Report on fatal Ellicott City train accident details how a piece of rail snapped

They would be college graduates now, poised on the brink of life, had not a train gone off the tracks two years ago in a tragic fateful moment that caught them where they should not have been.

After almost two years of investigation into a 2012 train derailment in Ellicott City, Md., the National Transportation Safety Board said a piece of rail near replacement age simply snapped under the weight of a half-mile-long train carrying 9,873 tons of coal toward the Baltimore docks.

Elizabeth Nass and Rose Mayr, both 19 and celebrating their imminent return to college, were sitting a few feet away on a trestle 20 feet above Main Street. They were buried beneath the spilling coal. Death transformed them into a parable for being in the wrong place at the wrong time, and for the random cruelty of fate. The details played out on the airwaves and in print as far as Australia.

They had tweeted messages and photos to friends from atop the rail bridge as the freight train rumbled toward them just before midnight. One photo showed the tiny shops and bars of Main Street, gone dark deep into Sunday night. Another showing their feet dangling off the bridge came with a one-word exclamation: “Levitating.”

Last month, the parents of the girls spoke out for the first time, releasing a statement through their attorneys saying that the CSX railroad was to blame.

The NTSB report is more meticulous than captivating. It describes details of the accident and gives a broader picture of a freight rail company struggling to stay ahead of deterioration on the oldest stretch of common carrier rail line in the United States.

It describes how the three crew members had the train rolling at 23 mph, just below the acceptable limit, when the emergency brakes slammed it to a halt. They got out to discover that 11 cars had overturned, including eight that had dumped their loads as they toppled into a parking lot below.

As they pieced together sections of shattered rail, investigators could not find five inches of it. “At the point of derailment, the rail fractured,” they said. The board said that “the probable cause of the Ellicott City derailment was a broken rail with evidence of rolling contract fatigue.”

The NTSB report said the railroad was aware of the history of rail defects on that line and of the increased volume of coal tonnage the line was carrying. As a result, the report said, CSX ran ultrasonic tests on the rails 11 to 12 times a year, far more frequently than regulations require. The rail had been tested by federal regulators in July 2012 and by CSX 17 days before the Aug. 20 derailment. “In the area of the derailment, no defects were recorded” by that CSX testing, the NTSB said.

After the accident, some people in Ellicott City said the railroad bridge was a place where underage people went to drink out of sight of others.

Just before they died, Nass tweeted, “Drinking on top of the Ellicott City sign,” a reference to the welcome sign painted on the bridge just below their dangling feet. The underage girls were not heavily inebriated, the NTSB report said. One had a blood alcohol level of 0.05 and the other was at 0.03, both below the limit of 0.08 for driving a car.

“Our daughters did not cause the derailment, CSX did,” Sue Nass, Elizabeth Nass’s mother, said in the statement released by the law firm, which said the families would seek a settlement from CSX. “A rail car should not turn over and kill innocent people.”

The NTSB report said CSX has installed a chain-link fence along the rail line “in an attempt to deter future trespassing.”

Crude oil trains make daily crossings

A railway bridge located on the Hudson River across from Cold Spring has visibly deteriorated however its owner says it remains fit for daily use by freight trains. The bridge is located at milepost 51 on the River Line, a 132-mile stretch of track that runs from northern New Jersey to Selkirk, New York, just south of Albany. The bridge and the tracks are owned by the Florida-based CSX Corporation. At the bridge, the tracks are located just a few feet from the riverbank.

The span in question, along with a second bridge a few hundred yards to the south, crosses over a pair of narrow channels that enable waters from a wetland located west of the tracks to flow in and out freely as river levels change due to tides, wind and rain. Concrete that forms a part of the bridge’s structure has crumbled beneath a vertical support directly under the tracks.

In an email to The Paper, CSX Spokesperson Kristin Seay, said that the bridge is “current” with regard to its annual inspection. “It was last inspected on Feb. 6, 2014, and was determined to be safe for railroad operations.” Seay said that all CSX bridges are inspected annually.

The bridge to the south also shows signs of deterioration but to a lesser extent. On that structure, concrete has fallen away, exposing the reinforcing metal bar.

Oil transport by rail on the rise

The condition of tracks and bridges along the Hudson River has become more significant locally as part of a national trend which has seen an exponential increase in the transport of crude oil and other hazardous materials by rail in recent years. On July 23, 2014, USA Today reported that “The number of oil-carrying cars run by seven major U.S. railroads jumped from 9,500 in 2008 to 407,761 in 2013…” Closer to home, Seay told The Paper that “CSX operates an average of two to three loaded crude oil trains per day over (the River Line) route…” That adds up to between 700 and 1,000 crude-oil trains that pass directly across from Philipstown each year.

Two high profile, rail-related tragedies that occurred in recent months no doubt add to local concern. Last July, in Lac-Megantic, Quebec, a train loaded with oil exploded, killing 47 people. Local insurance claims were estimated at $50 million. And in May of this year, a train derailed in Lynchburg, Virginia, dumping some 50,000 gallons of crude oil into the James River.

A July 23 editorial in the Albany Times Union underscored what it called “failure of government to adequately ensure rail safety” as evidenced by such accidents.

Federally regulated

Freight rail lines in the U.S. are regulated almost entirely at the federal level by the Federal Railroad Administration (FRA). Federal law requires that all railroad companies inspect their own bridges on an annual basis — regardless of the size of the bridge. Companies must determine the load capacity of each bridge, certifying to the state where it is located that it is capable of bearing the daily load it must handle.

On July 23, the Federal Department of Transportation proposed comprehensive rules to improve crude oil transportation safety. Recommendations include an immediate phasing out of older tank cars, new standards for tanker cars that carry highly hazardous materials, reduced operating speeds, and required notification of first responders.

At the state level, the New York State Department of Transportation’s (DOT) Rail Safety Inspection Section participates in FRA safety programs — mainly for staff training and certification. Beau Duffy, DOT Director of Communications, told The Paper that the agency also conducts random inspections or “blitzes” of rail facilities, focusing on track conditions and mechanical equipment such as brakes and wheels. He said that DOT does not however inspect bridges.

National issue … local focus

The deteriorating bridge across from Cold Spring brings what has become a significant national issue into very local focus.

Commenting on the CSX bridge, a Federal Railroad Administration official told The Paper that the FRA would work with CSX to ensure it is in compliance with all federal safety standards noting that FRA inspectors regularly evaluate railroad companies’ bridge safety practices to identify potential weaknesses.

Local senior-elected officials also commented on the River Line bridge. “Like many of my neighbors, I’m extremely concerned about the integrity of this bridge,” said Rep. Sean Patrick Maloney (D-18th District, NY), when notified of the issue by The Paper. “I immediately brought this to the … attention of CSX, and I’ll work closely with officials to ensure inspections are conducted and any necessary repairs are done promptly. With billions of gallons of oil barreling down the Hudson, we must be vigilant that issues like this are addressed quickly — the safety of our neighbors, environment and communities is far too important.”

Maloney is a member of the House Transportation and Infrastructure Committee, and has been working with the chairman of that committee to examine the environmental and economic impact of shipments of crude oil along the Hudson River.

New York State Sen. Terry Gipson (D-Dutchess, Putnam) also commented. “The impact of an oil train incident along the shore of the Hudson River would be devastating to our communities who rely on the river for their drinking water and our local economy,” Gipson said via email. “That is why I … have expressed strong concerns to our federal government about the need for safety improvements relating to the interstate transportation of crude oil along the Hudson River. This effort includes ensuring necessary track maintenance and infrastructure investments that will allow businesses to operate more effectively and safely.”

America’s drilling boom means more freight trains are snaking through Chicago carrying oil, which can erupt into fireballs if the tank cars derail. A new federal proposal to make the cars safer should be enacted as quickly as possible, and any changes in the final rules should enhance safety, not weaken it.

On July 23, U.S. Transportation Secretary Anthony Foxx proposed phasing out tens of thousands of tank cars called DOT-111s that date back to the 1960s and that too easily rupture or get punctured in derailments. In the past six years, oil has spilled in 10 major derailments, many of them fiery. In the worst, 47 people died last year in Quebec. In April, 30,000 gallons of crude oil leaked into the James River amid a blazing derailment near downtown Lynchburg, Va.

Because more than 40 oil-carrying trains pass through metropolitan Chicago every week, the safety proposal is critical. Mayor Rahm Emanuel called it a “very important step to reduce the risk of catastrophic disasters in our cities.”

The weaknesses of older tank cars, which include about 78,000 of the 92,000 now in use, have been known for 25 years. But now there’s a new reason to worry about them. A boom in American oil production, largely due to hydraulic fracturing — or fracking — that extracts petroleum from places where oil pipelines don’t go, has led to a surge in oil-carrying freights. Nationwide, the number of oil carloads jumped from 9,500 in 2008 to 434,000 last year. Trains carrying crude often are longer than 100 tank cars and can carry more than a million gallons.

In May, the U.S. Department of Transportation issued an emergency order requiring railroads to notify local officials before trains carrying large quantities of crude pass through. Now, the department has proposed a range of additional safety options, including requiring new or retrofitted tank cars to have thicker shells, more effective brakes and roll-over protections. Tank cars that don’t meet the new standards would be phased out after two years if they carry the most flammable fuels, including ethanol and most grades of crude oil.

Foxx also is calling for speed limits on trains transporting the fuels, especially through highly populated areas, and testing of the liquids they carry.

The proposals will go through negotiations, including a public comment period, before the final rules come out. Not everyone will agree: Industry representatives, for example, think the proposed speed limits are too low and environmentalists think they are too high.

Fortunately, industry players, including the Association of American Railroads and the American Petroleum Institute, agree tank cars need to be safer. They have offered their own safety enhancements, which don’t go as far as those proposed by Foxx. For example, they want a three-year phase-out period instead of two and would select a design used on tank cars built since 2011 as the new, safer standard.

The final rules should take into account legitimate concerns of business and environmentalists, but the government shouldn’t significantly water down the safety proposals nor let negotiations drag on, putting off the day crude shipments get safer.

We don’t want to see any disastrous fireballs along the many rail lines running through Chicago and its suburbs.

Oil Train Workers Raise Questions About Safety

Crude oil shipments by rail increased by more than 80 percent, nationally, last year. Most of it is coming from the Bakken oil fields of North Dakota. That crude is more flammable than other types of oil, and has been shown to catch fire and explode when trains derail.

More than 15 trains of Bakken oil move through some parts of the Northwest each week, en route to refineries and terminals in Washington and Oregon.

Burlington Northern Santa Fe Railway transports the majority of that oil. The company regularly touts its commitment to safety. But an EarthFix investigation reveals some troubling patterns in the way BNSF Railway deals with whistleblowers — particularly those who voice concerns about safety.
