New rules on oil trains draw flak from firefighters, too

— Lawmakers and environmental and industry groups criticized the federal government’s new safety measures for oil trains when they were announced earlier this month. Now another group has expressed disappointment in the new rules:

Emergency responders. They’re among the first in danger when a fiery derailment happens.

After another oil train derailed and caught fire last week, this time in North Dakota and the fifth in North America this year, firefighters renewed their call for more training and information about hazardous rail shipments.

The International Association of Fire Fighters’ primary objection to the new rules is about their information-sharing requirements. But Elizabeth Harman, an assistant to the general president of the group, also said firefighters needed more training on responding to hazardous materials incidents. The rule didn’t directly address that issue, though some lawmakers have sought additional funding.

“The training that’s needed has been developed,” she said. “This is the first step that needs to be funded and expanded for all first responders.”

Harman said her group had been talking to the Federal Emergency Management Agency about making more competitive grants available for first-responder training.

Tank cars still showing accident vulnerability

Tens of thousands of rail tank cars haul flammable liquids, such as crude oil and ethanol, across North America, and most have weak spots that make them vulnerable to puncture and fire in an accident. A new tank car design has been approved, but is not widely available yet. There have been five serious oil train derailments so far this year.

Since 2010, an exponentially larger volume of flammable liquids, especially crude oil and ethanol, has been moving by rail, and with it has come an increase in risk to communities.

“We need to be prepared for it, and we’re willing to be prepared for it,” Harman said.

The rail industry and the government have funded new training for emergency responders as a result of the increased risk. Railroads train 20,000 firefighters a year in communities across the country, according to the Association of American Railroads, an industry group.

Since last summer, the rail industry has paid to send hundreds more to an advanced firefighting academy in Pueblo, Colo., designed for responding to oil train fires.

While firefighter groups have praised the industry’s efforts, 65 percent of fire departments involved in responding to hazardous materials incidents still have no formal training in that area, according to a 2010 survey by the National Fire Protection Association.

While no first responders have been injured in multiple oil train derailments and fires in the past year and a half, they’ve faced numerous challenges:

– When an oil train derailed and caught fire near Casselton, N.D., on Dec. 30, 2013, a BNSF student engineer became an ad-hoc first responder. According to interview transcripts published last month by the National Transportation Safety Board, the student donned firefighting gear and equipment as he uncoupled cars that were still on the track to move them away from the fire.

– When an oil train derailed and caught fire in downtown Lynchburg, Va., on April 30, 2014, first responders didn’t know right away which railroad to call, since two companies operate tracks through the city. According to a presentation at a conference of transportation professionals in Washington in January, it also took 45 minutes for first responders to obtain documents showing them what the train was carrying.

– After an oil train derailed and caught fire near Galena, Ill., on March 5 this year, volunteer firefighters could reach the remote site only via a bike path. Once there, they attempted to extinguish the fire, but had to retreat when they realized they couldn’t, leaving their equipment behind. According to local news reports, their radios didn’t work, either.

Harman said the U.S. Department of Transportation’s new regulations for trains carrying crude oil, ethanol and other flammable liquids didn’t go far enough with respect to information that railroads provided to communities.

Under an emergency order the department issued last May, railroads were required to report large shipments of Bakken crude oil to state emergency-response commissions, which then disseminated that information to local fire departments.

But under the department’s new rules, starting next year, railroads will no longer report the information to the states, and fire departments that want the information will have to go directly to the railroads. It also will be shielded from public disclosure.

“These new rules fall short of requiring rail operators to provide the information fire departments need to respond effectively when the call arrives,” said Harold Schaitberger, general president of the firefighters group.

Susan Lagana, a spokeswoman for the Department of Transportation, said Friday that the department was reviewing feedback from emergency responders and lawmakers to address their concerns.

She said the new rule would expand the amount of information available to first responders and noted that for now, last year’s emergency order remains in place.

Ed Greenberg, a spokesman for the Association of American Railroads, said the industry was reviewing the new regulations. He said it had shared information with first responders for years and would continue to do so.

Greenberg said the industry was developing a mobile application called AskRail that would give emergency responders immediate access to information about a train’s cargo.

“Freight railroads have ongoing dialogue with first responders, residents and local civic officials on rail operations and emergency planning,” he said.

Emergency planners in Washington state sought more information about oil trains from BNSF, including routing information, worst-case derailment scenarios, response planning and insurance coverage. On April 30, the railroad met with state fire chiefs in Olympia.

“I think both sides learned a little bit about the other group’s point of view,” said Wayne Senter, the executive director of the Washington Fire Chiefs. “I was pretty positive by the end of the meeting the information we asked for in our letter was either available or will soon be available either directly or indirectly.”

[Editor: FEMA held a “worst case” urban bomb train scenario/drill in New Jersey in March, and plans another in Wisconsin in June.  Will they also hold a big city drill here on the west coast?  We don’t have nearly the oil train traffic that Midwesterners and East Coasters see every day … yet.  But there is significant traffic in the Pacific Northwest and increasing deliveries and plans for more here in California.  A FEMA exercise would be an eye-opener here.  – RS]

FEMA drill plans for deadly worst-case oil train scenario

Federal authorities painted a frightening picture of what could happen if an oil train exploded in a big city.

In a mock drill in Jersey City, N.J., on March 19, authorities laid out a scenario where five oil tankers from a 90-car train would derail on an elevated track, spilling 100,000 gallons of crude oil.

The pool of highly combustible oil quickly ignited, sending a 300-foot fireball skyward. Jersey City is across the Hudson River from Manhattan.

The blast could kill an estimated 287 people within 200 yards of the explosion, according to Federal Emergency Management Agency documents.

Using information tailored to a Jersey City neighborhood, FEMA estimated that buildings up to 340 yards away [0.2 miles] could be severely damaged.

All told, more than 32,000 people within 1,500 yards [0.9 miles] of the explosion could be injured.

The rail cars are an older design that the federal government is proposing to phase out. Tens of thousands of the tankers are in use today.

The location selected by FEMA — near a freeway and surrounded by residential and commercial buildings — would not seem out of place from rail corridors of Milwaukee used by trains pulling oil tankers.

FEMA put on the exercise as one of the federal government’s first efforts at disaster planning for an oil train disaster in an urban area.

In its next such drill, federal officials will conduct a mock derailment involving oil trains with state and local authorities June 9-10 in the La Crosse area.

Oil trains moving through La Crosse travel in two directions — south down the Mississippi River valley and east across Wisconsin through Milwaukee before heading to Chicago-area refineries and other locations.

Federal officials devise scenario involving a train explosion to prepare officials for the worst

Imagine a mile-long train transporting crude oil derailing on an elevated track in Jersey City, N.J., across the street from senior citizen housing and 2 miles from the mouth of the Holland Tunnel to Manhattan.

The oil ignites, creating an intense explosion and a 300-foot fireball. The blast kills 87 people right away, and sends 500 more to the hospital with serious injuries. More than a dozen buildings are destroyed. A plume of thick black smoke spreads north to New York’s Westchester County.

This fictional—but, experts say, plausible—scenario was developed by the Federal Emergency Management Agency in one of the first efforts by the U.S. government to map out what an oil-train accident might look like in an urban area. Agency officials unveiled it as part of an exercise last month to help local firefighters and emergency workers prepare for the kind of crude-by-rail accident that until now has occurred mostly in rural locations.

“Our job is to design scenarios that push us to the limit, and very often push us to the point of failure so that we can identify where we need to improve,” said FEMA spokesman Rafael Lemaitre. He said a second planning exercise is scheduled in June in a suburban area of Wisconsin.

Jersey City’s mayor, Steven Fulop, said the drill showed participants that they need to improve regional communication to cope with an oil-train accident.

“It would be a catastrophic situation for any urban area and Jersey City is one of the most densely populated areas in the entire country,” he said.

Railroad records show that about 20 oil trains a week pass through the county that contains Jersey City, and Mr. Fulop said the trains use the elevated track studied in the FEMA exercise. Even more trains hauling crude pass through other cities, including Chicago, Philadelphia and Minneapolis.

Rail shipments of oil have expanded to almost 374 million barrels last year from 20 million barrels in 2010, according to the U.S. Energy Information Administration. Although low crude prices and safety issues have recently led to small declines in such traffic, trains carrying volatile oil from North Dakota and the Rocky Mountains continue to rumble toward refiners on the East, West and Gulf Coasts.

Several oil-train derailments have produced huge fireballs, including two in March in rural Illinois and Ontario. In 2013, a train carrying North Dakota crude derailed late at night in Lac-Megantic, Quebec, killing 47 people.

Regulators worry more about a serious accident in a densely populated area. “The derailment scenario FEMA developed is a very real possibility and a very real concern,” said Susan Lagana, a spokeswoman for the U.S. Department of Transportation. She said her agency was considering emergency orders to address such risks.

Firefighters at the FEMA workshop in Jersey City discussed the difficulty of battling a crude-oil fire, which can be explosive and hard to extinguish. One problem: limited supplies of the special foam required to smother the flames.

Jordan Zaretsky, a fire battalion chief in nearby Teaneck, N.J., who attended the presentation, said the scale of such an accident was sobering. “This isn’t a structural fire that we can knock down in an hour or two,” he said. “This is something we’d be dealing with for days.”

Ideas discussed at the workshop included devising a system to allow local officials to know when an oil train was passing through, developing public-service messages to tell residents what to do in case of a derailment and providing more firefighters with specialized training.

There have been many calls for changes to how crude oil is handled on the railroads, including new speed limits for trains and requirements to treat the crude oil to make it less volatile.

Earlier this month, the chairman of the National Transportation Safety Board urged the rail industry and federal regulators to move more swiftly to replace existing tank cars with ones that would better resist rupturing and fire.

A spokesman for the American Petroleum Institute, a trade group for oil producers, said the companies are committed to “greater efforts to prevent derailments through track maintenance and repair, upgrades to the tank car fleet, and giving first responders the knowledge and tools they need.”

The Association of American Railroads recognizes that “more has to be done to further advance the safe movement of this product,” a spokesman said.

FEMA chose for the location of the derailment scenario a stretch of track adjacent to the New Jersey Turnpike and about a mile from downtown Jersey City. One side of the track is industrial and includes an electric substation. The other side is residential.

Edgardo Correa, a 59-year-old retired sanitation worker, lives in a house close to the tracks in Jersey City. He said he was aware that trains full of crude pass by his home. “It’s an alarming thing,” he said.

Day after derailment, cleanup and restoration begin

MOUNT CARBON — Cleanup crews began removing the hulks of derailed and burned-out railroad tank cars Tuesday evening, and residents began to get water and electricity back, after a train carrying crude oil derailed, caught fire and exploded in western Fayette County on Monday.

Emergency shelters, set up after hundreds of residents were evacuated from the area, were closed Tuesday evening after CSX, the company whose train derailed, provided hotel rooms for them.

The CSX train, hauling 107 tank car loads of Bakken Shale crude oil from North Dakota to a transportation terminal in Yorktown, Virginia, derailed in Adena Village near Mount Carbon and Deepwater about 1:30 p.m. Monday, setting one house ablaze and causing numerous tank cars to burn and explode. The train also included two cars of sand, which were used as buffers at either end of the train, CSX officials said.

At a briefing Tuesday afternoon, Gov. Earl Ray Tomblin said officials expected hundreds of residents without electricity to have service restored sometime Tuesday evening.

State officials said fewer than 800 people were affected by outages related to lines damaged by the initial fire. They also said they believed between 100 and 125 residents were evacuated or displaced, while the Federal Emergency Management Agency put that number at 2,400 in its daily report.

Local officials said about 100 people took refuge at emergency shelters Monday night at Valley High School in Smithers and the Armstrong Volunteer Fire Department.

Most people who had been staying at the shelters moved out once CSX offered hotel rooms, and others decided to stay with friends or relatives following the fire.

Billy Dunfee was the last to leave the shelter at Valley High School, having spent the night Monday. “They set us up on cots in the back gyms,” he said.

But the school didn’t have water Monday night, so Dunfee decided Tuesday morning to either stay with relatives or take CSX up on it’s offer for a hotel room. Dunfee wasn’t sure how long it would be before he would be allowed to return to his home.

Smithers police and volunteer firefighters from the area set up a makeshift water distribution center at Valley High School late Monday, and handed out water throughout the day Tuesday.

Smithers Police Chief Gerald Procter said the owner of J&J Trucking in nearby Canvas had a tractor-trailer filled with pallets of water, and took it upon himself to bring the truck to Smithers.

Volunteers had passed out water to about 60 cars by noon, with some drivers picking up water for friends and family members.

“I already came out and picked up water for six households before,” said Cannelton resident Jay Pauley. “I’m getting water for five more. There’s about 20 houses in the section where I live.”

CSX spokesman Gary Sease said the railroad was working with the Red Cross and other relief organizations to help those who had to leave their homes because of the train derailment.

The Federal Railroad Administration’s acting administrator, former Charleston resident Sarah Feinberg, and chief safety officer, Robert Lauby, were among several investigators from the FRA and the federal Pipeline Hazardous Materials Safety Administration who were on the scene Tuesday.

“Once the site is secured, officials will begin the investigation into the cause of the derailment,” U.S. Department of Transportation spokeswoman Suzanne Emmerling said Tuesday morning.

Officials at the West Virginia American Water treatment plant in Montgomery, downriver on the Kanawha-Fayette county line, were told to shut down their water intake as a precaution. The intakes were reopened Tuesday afternoon, after three rounds of testing by the company, with the help of the West Virginia National Guard, showed “non-detectable levels” of the components of crude oil in the Kanawha River.

The approximately 2,000 customers of West Virginia American Water’s Montgomery system — including people in Montgomery, Smithers, Cannelton, London, Handley and Hughes Creek — were told to boil their water before using it. Bottled water stations were being set up at the Montgomery Town Hall and at Valley High School.

Kelley Gillenwater, spokeswoman for the state Department of Environmental Protection, said that the fires were keeping DEP officials from being able to fully examine the site of the derailment to determine what sort of containment and cleanup is going to be needed.

Full details of water sampling being done by the state were not immediately available, but Gillenwater said that so far the results had come back “non-detect.” She said that despite initial reports, none of the train cars that derailed actually ended up in the Kanawha River.

Tomblin declared a state of emergency in Fayette and Kanawha counties after the derailment. “It appears things are starting to come back to normal,” the governor said at Tuesday’s news conference.

Randy Cheetham, a regional vice-president with CSX, said at the same press conference that the section of track where the derailment occurred had last been inspected on Friday. He said CSX and transportation officials have not yet determined the cause of the wreck.

Cheetham said the derailment started with the third car behind two locomotives pulling the train, and continued to the 28th car. Work crews were able to pull most of the cars away from the site of the fire.

An engineer and conductor on the train were not hurt, Cheetham said. He said the tank cars set fire to one home at the site, and the homeowner was treated for smoke inhalation — the only injury reported related to the derailment.

The West Virginia University Institute of Technology in Montgomery canceled classes for the rest of the week. In a statement, WVU Tech officials said water service on campus isn’t expected to be restored for another two or three days, and the school’s residence halls would close at 5 p.m. Tuesday. WVU Tech students will be temporarily housed at the University of Charleston’s residence halls at the former Mountain State University in Beckley, and at the Marriott Courtyard hotel in Beckley if necessary.

In April 2014, a train carrying crude oil on the same North Dakota-Virginia route derailed in Lynchburg, Virginia — one of several incidents involving oil-carrying rail cars in recent months that have brought increased scrutiny to the transport of oil via rail.

In October, officials with the state Department of Homeland Security blacked out details about the frequency of CSX oil train shipments, the amounts of oil transported and the routes the trains took through West Virginia from a Charleston Gazette Freedom of Information Act request for data on Bakken crude oil shipments through the state, citing security concerns and saying some of the information was proprietary to CSX.

Asked Tuesday whether the state would reconsider that stance in light of Monday’s derailment, Tomblin said there were probably still security concerns over releasing the information. However, he said state officials would take another look at the question.

Amtrak’s thrice-weekly Cardinal service, which runs through Fayette County on its way between Chicago and New York City, listed today’s run as canceled on the Amtrak website. Friday’s run is listed as “sold out,” which the service often does to block ticket sales on annulled runs. Tickets are being sold online for Sunday’s run.
