration spokesman Michael England said reasons for the decline are stepped-up enforcement, advances in technology and a large increase in crossings with lights and gates.

There are more than 4,000 rail-highway crossings in Wisconsin. Of these, about 800 have both flashing lights and gates, a thousand have flashing lights, and 2,200 have only crossbucks. The average cost of installing gates is around $200,000, and the Office of the Commissioner of Railroads spends $4.4 million a year upgrading crossings.

Whatever the signage, crossings can be deadly. In many of the 2013 accidents, drivers went around gates or failed to stop. But cars also got stuck on the rails, in snow, or slid on ice into a train’s path.

Clarence Drewa, 87, a Palmyra resident, was driving Nov. 7 on Benson Ave. in Vernon when his tire got stuck in the railroad tracks. When he saw a train coming, he exited the car, his daughter, Sandra Stefanski, said. But the train struck the car and sent it hurling toward him. Among other injuries, his ribs were marred by fractures, and he died a week and a half later, she said.

The most tragic part was when two of his grandchildren, ages 5 and 6, were looking for their grandpa to come home.

“He was in all of our lives daily, and he was a very healthy man,” his daughter said.

All about the unsafe DOT-111 tank car

Old oil tanker cars, old regulations, new danger

Freight trains have an excellent overall safety record, which is why we don’t flee at the sight of them. But the growing numbers of oil trains rumbling through Washington ought to be making us nervous.

U.S. petroleum production – especially at the Bakken formation in North Dakota – has been expanding far more quickly than the nation’s pipeline capacity. As a result, the crude oil is getting carted across states by train and by truck. Let’s take a closer look at the tanker car that hauls much of that oil through Western Washington.

It’s called the DOT-111, a 1964 design. The Bakken oil that exploded catastrophically in Quebec last July, killing 47 people, was being carried in DOT-111 cars.

Five years ago, the National Transportation Safety Board investigated a low-speed train crash in Illinois in which 15 DOT-111 cars carrying fuel-grade ethanol went off the rails. Thirteen of the cars ruptured; the resulting explosion killed a motorist waiting at the crossing.

The NTSB did the math: 13 out of 15.

“This represents an overall failure rate of 87 percent,” it concluded, “and illustrates the continued inability of DOT-111 tank cars to withstand the forces of accidents, even when the train is traveling at 36 mph, as was the case in this accident.”

The NTSB noted that the basic DOT-111 lacks many puncture-resistance systems and has a thinner shell than cars designed to carry extremely hazardous liquids, such as chlorine. It reportedly is well-suited for things that don’t blow up, like corn syrup.

Bakken crude – as the Quebec disaster demonstrated – is turning out to be unexpectedly volatile and even explosive. It shouldn’t be in the older DOT-111 fleet – newer models are reputedly safer – if the cars aren’t retrofitted with heavier steel armor and other safety features.

The American petroleum boom caught regulators and railways with their pants down.

Railroad companies didn’t have enough modern, thick-walled tanker cars, so the DOT-111s were pressed into service. Spills and explosions have resulted. The U.S. Department of Transportation hasn’t come up with the tighter tank-car standards the new reality obviously demands.

Earlier this month, U.S. Sen. Patty Murray held a hearing that put Transportation Secretary Anthony Foxx on the hot seat. Sen. Susan Collins of Maine asked Foxx when the new oil train standards would be arriving.

“My target date is as soon as possible,” he said.

Four years ago – when North Dakota ran out of pipeline capacity – would have been better timing.

As the United States reaps the fruits of a domestic energy boom, driven in part by huge volumes natural gas extracted via hydraulic fracturing, the amount of oil transported via rail has grown apace. According to the California Energy Commission, 6.1 million barrels of crude chugged into California on trains in 2013, accounting for 1.1 percent of the amount processed at California refineries.

“It is safe to say that we’ve all become alarmed with learning about the large increase in certain types of crude oil and oil products that California refineries will be receiving,” Dickinson said during a Thursday news conference at the downtown Sacramento train station.

Cities have begun raising the alarm about safety hazards, and officials have testified to Congress that most communities are ill-prepared to handle the aftermath of a derailment. In addition to the deadly derailment in Lac-Megantic, Quebec, oil trains have jumped the tracks and ignited in Alabama and  North Dakota.

Now, with a Bay Area refinery planning to move huge amounts of crude oil on a rail line running through downtown Sacramento, Dickinson has proposed legislation requiring railroads to disclose more information about oil shipments to those who would be dispatched to handle a potential rail accident.

“Because of this rapid change in the transportation of crude by rail, state safety rules are simply not what they need to be,” Dickinson said.

Currently, railroads don’t have to notify cities in advance about their cargo. Trains carrying hazardous materials, like oil or acid, must have warnings stenciled on the side of the cars containing the dangerous commodities.

Under Dickinson’s bill, blueprints detailing facts like the volume of oil being transported in a given day; how many cars are being used; and the characteristics of the oil being conveyed would go to local officials. The state agency that now obtains that information would be compelled to share it with local fire and police departments.

“If (responders) know what they’re dealing with,” Dickinson said, “they’ve got a much better chance of controlling and containing the incident and also protecting their own lives.”

Gov. Jerry Brown has also taken note of the growing risk. Under the governor’s budget, the state’s Office of Oil Spill Prevention and Response would get more money and staff to deal with the growing risk of inland oil spills. As it stands now, the agency responds to oil spills in marine areas.

Freight trains roll through the Chicago suburb of Barrington, Ill., every day, many pulling older tank cars known as DOT-111s. They’re known as the “soda can” of rail cars, says village President Karen Darch, because their shells are so thin.

Many of the DOT-111s are full of heavy Canadian tar sands crude oil. Some carry ethanol. And more and more of them are loaded with light Bakken crude oil from North Dakota.

“The worry is that if there’s a derailment and the car is punctured, if any of the flammable materials in it … spills out and explodes, it will create a huge fire, as we saw last summer in Lac-Megantic,” Darch says.

The center of that small town in Quebec just north of the U.S. border was incinerated in July after an unattended oil train rolled downhill and derailed. More than 60 of the DOT-111s on that train exploded into flames, killing 47 people. Since then, safety advocates have been pressuring Canadian and U.S. officials to create new safety standards for tank cars and to make the old DOT-111s more puncture-resistant.

But the regulatory authorities have not acted yet — not even after three fiery derailments of oil trains since, all in rural areas in which no one was injured. Darch believes it’s only a matter of time before there is another.

“In towns like ours, it can derail blocks from a high school with 3,000 kids, right by houses, neighborhoods where people are sleeping in the middle of the night. And even with the best response, you’re going to have very catastrophic results,” she says.

And it’s not just those living near railroad tracks who are increasingly concerned.

“The regulatory uncertainty of not having regulations to build new cars to, or not having regulations to modify the current fleet, is starting to adversely impact my industry,” says Tom Simpson, president of the Railway Supply Institute, which represents rail car manufacturers.

Simpson says that since 2011, the industry has been building to a stronger standard on its own, making new tank cars more puncture-resistant. But some are recommending an even stronger standard than that — and there’s some disagreement between manufacturers, oil companies and the railroads over just how robust the new standard should be.

Manufacturers are becoming frustrated, he says.

“We are willing to build new cars to a tougher standard. We are willing to modify the current fleet to a tougher standard to continue to remove the risk of moving hazardous material by rail, but we would not take that step until we are certain that the steps we do take would be approved by the federal government,” Simpson says.

And that lack of momentum was the focus of a Senate subcommittee hearing on the topic last week. Republican Susan Collins of Maine tried to pin down Transportation Secretary Anthony Foxx on when the new tank car standards would be ready.

His target date, Foxx said, is “as soon as possible.”

“That’s a frustrating answer,” Collins said.

“I understand. It’s frustrating for me to give it to you,” Foxx said. “But I can promise you, senator, that we are working as hard as we can to get the rule done as quickly as we can.”

When pressed, Foxx says he hopes the new rule will be ready before the end of this year. But that vague response leaves industry groups, safety advocates and community leaders somewhere they don’t want to be: in oil tank car limbo.
