Valero is NOT a good neighbor!

Valero’s self-proclaimed “Good Neighbor” status is laughable when you begin to peel back the onion and remove the layers of misinformation (or missing information) and reveal the same flavor of corporate propaganda and fearmongering that is used to hold small communities hostage.

There are hidden costs to having Valero as a neighbor that you may not be aware of.

Valero says the City of Benicia is losing more than $360K per year in revenue because of delays in approving their crude by rail project, which could get us 4 new police officers.

Valero DOESN’T say…

    • CEQA (California Environmental Quality Act) is a law that requires due diligence to properly evaluate environmental impacts and most importantly, inform the public of those impacts. City staff initially attempted to push this project through, under the radar, and without LITTLE public notification – skirting the law. Had it not been for a group of alert citizens bringing this to the public’s attention Valero would have gotten away with implementing a project that would have enormous ramifications to our health, safety, and economic viability, not only in our community, but every community along the rails.
    • Our personal safety is NOT at risk because we are short on police officers, it’s at risk because transporting highly volatile crude oil by rail is extremely risky business. More than 17 major oil train accidents have occurred in the last 24 months resulting in explosions, spills, and derailments.

Valero says they contribute 25% to Benicia’s general fund.

Valero DOESN’T say…

  • That number is actually 20% AND it doesn’t reflect the millions that Valero has taken away from the city’s coffers in recent years.
  • The City of Benicia was forced to pay Valero $2.3 million because Valero filed an appeal for a reduction in its property value from $1.02 billion to $230 million and $964 million to $100 million in 2012 and 2013 respectively despite climbing profits and gas prices since 2010. Benicia loses $2.3 million AND any on-going revenue generated from Valero’s property taxes. How many police officers do you think $2.3 million get us?

Valero says the crude by rail project will reduce air emissions and decrease greenhouse gases. In addition, they say they are entitled to $57million in emission reduction credits because of improvements made to the refinery.

Valero DOESN’T say…

  • The recirculated EIR for their crude by rail project specifically states that there will be significant increases in air emissions and greenhouse gases.
  • Valero has received dozens of notices of emissions violations nearly every single month of 2014 and 2015 including a violation for Benzene.
  • Valero has failed to install any publically accessible emissions monitoring equipment despite their pledge to do so since 2008.
  • Emission reduction credits would allow Valero to increase their emissions for new projects, sell or trade their credits to other polluters. Because of Cap and Trade legislation, big polluters in our own backyards get to pollute even more.
  • According to the EPA, Valero is the biggest polluter in Solano County, contributing 82% of all toxic releases in 2013. Data for 2014 and 15 is not available.

Valero is desperate to turn a profit and will use whatever means is necessary – squeeze money from the city coffers, pollute our environment, and put our lives at risk – to satisfy the short-term interests of their shareholders. They even threaten to lay people off or sell the refinery if the city doesn’t comply.

We can’t let one business keep our community in such an economically vulnerable situation. The City of Benicia has adopted a Climate Action Plan, but can’t seem to address THE REAL CLIMATE ELEPHANT IN THE ROOM, which is Valero. It’s time that serious action be taken to seek out and invite other, more sustainable industries to our city because Valero is NOT a Good Neighbor!

EDMONTON — The Transportation Safety Board (TSB) says 20 cars carrying potash derailed just north of Wetaskiwin, Alta., around 9:09 a.m. Sunday near Highway 13.

Pictures from the scene show piles of potash, which is mostly used in fertilizers, spilling onto the ground.

HUDSON, Colo. (AP) — A train jumped its tracks early Sunday, dumping tons of coal from more than two dozen cars near the northern Colorado town of Hudson.

(Reuters) – A Los Angeles-bound commuter train slammed into a produce truck apparently stuck on the tracks in a Southern California city before dawn on Tuesday, injuring 50 people in a fiery crash, some of them critically.

The truck driver, who was not hurt, left the scene of the destruction in Oxnard on foot and was found walking and disoriented one or two miles away, Assistant Police Chief Jason Benitez said.

Benitez said the 54-year-old driver from Arizona was not arrested but investigators were trying to determine if there was any criminal wrongdoing in the 5:45 a.m. PST (8:45 a.m EST) wreck, which overturned three double-decker Metrolink rail cars. Two others derailed but remained upright.

While no-one was killed, the force of the impact ripped the truck apart and left burned-out chunks and twisted wreckage still smoldering hours later.

Benitez said it appeared that the truck driver had taken a wrong turn in the pre-dawn darkness and ended up on the tracks, where the rig became stuck as the train approached at 79 miles per hour.

But in a move that may have helped avert a more catastrophic accident, the train used an emergency braking system moments before impact, and the rail cars had safety features that helped absorb the energy of the crash, Metrolink spokesman Jeff Lustgarten said.

“I think we can safely say that the technology worked. It definitely minimized the impact. It would have been a very serious collision, it would have been much worse without it,” Lustgarten said.

The crash came three weeks after a Metro-North commuter train struck a car at a crossing outside New York City and derailed in a fiery accident that killed six people.

TRAIN OPERATOR CRITICAL

Ventura County Emergency Medical Services administrator Steve Carroll said 50 people were hurt in the Oxnard incident, 28 of whom were transported to hospitals.

Among the most seriously injured was the train’s operator, who was in critical condition in the intensive care unit at Ventura County Medical Center, hospital spokeswoman Sheila Murphy said.

The operator, who has not been publicly identified, suffered extensive chest injuries affecting his heart and lungs but was able to communicate with doctors, Murphy said.

National Transportation Safety Board Member Robert Sumwalt said investigators would examine the train’s recorders and seek to determine if crossing arms and bells were functioning properly.

“We are concerned with grade crossing accidents. We intend to use this accident and others to learn from it so that we can keep it from happening again,” Sumwalt said.

The incident took place where the Metrolink tracks cross busy Rice Avenue in Oxnard, a street used by a steady stream of big rigs and farm trucks and lined with warehouses and farmland.

“It is a very dangerous crossing,” said Rafael Lemus, who works down the street from the crash site. “The lights come on too late before the trains come. It is not safe.”

A Ventura County Medical Center spokeswoman said the hospital had received nine victims, three of whom were listed in critical condition.

Los Robles Hospital & Medical Center received six patients with minor injuries such as back, leg or shoulder pain, said spokeswoman Kris Carraway. St. John’s Pleasant Valley Hospital in nearby Camarillo was treating two patients for minor injuries, a spokeswoman said.

The wreck triggered major delays to Metrolink lines across Ventura County, forcing commuters onto buses. Oxnard is an affluent coastal city of some 200,000 about 45 miles northwest of Los Angeles.

In 2008, a crowded Metrolink commuter train plowed into a Union Pacific locomotive in Chatsworth, California, killing 25 people and injuring 135 in an accident officials blamed on the commuter train engineer’s failure to stop at a red light.

In 2005 a Metrolink train struck a sport utility vehicle parked on the tracks in the Los Angeles suburb of Glendale, killing 11 people and injuring 180.

AP Exclusive: Fuel-hauling trains could derail at 10 a year

BILLINGS, Mont. (AP) – The federal government predicts that trains hauling crude oil or ethanol will derail an average of 10 times a year over the next two decades, causing more than $4 billion in damage and possibly killing hundreds of people if an accident happens in a densely populated part of the U.S.

The projection comes from a previously unreported analysis by the Department of Transportation that reviewed the risks of moving vast quantities of both fuels across the nation and through major cities. The study completed last July took on new relevance this week after a train loaded with crude derailed in West Virginia, sparked a spectacular fire and forced the evacuation of hundreds of families.

Monday’s accident was the latest in a spate of fiery derailments, and senior federal officials said it drives home the need for stronger tank cars, more effective braking systems and other safety improvements.

“This underscores why we need to move as quickly as possible getting these regulations in place,” said Tim Butters, acting administrator for the Transportation Department’s Pipeline and Hazardous Materials Safety Administration.

The volume of flammable liquids transported by rail has risen dramatically over the last decade, driven mostly by the oil shale boom in North Dakota and Montana. This year, rails are expected to move nearly 900,000 car loads of oil and ethanol in tankers. Each can hold 30,000 gallons of fuel.

Based on past accident trends, anticipated shipping volumes and known ethanol and crude rail routes, the analysis predicted about 15 derailments in 2015, declining to about five a year by 2034.

The 207 total derailments over the two-decade period would cause $4.5 billion in damage, according to the analysis, which predicts 10 “higher consequence events” causing more extensive damage and potential fatalities.

If just one of those more severe accidents occurred in a high-population area, it could kill more than 200 people and cause roughly $6 billion in damage.

“Such an event is unlikely, but such damages could occur when a substantial number of people are harmed or a particularly vulnerable environmental area is affected,” the analysis concluded.

The two fuels travel through communities with an average population density of 283 people per square kilometer, according to the federal analysis. That means about 16 million Americans live within a half-kilometer of one of the lines.

Such proximity is equivalent to the zone of destruction left by a July 2013 oil train explosion that killed 47 people and leveled much of downtown Lac-Megantic, Quebec, the analysis said.

Damage at Lac-Megantic has been estimated at $1.2 billion or higher.

A spokesman for the Association of American Railroads said the group was aware of the Department of Transportation analysis but had no comment on its derailment projections.

“Our focus is to continue looking at ways to enhance the safe movement of rail transportation,” AAR spokesman Ed Greenberg said.

Both the railroad group and the Railway Supply Institute, which represents tank car owners and manufacturers, said federal officials had inflated damage estimates and exaggerated risk by assuming an accident even worse than Lac-Megantic, which was already an outlier because it involved a runaway train traveling 65 mph, far faster than others that had accidents.

To get to refineries on the East and West coasts and the Gulf of Mexico, oil shipments travel through more than 400 counties, including major metropolitan areas such as Philadelphia, Seattle, Chicago, Newark and dozens of other cities, according to routing information obtained by The Associated Press through public record requests filed with more than two dozen states.

Since 2006, the U.S. and Canada have seen at least 21 oil-train accidents and 33 ethanol train accidents involving a fire, derailment or significant amount of fuel spilled, according to federal accident records reviewed by the AP.

At least nine of the trains, including the CSX train that derailed in West Virginia, were hauling oil from the Northern Plains’ Bakken region that is known for being highly volatile. Of those, seven resulted in fires.

Both the West Virginia accident and a Jan. 14 oil train derailment and fire in Ontario involved recently built tank cars that were supposed to be an improvement to a decades-old model in wide use that has proven susceptible to spills, fires and explosions.

Safety officials are pushing to make the tanker-car fleet even stronger and confronting opposition from energy companies and other tank car owners.

Industry representatives say it could take a decade to retrofit and modify more than 50,000 tank cars, not the three years anticipated by federal officials, who assumed many cars would be put to new use hauling less-volatile Canadian tar-sands oil.

The rail industry’s overall safety record steadily improved over the past decade, dropping from more than 3,000 accidents annually to fewer than 2,000 in 2013, the most recent year available, according to the Federal Railroad Administration.

But the historical record masks a spike in crude and ethanol accidents over the same time frame. Federal officials also say the sheer volume of ethanol and crude that is being transported – often in trains more than a mile long – sets the two fuels apart.

Most of the proposed rules that regulators are expected to release this spring are designed to prevent a spill, rupture or other failure during a derailment. But they will not affect the likelihood of a crash, said Allan Zarembski, who leads the railroad engineering and safety program at the University of Delaware.

Derailments can happen in many ways. A rail can break underneath a train. An axle can fail. A vehicle can block a crossing. Having a better tank car will not change that, but it should reduce the odds of a tank car leaking or rupturing, he said.

Railroads last year voluntarily agreed to reduce oil train speeds to 40 mph in urban areas. Regulators said they are considering lowering the speed limit to 30 mph for trains not equipped with advanced braking systems. Oil and rail industries say it could cost $21 billion to develop and install the brakes, with minimal benefits.
