Pacific Northwest ports wary of crude by rail – Association to issue position paper

Portland port passes on oil-by-rail terminal

While Vancouver pursues project, other Northwest ports aren’t so sure

It doesn’t matter if the shipments are toxic or nontoxic. Ports move cargoes, the story goes. They don’t pronounce moral judgments about them.

However, at least one line of business is no longer necessarily a lock, at least in the Northwest: the transportation of crude oil by rail.

Public concerns about everything from explosive oil-train derailments and crude spills to greenhouse gas emissions and the future of life on the planet are part of the reason why.

In at least two cases in Oregon and Washington, ports decided safety and environmental concerns loomed large enough for them to step back from oil transport. The Port of Portland, for example, eyed as much as $6 million in new annual revenue when it mulled siting an oil-train export terminal, documents obtained by The Columbian show. Ultimately, Oregon’s largest port scrapped the idea because of rail safety and other worries. At one point, it also reckoned that “the public does not readily differentiate between our direct contribution to climate change and actions we enable.”

In Washington, the Port of Olympia adopted a resolution raising multiple safety, environmental and economic concerns. It noted the July 6, 2013, fiery oil-train accident in Lac Megantic, Quebec, which killed 47 people. And the resolution called on the Port of Grays Harbor to rethink opening its doors to three proposed oil-by-rail transfer terminals.

To be sure, there doesn’t appear to be a groundswell of Northwest ports swearing off oil or other energy projects. Yet public concerns aren’t lost on the port industry. Eric Johnson, executive director of the Washington Public Ports Association, said he worries that putting certain commodities such as coal under “cradle-to-grave” environmental analyses sets a bad precedent that could gum up the quest for other port cargoes.

Nevertheless, he said, “we’re concerned about oil-by-rail transportation.” So much so, the association, which represents some 64 ports in Washington, will soon issue a position paper, Johnson said. It will include calls on the federal government to boost the safety of tank cars, and to upgrade oil-spill prevention and response measures. Last week, the National Transportation Safety Board said that assuring the safety of oil shipments by rail would be one of its top priorities for the year.

In Vancouver, meanwhile, critics pressure port commissioners to cancel a lease to build what would be the nation’s largest oil-by-rail transfer operation. Under the contract, Tesoro Corp., a petroleum refiner, and Savage Companies, a transportation company, want to build a terminal capable of receiving an average of 360,000 barrels of crude per day.

In addition to the political pressure, legal challenges dog the project, too. One lawsuit goes to the heart of how ports relate to their constituencies: It accuses Vancouver port commissioners of using multiple closed-door meetings to illegally exclude people from their discussions of the lease proposal.

The port denies the allegations. It has repeatedly said public safety remains its top concern. And it has said the oil terminal won’t get built unless the companies’ proposal wins state-level safety and environmental approvals.

Yet opponents see increased public attention to the safety and environmental impacts of proposed oil and coal terminals as reason to believe ports can no longer easily don the robes of an agnostic. “People are paying attention,” said Brett VandenHeuvel, executive director of Columbia Riverkeeper, one of three environmental groups pressing legal complaints against the Port of Vancouver. “It’s no longer simply the bottom line and the most revenue.”

In the Northwest, the Port of Portland’s decision to temporarily back off oil transport sharply contrasts with the Port of Vancouver’s choice to pursue it. Oil terminal critics use Portland’s decision to hammer the Port of Vancouver.

“I don’t see how an oil terminal is unsafe on the Oregon side of the Columbia (River) and safe on the Washington side,” VandenHeuvel said. “The striking thing is how close in proximity the ports of Portland and Vancouver are and the different approach they’ve taken on oil.”

In an email to The Columbian, Abbi Russell, a spokeswoman for the Port of Vancouver, said the port moves “forward on projects we think have merit and will bring benefit to the port and our community.” She also said the port understands that “every port needs to make decisions that make sense for them.”

‘Protests may occur’

Initially, an oil-train operation made sense to the Port of Portland, too.

It considered three sites: Terminals 4, 5 and 6. It analyzed the production of crude from the Bakken shale formation in the Midwest and from oil sands in Canada. It assessed business risks, including Kinder Morgan’s plan to repurpose an existing natural gas pipeline to connect West Texas crude to Southern California. And it contemplated the “primary specific concern among governments and community groups” over the potential for “oil spills, whether from unit trains, pipelines from the unit trains to the storage tanks to the dock, and barges.”

In May 2013 — about a month after Tesoro and Savage announced their oil terminal proposal in Vancouver — the Port of Portland signed a nondisclosure agreement with an unspecified company (the port redacted its identity in documents) to explore locating an oil export facility near Terminal 6.

Just shy of a year later, however, the port backed away.

In March 2014, it publicly announced that while it was “interested in being part of an American energy renaissance brought on by this remarkable domestic oil transformation” it did not “believe that we have sufficient answers to the important questions regarding environmental and physical safety to proceed with any type of development at this time.”

In an email to The Columbian, Kama Simonds, a spokeswoman for the Port of Portland, said “rail car safety was the primary issue” that led the port to temporarily halt its pursuit of an oil-train terminal.

But the port also worried about damaging “our hard-won positive environmental reputation,” documents show, and noted “other relationships will be affected,” including “other governments, neighborhood associations and civic groups …”

“National environmental groups will be involved — Sierra Club, Bill McKibben’s 350.org, Greenpeace,” it also noted. “Protests may occur.”

And the Port of Portland was aware of the controversy that engulfed its neighbor, remarking that “as seen with the Tesoro project at the Port of Vancouver and other energy-related projects at several other ports on the river system and along the coastline, these kinds of announcements can quickly create opposition, controversy and protests.”

Unlike the Port of Vancouver, whose three commissioners are elected by Clark County voters, the Port of Portland’s nine commissioners are appointed by Oregon’s governor and ratified by the state Senate.

The Port of Portland’s Simonds said Gov. John Kitzhaber wasn’t kept informed of the port’s initial pursuit of an oil-by-rail facility and that “we are not aware of any formal statement issued to the port from the governor’s office.”

Nowadays, she said, the port pursues “other energy-related projects” and focuses on Canadian company Pembina Pipeline’s plan to build a propane export facility near Terminal 6. Propane would be brought to the facility by train and eventually shipped overseas. The propane terminal would use the same property that the Port of Portland had considered for an oil-by-rail transfer operation. That project is also expected to face opposition from environmental groups.

Josh Thomas, a spokesman for the Port of Portland, said the port is “extremely discerning” when thinking about energy-sector opportunities. After rejecting coal and temporarily halting oil, he said, the port is now working with Pembina. “Propane has an excellent track record as a clean and safe alternative fuel,” Thomas said, “with a good climate story, displacing many dirtier traditional fuels.”

‘We are not alone’

If the Port of Portland only temporarily dropped the idea of an oil-train venture, the Port of Olympia in Washington went further.

In August 2014, the Olympia port commission voted 2-1 to approve a resolution expressing “deep concern” about the threat to “life, safety, the environment and economic development” of hauling Bakken crude by train “through our county.”

The resolution urged the Port of Grays Harbor — some 50 miles west of the Port of Olympia — to reconsider allowing three proposed oil-transfer terminals. It also called on the city of Hoquiam to reject construction permits for the projects.

The Olympia port’s resolution didn’t sit well with the executive committee of the Washington Public Ports Association. The committee shot a letter — signed by five port commissioners, including Port of Vancouver Commissioner Jerry Oliver — to Port of Olympia Commissioner George Barner. The letter chastised the resolution as meddling in another port’s lawful business. “We can only presume that if another port were to do this to the Port of Olympia that you would be rightly, and deeply, offended,” according to the letter, signed by Oliver, Port of Seattle Commissioner Tom Albro, Port of Benton Commissioner Roy Keck, Port of Everett Commissioner Troy McClelland and Port of Chelan County Commissioner JC Baldwin.

Barner and his colleague, Port of Olympia Commissioner Sue Gunn, who cast the other “yes” vote for the resolution, returned fire with a letter of their own. “As public officials, we have a responsibility to protect our citizenry and our natural resources,” they wrote in their letter addressed to Albro. “We are not alone in our concern over the passage of crude oil by rail through our community, as no less than sixteen other jurisdictions have passed similar resolutions, including the cities of Anacortes, Aberdeen, Auburn, Bellingham, Chehalis, Edmonds, Hoquiam, Kent, Mukilteo, Seattle, Spokane, Vancouver, and Westport; King and Whatcom Counties, and the Columbia River Gorge Commission.”

The jousting letters illustrate that not all ports think alike when it comes to how they do business.

Although the Port of Portland didn’t join the Port of Vancouver in seeking a share of the vast quantity of crude coming onto the nation’s rails, there appears to be no acrimony between them.

Shortly before the Port of Portland said last March that it wasn’t going after an oil-by-rail project, it gave the Port of Vancouver a heads-up about it.

“We wanted to make sure you had visibility to it prior to its release as the port is effectively making and taking a public position on crude-by-rail,” Sam Ruda, chief commercial officer for the Port of Portland, wrote in an email to Port of Vancouver CEO Todd Coleman and Chief Marketing/Sales Officer Alastair Smith.

Ruda offered to discuss the matter with them.

“I am doing this on behalf of Bill Wyatt (the Port of Portland’s executive director) who is traveling in Vietnam,” Ruda wrote in his Feb. 28, 2014 email. “At the same time, I have been very involved in this matter and am prepared to offer you perspectives and context as to why we are doing this at this time.”

Russell, the spokeswoman for the Port of Vancouver, said Coleman and Smith thanked Ruda for the heads-up when they later spoke with him. “These types of courtesy communications are common,” she said. “There was no additional discussion related to the statement.”

Ecology report details plans to make oil trains safer

A new, 500-page state report says railroad oil shipments through Washington may increase sevenfold in the next six years and recommends 40 measures to improve safety and protect the environment.

The state Department of Ecology report, released Monday, recommends additional spending for emergency planning, training and equipment, rail inspections and ongoing risk assessments.

The study does not outline the costs of measures it is suggesting to the railroad industry and the Legislature. Lawmakers already are grappling with budget shortfalls to fund court-ordered and voter-approved mandates for improving public schools.

“There’s a lot of people concerned about oil trains, including myself. But I think whatever we do it has to be reasonable and not go so far as to be unrealistic for the industry,” state Rep. Dean Takko, D-Longview, said Monday.

The Legislature requested the study based on recent changes in how crude oil moves through rail corridors and Washington waters.

Ecology’s report says 19 crude oil unit trains — each measuring 100 cars — now move through Washington each week. That number could grow to 137 trains per week by 2020 if the full build-out of proposed oil terminals is permitted, Ecology said.

The oil is coming from the North Dakota’s Bakken area. Many of the trains run through the Burlington Northern Santa Fe main lines that run through Cowlitz County.

“I don’t have a problem with oil trains if the safety stuff that needs to be done is done,” Takko said.

But increased safety measures aren’t the only issues the state is considering. The Washington Military Department’s Emergency Management Division, which helped research and compile Ecology’s report, also looked at how emergency crews would respond to an oil spill or train derailment.

“In our survey of first responders, we heard from a large percentage of districts that believe they need additional training or resources to effectively respond to a train derailment and fire,” EMD spokeswoman Karen Ferreira said.

Ecology included recommendations for more track, upgrades to equipment and crossing signals, furnishing oil spill response equipment, and developing hazardous materials response teams.

Opponents to crude oil shipments through the Pacific Northwest aren’t looking to the state for answers.

“There’s really not a lot the state can do. This is a federal issue,” Longview activist John Green said.

Burlington Northern spokesman Gus Melonas had not seen the report, but he said the railroad “is committed to safely move all types of commodities through Longview. We have thorough processes for inspection, detection … and will continue to invest to protect the railroad, public and environment complying with Federal standards. BNSF will continue to work closely with Washington state on future safety discussions.”

The final report will be delivered to the Legislature on March 1.

(Reuters) – Shipments of Bakken crude oil from North Dakota to California by barge have quietly overtaken those by train for the first time, showing how the state’s isolated refiners are using any means necessary to tap into the nation’s shale oil boom.

While tough permitting rules and growing resistance by environmentalists have slowed efforts to build new rail terminals within California itself, a little-known barge port in Oregon has been steadily ramping up shipments to the state, a flow expected to accelerate next year.

From January through June, California received 940,500 barrels of the North Dakota crude oil from barges loaded at terminals in the Pacific Northwest, the highest rate ever, Gordon Schrempf, senior fuels analyst for the California Energy Commission, told Reuters.

Bakken crude transported to California on railcars, which has gained widespread attention after a series of fiery train derailments in North America, accounted for just 702,135 barrels over the same time period, according to published figures.

“We’re seeing marine transport of Bakken crude outpace rail for the first time,” Schrempf said. In 2013, rail shipments of 1.35 million barrels exceeded barge shipments of 1.33 million barrels. The year before, almost no crude arrived by barge.

Bakken shipments by barge and rail may only comprise a tiny portion of the crude California imports, at about 5,200 and 4,000 barrels per day respectively, with Alaska supplying over 20 times as much crude.

But companies, including refiner Tesoro Corp and logistics company NuStar Energy LP, have plans to significantly expand that volume with new terminals along the Pacific Northwest that would unload trains from North Dakota and pump the oil onto tankers.

They would help make California a major destination for Bakken oil, a trend that has drawn objections from environmental groups who have been seeking to stem the tide, often by blocking local permits to built oil-train offloading terminals.

“Bringing it in by barge gets you around cumbersome permitting and the growing citizen opposition to crude-by-rail,” said Lorne Stockman, research director of Oil Change International, a research and advocacy organization working on energy, climate and environmental issues.

To be sure, their objections may differ. The principle concern over transporting Bakken by rail is the risk that a derailment could cause a deadly explosion similar to the one in Lac Megantic, Quebec, last year that killed 47 people.

There is no suggestion that waterborne oil transportation poses similar explosive risks, although the environmental impact of a barge spill could be much greater.

“The barges are designed to carry the grade of oil that the Bakken is,” said Ted Mar, prevention branch chief for the state’s Office of Spill Prevention and Response and a former member of the Coast Guard.

That is small comfort to environmentalists, who oppose all forms of oil production, in particular shale crudes like Bakken, extracted through hydraulic fracking they fear contributes to global warming and poses a potential risk to water supplies.

“Our end goal is to leave these more dangerous, unconventional fuels in the ground,” said Jess Dervin-Ackerman, conservation manager for the San Francisco Bay Chapter of the Sierra Club.

SMALLER BUT CLOSER

With state production declining since the mid-80s, California’s refiners have increasingly relied on deliveries of crude by oceangoing tankers carrying 500,000 barrels or more from places like Alaska, Saudi Arabia, Ecuador and Iraq, which supplied two-thirds of their needs last year.

The refiners have been scrambling for several years to get better access to cheaper domestic shale oil by any means necessary, replacing costlier imports. But with the big shale fields to the east of the Rocky Mountains and a lack of major pipelines, it has not been easy.

The articulated tug barges (ATBs) now arriving are tiny by comparison to the tankers, carrying as little as 50,000 barrels.

Such shipments cost more than bringing Bakken directly to California by rail, but easily plug into existing port and terminal infrastructure – avoiding the need for new permitting that can take years.

While many are working to build out their own rail facilities, a handful of major rail-to-barge terminals along the Pacific Northwest coast that would ship over 500,000 bpd of Bakken crude have been in the works for several years. But most are incomplete, and several face delays.

One of the few exceptions is an idled ethanol terminal and processing plant in Clatskanie, Oregon, run by Global Partners LP. The facility, on a small canal that feeds into the Columbia River, began quietly transshipping oil from trains to barges in 2012 and is now receiving so-called “unit trains”, mile-long trains that only carry crude oil.

“Unit train volume into our Clatskanie terminal is up, and interest in the facility from prospective customers is at an all-time high,” Global Partners Chief Executive Eric Slifka said in August.

Global Partners did not respond to a request for comment.

Later that month, the firm received a new air permit from the Oregon Department of Environmental Quality that will allow it to ship as much as 1.84 billion gallons of volatile liquids, or some 120,000 bpd. It did not specify crude or ethanol.

Much of those shipments moved north to refineries in Washington, including BP’s Cherry Point in Puget Sound, and Phillips 66’s Ferndale facility. But both those plants are expanding their own facilities to bring more Bakken in by rail, likely curbing some demand for barges.

Top oil barge operator Kirby Corp, which runs vessels out of Clatskanie, is currently building two larger 185,000-barrel barges to deploy on the coast next autumn.

Environmentalists say they are monitoring the rise in Bakken-by-barge deliveries.

“This won’t pull our focus away from crude by rail, but rather expand the lens with which we look at dangers of Bakken entering our communities,” said the Sierra Club’s Dervin-Ackerman.

Pierce County gets all risks, no rewards for surging oil train traffic

As this editorial page has noted, Washington has seen a stunning increase in the amount of Bakken crude oil transported on our railroads, to an estimated 2.87 billion gallons each year. Much of that highly flammable oil rolls across the central Puget Sound region, through downtown Tacoma and past Steilacoom in aging tank cars.

The surge in train traffic has created an unprecedented risk to our people, our economy, our traffic and our environment. Our communities assume all of the risks while big oil companies get all of the rewards.

There’s the immediate risk to public safety when flammable fuel passes through heavily populated areas like Tacoma and Seattle and past our neighborhoods, schools and parks. Since July 2013, there have been nine serious train derailments across North America – more than we experienced during the past four decades combined. An oil-train explosion last year in Quebec, Canada, killed 47 people and wiped out half a downtown area.

There’s also the increased risk of oil spills contaminating Puget Sound and undermining the progress we’ve made in waterfront development and cleaning up the Foss Waterway. It’s a scenario we saw earlier this year when an oil train spilled more than 20,000 gallons of crude oil into the James River just outside Lynchburg, Virginia.

We work hard to ensure that our first responders have the equipment and training they need to respond to oil-train derailments, spills and fires. But we need state and federal action to prevent these potentially life-threatening tragedies from occurring in the first place.

That is why we brought together more than 100 other elected leaders from across the Northwest and British Columbia to form the Safe Energy Leadership Alliance. It’s a broad coalition of local leaders from urban and rural areas who share a mission to better understand the potential safety and economic impacts from oil and coal trains, and call for stronger safety standards.

Having multiple mile-long trains – each carrying 3 million gallons of crude oil – roll through Pierce and King counties snarls our traffic and makes it more difficult for our emergency personnel to respond to calls. The proposed increase in oil traffic would also harm our local businesses, manufacturers and farmers who rely on our limited rail capacity to transport their goods to overseas markets.

Displacing Washington state agriculture and manufactured products that create jobs to make way for crude oil would benefit only oil companies.

Perhaps what’s most concerning is that there is the potential for all of these risks and impacts to substantially increase over the next six years if proposed facilities are built along the Pacific coast.

The Department of Ecology estimates that the amount of crude oil that comes through our state could triple – to nearly 9 billion gallons each year – by 2020. The number of fully loaded oil trains that cross our state each week could go from 19 to more than 100 within the next few years.

That’s why we applaud Gov. Jay Inslee for fast-tracking the state’s Marine and Rail Oil Transportation study and the Department of Ecology for hosting a public meeting Thursday in Olympia (see box). This study shines a light on the risks and costs to our communities, and makes recommendations to strengthen disclosure of hazards and emergency preparedness.

We urge our state lawmakers to act swiftly on these recommendations, and enact provisions that maintain public safety. The costs to protect our communities and prevent delays in rail crossings should fall to the oil industry and not local governments.

Our long-term goal is to establish the Northwest as a global exporter of clean energy. In the meantime, we will work together to ensure that oil and coal companies don’t take up our limited rail space, put our communities at risk and harm our local economy.
