Five rail cars carrying petroleum crude oil derail and catch fire near Boeing Field, about five miles south of downtown Seattle. That was the scenario during a tabletop exercise King County held Tuesday.

The planning exercise took place less than two weeks after three tank cars carrying highly flammable crude oil from North Dakota derailed in Seattle’s Interbay neighborhood. That incident was relatively benign. None of the cars leaked or caught fire. The mock scenario discussed on Tuesday was designed to be far more precarious.

“This is an emerging public safety threat,” said King County Executive Dow Constantine at a press conference on Wednesday. “And we need to have our emergency preparedness folks really up to speed on it and well-coordinated. And that’s what yesterday’s exercise was all about.”

The exercise highlighted some of the complications responders might face when dealing with burning tank cars of crude oil, such as monitoring toxic smoke, transporting evacuated people and delivering information to the public.

Between eight and 13 trains operated by BNSF Railway Co. pass through King County each week carrying crude oil, according to information the railroad released in June to the Washington Military Department.

A local fire chief involved in the exercise acknowledged on Wednesday that responders would most likely have to let some of the fuel burn off if one of those trains crashed and five tank cars were ablaze.

The cars commonly used to transport petroleum crude oil have a capacity of about 30,000 gallons apiece. In past wrecks, un-breached cars, heated by surrounding flames, have ruptured in dramatic explosions.

“We’ll want to probably suppress the fire enough to assess the integrity and exposure to the other tank cars. We’d certainly want to minimize life risks,” said Mark Chubb, Fire Chief of King County Fire District 20.

“It’s unusual for all five tank cars to breach,” he also said.

Battling flames would not be the only problem that burning tank cars of crude oil would present for responders.

“We have to be mindful of the impact of the smoke column on aviation,” Chubb said. He also noted that a large oil train fire could create problems on Interstate 5, even if the smoke and flames do not reach the highway. “The distraction of an event of this scale,” he said, “is going to be highly disruptive.”

Chubb added: “After you grapple with the fact that it’s a fire and it’s going to go on a while, it’s all about logistics.”

Walt Hubbard, director the King County Office of Emergency Management, viewed Tuesday’s exercise as helpful, because it got people from different agencies together in the same place, talking about how they would coordinate and communicate if there were a serious crude oil train accident.

In addition to emergency responders, staff from local transportation and public health departments attended, as did officials from federal agencies, such as the Federal Emergency Management Administration, the U.S. Coast Guard and the Environmental Protection Agency.

Representatives from BNSF were also on hand. The company operated the train that derailed in Interbay.

For Hubbard, having the railroad representatives at the exercise was important.

“We want to keep them engaged,” he said. Hubbard specifically pointed to dialogue that took place between BNSF representatives and fire officials about what kinds of equipment and people the railroad could deploy after an accident.

“That was a very good exchange,” he said.

Another topic that came up during the exercise was evacuations. If a rail car of crude oil is on fire, U.S. Department of Transportation guidelines recommend that responders consider evacuating people within a half-mile of the accident scene.

The risk of an explosion would be one immediate reason to evacuate the area around the fire. But Chubb, the King County fire chief, also noted that toxic smoke is a hazard, and said that responders would consult with officials from public health agencies and the EPA when considering whether to tell people to leave the area.

Washington, D.C. — Today, two national environmental organizations filed a formal legal petition to compel the Secretary of the U.S. Department of Transportation to issue an emergency order prohibiting the use of hazardous rail cars—known as DOT-111s—for shipping flammable Bakken crude oil (See FAQ sheet for more info on petition). The National Transportation Safety Board has repeatedly found that the DOT-111 tank cars are prone to puncture on impact, spilling oil and often triggering destructive fires and explosions. The Safety Board has made official recommendations to stop shipping crude oil in these hazardous tank cars, but the federal regulators have not heeded these pleas (See quote sheet of on-record statements by public officials for more info).

“These oil tankers have been called the Ford Pinto of the rails,” said Ben Stuckart, City Council president in Spokane, Washington. “National Transportation Board members, U.S. Senators, and local officials are all on record on the danger of these antiquated, unsafe rail cars. It’s long past time for the government to take action to protect communities like mine.” Officials estimate between 13 and 16 oil trains a week come through Spokane, a major hub for rail traffic, although those numbers would skyrocket if planned oil terminals on the West Coast are built. Spokane is one of many towns across the country that has seen an organized and strong community opposition to these trains.

In September 2013, in the wake of the deadly Lac-Mégantic and other rail disasters, the federal government began a rulemaking process to set new safety standards for crude oil rail cars. Transportation Secretary Anthony Foxx has stated publicly that the DOT-111s will likely have to be phased out, and even questioned whether the industry’s replacement design is safe enough for U.S. communities. The draft rule is currently under review at the White House. But the groups believe that the process is moving too slowly and likely to drag on a year or more before a final rule is in place. While he has issued emergency orders addressing other urgent safety issues, all the Department has done to date is urge shippers to use the safest tank cars in their fleets. Immediately banning the use of DOT-111 tank cars to ship Bakken crude would reduce the risk of punctures and oil spills by over 75 percent, according to rail industry estimates.

“The continued use of potentially unsafe DOT-111 train cars is a disaster waiting to happen. The people of Albany County are standing up today to ask the federal government take swift action to improve rail safety,” said Albany County Executive Daniel P. McCoy. “In light of recent incidents in North America, a strong response from the federal government is needed to protect the public.” Trains carrying Bakken crude oil arrive daily into the Port of Albany, like many other towns across the country. Firefighters and first responders have hurried to train for impending disasters and increased risk.

“These exploding oil trains are in our backyards, where our kids play,” said Charlene Benton, president of the Ezra Prentice Homes Tenants Association in Albany, NY. “We’re putting our children’s and our neighbors’ lives in jeopardy here. Over the last three years, we’ve seen a huge increase in the number of these dangerous oil trains coming through our community. Our community has organized against these oil trains because we don’t want to be the site of another catastrophic disaster. We need a national emergency ban of these oil rail cars.”

The recent surge in U.S. oil production, much of it from Bakken shale, has led to a more than 4,000 percent increase in crude oil shipped by rail since 2005, mostly in long oil trains with as many as 120 cars and over 1.5 miles long. The Bakken crude has proven to be more explosive than shippers represented. And the Bakken crude has been shipped in the most dangerous tank cars on the market – the DOT-111s. The result has been oil spills, destructive fires, and explosions when oil trains have derailed. More oil spilled in train accidents in 2013 than the total in 1975-2012 combined. Canada has taken steps to ban many DOT-111s immediately and is phasing them out of hazardous transport altogether, which will shift even more of these tank cars to the U.S.

The petition follows closely on the announcement that the oil and rail industries have reached their own compromise proposal on rail safety, one that would only seek to slowly phase out dangerous DOT-111s over three years, and that would propose a weaker standard for new rail cars than the industry had previously proposed.

Report minimizes risk from oil trains through Roseville, Sacramento

A much-anticipated report released Tuesday offered new details and some controversial safety conclusions about a Bay Area oil company’s plan to run crude-oil trains daily through Roseville and Sacramento to Benicia.

Valero Refining Co., which operates a sweeping plant on a hillside overlooking Suisun Bay, plans to transport crude oil from undisclosed North American oil fields on two 50-car trains every 24 hours through the Sacramento region to the Benicia site. One would run at night and the other in the middle of the day to minimize conflicts with Capitol Corridor passenger trains, which share the same line.

If the project is approved, Valero would begin shipments later this year or early next year. The trains would cut through downtown Roseville, Sacramento and Davis, and pass within a quarter-mile of 27 schools, 11 of them in Sacramento, according to the draft environmental impact report, which was commissioned by the city of Benicia, lead agency on the project.

In findings that already are provoking debate, authors of the draft report concluded that the shipments would not constitute a significant safety risk for communities along the rail route because those trains are very unlikely to crash or spill their oil.

“Although the consequences of a release are potentially severe, the likelihood of such a release is very low,” wrote the report’s author, Environmental Science Associates of San Francisco. The report notes that safety steps by federal officials and railroad associations, such as slower train speeds through some urban areas and more track inspections, already are reducing the chance of crashes.

A spill risk assessment included in the report calculates the probability of a spill of 100 gallons or more in the 69 miles between Roseville and Benicia as occurring only once every 111 years. The key report section regarding impact on up-rail cities, including Sacramento, Davis, West Sacramento and Roseville, concludes: “Mitigation: None required.”

Several local Sacramento leaders on Tuesday said they had not yet read the Benicia report, which runs hundreds of pages, but that they weren’t soothed by a declaration that oil spills are unlikely.

Mike Webb, director of community development and sustainability in Davis, said the assessment misses a frightening reality for people living along the rail line: “It only needs to happen once to be a real problem.”

Across North America, six major crude-oil train crashes in the last year resulted in 2.8 million gallons of oil spilled, some of it causing explosions and forcing evacuations. The worst of those occurred last July in Lac-Megantic, Canada, where a runaway Bakken train crashed, spilling 1.6 million gallons of crude and fueling an explosion that killed 47 people and leveled part of that city’s downtown.

State Sen. Jerry Hill, D-San Mateo, introduced a bill last week to charge the oil industry a rail-related fee to pay for safety measures. In an interview earlier this week, he said he believes “it is not a matter of will (a spill) happen, it’s when. We have to be prepared.”

The debate over the Valero project is part of a growing discussion nationally about crude oil safety, prompted by increased pumping in recent years of less-expensive crude oil from Canada and the Bakken fields of North Dakota.

The surge in extracting North American oil is enabling some companies, such as Valero, to reduce reliance on overseas shipments of foreign oil. At the same time, it has caused a dramatic increase in the number of trains crisscrossing the country, pulling 100 cars or more of flammable crude through downtowns, with almost no notice to the public and minimal warning to local fire departments.

The debate was heightened by a federal warning earlier this year that Bakken crude may be more volatile than other crudes, and by federal concerns that the fleet of train tanker cars in use nationally is inadequate to safely transport crude oils. Last week, Gov. Jerry Brown’s administration issued a report saying California is behind in taking steps to protect cities and habitat from potential oil spills given the increase in crude oil shipments.

The draft environmental impact report released Tuesday does not state whether Valero will be transporting Bakken crude to Benicia. Valero has declined to disclose publicly exactly which crude oils it will ship. But the report lists Bakken as one of the lighter crudes Valero could ship.

The U.S. Department of Transportation is considering amending tank car design standards in light of concerns raised by recent fiery spills. Valero officials say they already have purchased some tank cars that have more safety features than most rail cars in use nationally. Valero spokesman Chris Howe said his company would expect to phase in retrofits of those cars, depending on what the federal government ultimately requires.

In California, the Valero crude-by-rail project is one of a handful planned by refineries. Another by Phillips 66 in Santa Maria likely will involve crude oil shipments through Sacramento. Several Kern County refineries also are adjusting or planning to retrofit their sites to receive crude shipments by rail. Trains last year began delivering crude oil to a transfer station at McClellan Park in Sacramento.

Rail companies are insisting that details of those shipments not be disclosed to the public, saying they are worried about security issues and don’t want to divulge “trade secrets” to competitors.

Local officials, including fire chiefs, recently have said they want to know more about the Valero project in particular. The Davis City Council has passed a resolution saying it does not want the shipments to come through the existing UP line in downtown.

Sacramento Rep. Doris Matsui, responding to questions by email Tuesday, expressed concern as well. “As the number of cars coming through Sacramento increases, it is clear that our risk also increases,” she wrote.

Webb, the Davis community development director, said representatives from Sacramento area cities will meet in two weeks to discuss the Benicia environmental report. Several local officials have said they would like Valero and UP to work with them on safety measures, including more communication about train movements and hazardous materials training.

The Benicia report declines to specify the routes trains may take to get from oil fields to Roseville, saying that any potential routes beyond Roseville are speculative. The most likely routes, according to people knowledgeable about rail movements, are through the Sacramento Valley via Dunsmuir and Redding, as well as over Donner Summit or through the Feather River Canyon.

The conclusion that an oil spill between Roseville and Benicia is a once-in-111-years event was made by Christopher Barkan, an expert on hazardous rail transport at the University of Illinois who did a risk assessment attached to the draft environmental impact report. Barkan previously worked for the American Association of Railroads, the industry’s leading advocacy group in Washington, and does research supported by the railroad association, according to his institute’s website.

Barkan, in an email, said his work for Benicia was not influenced by his relationships with the railroad association.

“The AAR had nothing to do with this project,” he wrote. “Whenever I am approached about conducting projects such as this, I discuss any potential conflicts of interest with other sponsors, as I did in this case, and it was mutually agreed that there was none … My role is to apply the best data and analytical methods possible to assess risk, irrespective of the sponsor.”

Benicia city officials did not respond to a request for comment Tuesday. The draft EIR will be circulated for public comment this summer. Those comments will be incorporated into a final environmental document, to be voted on by the Benicia City Council. The council has the authority to approve changes at Valero’s plant to allow the oil company to begin rail shipments.

Howe, the Valero spokesman, complimented the city of Benicia on “the thoroughness and detail” of the report.

“We are reviewing the material published today and will be developing comments as part of the process. We look forward to working with the community and the city of Benicia toward completion of this important project.”

Oil train fires require SWAT teams, veteran firefighters tell states

— A pair of Texans with decades of firefighting experience is encouraging state and local government leaders to consider establishing SWAT-like response teams for crude oil train fires.

A series of derailments of trains loaded with crude oil in the past year has exposed numerous safety vulnerabilities, including the integrity of the rail cars, the condition of the tracks and the way the trains are operated.

It’s also revealed a yawning gap in emergency response. Most fire departments across the country are simply not trained or equipped to fight the enormous fires seen in recent derailments.

“Emergency response is the most difficult part,” said Bob Andrews, founder and president of the San Antonio-based Bob Andrews Group, who has both firefighting experience and knowledge of the rail industry.

Groups representing firefighters, fire chiefs and emergency management agencies have testified in Congress in recent months that derailments such as those in Quebec, Alabama and North Dakota are beyond their response capabilities.

“There’s only so much training you can do,” said Sam Goldwater, Andrews’ business partner. “Our first responders are pretty much maxed out.”

Andrews and Goldwater said they’ve received a favorable response so far from the state and federal officials they’ve approached. Several states have expressed interest in their plan, but a proposal for a specialty fire department in the Philadelphia region is the furthest along. They envision for their proposal to be a mix of public and private funds.

“We’re optimistic that we’ll be able to work something out in Pennsylvania,” Andrews said after a recent meeting with state officials.

Entire trains of tank cars loaded with crude oil snake through Pennsylvania’s capital city every day, bound for refineries and terminals along the East Coast. The trains carry Bakken crude oil from North Dakota and western Canadian tar sands oil to a cluster of refineries and barge terminals in the Philadelphia area.

Andrews and Goldwater say that airports and refineries have their own firefighting teams with special expertise and equipment. And, they say, that’s precisely what’s demanded by the rise in crude oil shipments by rail.

“You need the airport idea,” Goldwater said, “but you need it for the 1,400 miles between North Dakota and the Delaware River.”

In March testimony before a Pennsylvania House of Representatives committee, Andrews said that the nation’s 783,000 volunteer firefighters are dedicated to their work. But according to the National Volunteer Fire Council, their ranks have declined 13 percent since 1984.

“It is not fair for the community, at the local or state level, to create an environment where well-meaning volunteers will feel compelled to commit themselves to conducting highly-hazardous operations, that they are neither trained, nor equipped to perform,” Andrews testified.

One such incident took place in West, Texas, in April 2013. A massive explosion at a fertilizer storage facility killed 11 firefighters from five departments. In July last year, a 72-car train of Bakken crude oil rolled away and derailed at high speed in the town of Lac-Megantic, Quebec. The inferno killed 47 people and leveled much of the business district.

“Volunteer fire fighters and emergency response personnel being thrust into catastrophic events without adequate training or resources is a widespread problem that needs to be addressed,” wrote the National Transportation Safety Board after a toxic chemical leak from a rail car in November 2012 in Paulsboro, N.J.

Tim Burn, a spokesman for the International Association of Fire Fighters, said that a broad-based training program was still the best approach.

“It is the duty of government to provide the resources needed for hazmat response,” he said, “and this public safety discussion should not be driven by profit motive.”

Goldwater said he and Andrews expected a return on their investment. However, he added, if anyone wanted to make lots of money, “this is not the thing to do.”

So far, the impulse of government and industry has been to simply fund more training for emergency personnel. But Andrews said that might not be the most effective approach. The firefighting profession experiences an attrition rate of about 20 percent a year. Call volumes have increased, putting more pressure on volunteer and career firefighters alike. It’s difficult for volunteers with full-time jobs to take off time for training, and most departments can’t afford to pay for it.

The Association of American Railroads, the industry’s leading advocacy organization, has offered to train 1,500 emergency responders at its rail testing facility in Pueblo, Colo. But with the random and rare nature of train derailments, the odds aren’t good that a limited number of trained personnel scattered across the country will be where they’re needed when something happens.

Andrews and Goldwater say their plans would be geographically tailored. Philadelphia is a major destination for crude oil, so its response needs may be different from places such as Albany, N.Y., or Sacramento, Calif., where oil trains pass through.
