A recent spate of train derailments is not a sign that the industry’s safety record is deteriorating, but is rather “the bad luck of the stats,” analysts say.

A Canadian National Railway Co. train derailed near Brandon, Man., on Wednesday night, joining two other high-profile incidents involving CN trains in less than a month.

CN spokesman Brent Kossey said the cars were carrying refinery cracking stock, a non-regulated commodity that’s used in the petroleum refining process. One of the 13 cars that derailed sprung a leak, but there was no fire.

This is in contrast to two CN derailments near the community of Gogama, Ont., in the past month, both of which were carrying crude oil and caught fire. There have also been two fiery oil-train derailments in the U.S. since mid-February — one a BNSF Railway Co. train in northern Illinois and the other a CSX Corp. train in West Virginia.

It sounds like an alarming trend but analysts say it’s simply the inevitable result of the growing volumes of crude transported by rail, as well as increased scrutiny of the industry following the Lac-Mégantic, Que., disaster in 2013.

“Last year was the safest year on record,” Tony Hatch, principal at railway consulting firm ABH Consulting, said in an interview. “I think what you’re seeing is intense scrutiny and the bad luck of the stats.”

According to the National Energy Board, the volume of Canadian crude-by-rail exports has increased by 1,000% in less than three years, from 1.45 million barrels in the first quarter of 2012 to 15.95 million in the fourth quarter of 2014.

“If you ship 10 times as much crude oil, you’ll get 10 times more derailments,” Allan Zarembski, director of the railroad engineering and safety program at the University of Delaware, said in an interview.

He added that an oil-train is no more likely to derail than any other type of train.

“The oil trains aren’t heavier than a coal train or an iron-ore train or even a grain train,” he said.

“They’re all loaded to the same range, they don’t travel any faster — in fact, they travel somewhat slower than the heavy intermodal trains. There’s no particular reason why you should have more derailments associated with an oil train.”

The industry’s safety record has been steadily improving over the last several years thanks to new technology, said Russell Quimby, a former rail safety engineer with the U.S. National Transportation Safety Board and president of Quimby Consulting.

“In the last 20 years, the amount of detection and inspection technology introduced and implemented is tremendous,” Mr. Quimby said. “The accident statistics reflect that.”

According to the Transportation Safety Board, a total of 83 main-track derailments were reported in 2013, down 6% from the five-year average.

Transport Canada is also working to reduce the risk of fires and spills. The agency proposed Wednesday a new standard for the tank cars used to ship crude that will include thicker steel, insulation to protect the contents from fire and a shield to guard against punctures, among other things. If the measures are approved, older tank cars will be phased out by 2025.

“While we have already banned the least crash-resistant tank cars from the system and came out last year with tougher new regulations, we will continue to do more,” Transport Minister Lisa Raitt said in a statement. The minister has also called on CN to testify before the Transport Committee about the recent derailments.

But as long as crude is being shipped by rail, there will always be a risk of fiery derailments, Mr. Quimby said.

“You want to have zero accidents,” Mr. Quimby said. “It’s like flying. Statistically, flying is safer than driving but it’s not safer if you happen to be in the airplane that goes down.”

Sacramento area Congress members call on feds to upgrade oil train safety now

Several Northern California representatives in Congress have sent a letter to the Obama Administration expressing displeasure that federal officials missed a self-imposed deadline to propose stronger safety regulations on trains shipping crude oil.

The Sacramento area is among many in the country that is seeing growing numbers of trains carrying volatile Bakken crude oil. Elsewhere in North America, several trains have crashed and exploded, including one carrying highly volatile Bakken crude in West Virginia several weeks ago that spilled oil into a river and set a forested area on fire.

Pressure is growing on federal officials to impose safety regulations. The federal government last year announced a series of potential rule changes, including requiring stronger tank cars, and set a January 2015 date for a likely ruling.

“Clearly action needs to be taken to increase the safety standards for rail cars transporting Bakken crude oil, and it must be taken now,” Rep. Doris Matsui, D-Sacramento, said in a press statement about the letter. “Our communities simply cannot afford any delay in implementation of stringent safety guidelines.”

The group, which includes Matsui, John Garamendi, D-Walnut Grove, and Mike Thompson, D-St. Helena, sent its letter Friday to the Pipeline and Hazardous Materials Safety Administration and Federal Railroad Administration, asking them to take action to make rail shipments safer.

“We understand that more than 3,000 comments to the rule were analyzed and we commend the DOT for its work with industry thus far on information sharing, slower speeds, and reinforced railcars, but the multi-pronged solutions for this important safety issue must be implemented as quickly as possible,” the group wrote in the letter.

“We also believe that DOT should issue a rulemaking that requires stripping out the most volatile elements from Bakken crude before it is loaded onto rail cars. This operation may be able to lower the vapor pressure of crude oil, making it less volatile and therefore safer to transport by pipeline or rail tank car. Additionally, we believe that track maintenance and improvements must be a priority.

“We need safer rail lines that are built for the 21st century including more advanced technology in maintaining railroad tracks and trains, so that faulty axles and tracks do not lead to further derailments. If more dangerous and volatile crude is to be transported through cities and towns and along sensitive waterways and wildlife habitat, the rail and shipping industries must do more.”

The letter from local leaders came a day after Pennsylvania Gov. Tom Wolf sent a similar, high-profile plea to the president.

“The pace of federal rulemaking on rail safety is too slow,” Wolf wrote in a letter to Obama. “We urge that new federal safety rules be developed and implemented with a sense of urgency appropriate to the risk presented.”

Federal transportation officials said they are taking the final steps now in the process, but that the issue is complex.

“I’ve made the tank car rule a top priority for this department because the American people must have confidence that when hazardous materials are transported through their communities, we’ve done everything in our power to make that train as safe as possible, “ Transportation Secretary Anthony Foxx said.

“This is a highly complex issue, consuming massive staff time, scientific study, dialogue with stakeholders and experts, and coordination across borders,” Foxx said. “The department has and will continue to put a premium on getting this critical rule done as quickly as possible, but we’ve always committed ourselves to getting it done right.”

7 things you need to know about oil-by-rail safety

Last week’s oil train derailment in West Virginia launched a national conversation about the safety of shipping oil by rail. It’s a topic we’ve been hearing about over the past couple years, especially here in Minnesota, where Bakken oil crisscrosses the state’s rail lines in large volume.

It’s a complex topic combining federal policy with scientific questions. The Wall Street Journal’s Russell Gold has been following the issue closely and spoke to MPR News’ Tom Weber to explain what you need to know.

Here are 7 things you should know about oil transport by rail:

1. The most misunderstood part of crude oil transport by train: It’s very explosive.

“The kind of oil that’s being taken out of the ground in North Dakota and put into these tanker cars is a much lighter oil,” Gold said. “It is a very gassy oil; it has a lot of ethanes, and butanes and propanes dissolved in it. It really does explode and that’s really what’s causing the problems.”

When a set of tanker cars goes up in flames, it can cause 20-story-tall fireballs.

2. The amount of crude oil carried by train has increased exponentially in less than a decade.

According to the American Association of Railroads, there were 9,500 rail cars carrying crude in 2008. Last year is was 400,000.

We’ve been moving small amounts of crude by rail for years, but it was one or two cars in long train, Gold said. Now we see 100 to 120 tanker cars all filled with crude oil. That’s 70,000 barrels of crude per train, he said.

3. Once the crude oil is extracted in North Dakota, it has to be transported to the country’s major refineries on the coasts.

Refineries are built to utilize the gases removed from the product. If it was stabilized near the extraction site, North Dakota would have to find a way to use or dispose of the ethane and propane gases that make the oil explosive.

4. Railroads have become “virtual pipelines” for oil.

While these virtual pipelines can be created in months, traditional pipelines have become increasingly difficult to install as environmental groups seek to block permits for new energy infrastructure.

“What we are seeing on rail is largely due to opposition to and uncertainty around building pipelines,” said Brigham McCown, who was the chief pipeline regulator under President George W. Bush . Pipelines, he adds, are far safer than trains.

5. Pipeline leaks and spills are environmental problems. Oil train derailments are public safety issues.

When you have a tank car that derails and starts losing it’s very gassy oil, it’s going to burst into fire rather than leak into waterways, Gold said.

6. If you live close to these rail lines, get in touch with local first responders.

Gold recommends checking with emergency responders nearby and ask if they are properly trained to handle a crude oil train derailment. Make sure your fire chief is in contact with the rail companies to know when major shipments come through your area. Push for decreasing train speed limits and increased track inspection.

Canada’s TSB Concerned Railway Safety ‘Remains Inadequate’

Transportation Safety Agency Concerned Over Ottawa’s Oversight of Railway Companies

Canada’s transportation safety agency said Wednesday it is concerned that Ottawa’s oversight of railway companies remains inadequate, while noting that measures now in place would significantly reduce the risk of runaway trains.

Last year, the agency recommended several measures to strengthen rail safety after a 2013 oil-train derailment in Quebec killed 47 people and devastated the small town of Lac-Mégantic.

“While recognizing significant positive action taken by the regulator, the Transportation Safety Board of Canada remains concerned about Transport Canada’s response to outstanding recommendations,” the agency said Wednesday.

Transport Canada is the Canadian federal ministry responsible for rail transportation.

The TSB said it is specifically concerned the ministry hasn’t yet put in place an effective oversight process “that guarantees all railways will be audited in sufficient breadth and frequency to ensure safety issues are addressed in a timely manner.”

Canadian Transportation Minister Lisa Raitt said the ministry has taken action to boost oversight. “As part of our response to the Transportation Safety Board, Transport Canada will be conducting full (safety management systems) audits of federally regulated railway companies on a three-to-five-year cycle,” Ms. Raitt’s spokeswoman said in an emailed statement.

In August, the TSB cited 18 factors for the Lac-Mégantic disaster, including a weak safety culture at the train’s operator—Montreal, Maine & Atlantic Railway Ltd.—and lax regulatory oversight. The derailment sharply raised concerns about the growing transportation of crude by rail and was followed by a number of other fiery but non-deadly accidents.

Among the TSB’s recommendations was that Transport Canada audit the safety management systems of all railways on a regular basis to confirm that safety measures are in place, and more measures to secure trains.

Transport Canada hasn’t yet shown that an effective oversight regime has been implemented, which could lead to a lag in identifying safety issues, the TSB said Wednesday.

As for preventing runaway trains, the agency said it is satisfied that Transport Canada has introduced “multiple layers” of defenses that, if fully implemented, will significantly reduce risks.

“The Minister of Transport and the department have taken strong action to improve rail safety in the wake of the Lac-Mégantic tragedy, but more work needs to be done,” the safety agency said.

Last year, the TSB found that the 72-car train derailed after being left unattended and improperly secured on a descending grade despite indications there were mechanical problems with the lead locomotive. The agency said then that the now-defunct railway didn’t properly train and oversee its crews and lacked fully functioning safety-management processes.

“As we have always said, and as the Transportation Safety Board report clearly indicates, this was a case where rules were not followed,” Ms. Raitt’s spokeswoman said Wednesday.
