First responders likely wouldn’t fight oil-train fire in Seattle rail tunnel

An oil train fire would be so volatile that first responders could not safely enter Seattle’s aged, mile-long downtown train tunnel, Mayor Ed Murray and Seattle Fire Chief Harold Scoggins told a Tuesday briefing.
“In all likelihood we would not send our first responders in,” Murray said.
Scoggins, taking particular note of the need for ventilation improvements, said: ”It would be really challenging for a firefighter or anyone to go into that tunnel.”
Any fire would need to be fought from outside given ventilation and heat in the century-old structure.
About a dozen oil trains a week pass along the Seattle, Edmonds, Everett, Marysville and Bellingham waterfronts, carrying Bakken crude oil from North Dakota to four northern Puget Sound refineries.
The trains pass through downtown Spokane as they enter Washington, move south through Pasco, along the Columbia River to Vancouver, then north.
They are likely to grow in number, especially if Tesoro succeeds in building an oil-shipment terminal along the Columbia River in Vancouver.
In Seattle, 170,000 people live within half-a-mile of the railroad tracks. The Mariners and Seahawks’ stadiums sit just south of the tunnel entrance: Train whistles are a feature of televised Seattle sports events.
Sen. Maria Cantwell, D-Wash., and colleagues, have pressured the U.S. Department of Transportation to retire old, explosion-prone 1964-vintage tank cars, and to limit volatile components of crude oil (propane, butane, methane and ethane) in rail shipments.
“Current tank cars don’t have adequate protection,” Cantwell said Tuesday. “The railroads tell us they are building 40,000 cars a year. There are 37,000 (old) DOT-111 cars in use. We believe that (removal) can be accomplished by the end of the year.”
The senator noted that strict rules govern the amount of volatile components permitted in oil pipelines. No similar rules govern oil trains.
Describing herself as “very frustrated,” Cantwell said it is time to “rein in” volatile components on oil train cargoes. She wants the Pipeline and Hazardous Materials Safety Administration to issue an interim rule.
“People are putting volatility into a product that not even oil companies want,” said Cantwell.
“The longer we wait, the more we expose the public to the problems of these cars that aren’t especially robust,” the NTSB chairman said.
The Burlington Northern Santa Fe Railroad has issued regular updates, saying it is spending millions to upgrade tracks, and training hundreds of firefighters in emergency response. The BNSF brought tank cars to Interbay last year for training Seattle firefighters.
Still, recent oil train fires — notably the lethal explosion that leveled downtown Lac-Megantic, Quebec, and killed 47 people — have overwhelmed local emergency responders.
“If one of these events occurred, it would exhaust our resources and require assistance from communities around us,” Scoggins said.
The U.S. Department of Transportation promised last year that it would implement comprehensive safety rules. It has been repeatedly prodded by senators from both oil-producing and oil-refining states.
“This issue ultimately can be addressed only by the federal government,” Murray said.
Along with several colleagues, Cantwell has introduced the Crude-By-Rail Safety Act, which would immediately prohibit use of all DOT-111 tank cars and unjacketed CPC-1232 cars. It would force rules on volatile components.
The legislation requires railroads and shippers to disclose crude-by-rail movements to states’ emergency response coordinators. It would would institute a close-call reporting system in which employees can anonymously report safety problems.
The Washington Fire Chiefs have asked the BNSF, Union Pacific and Canadian National Railroads to supply worst case scenarios and comprehensive emergency response plans. The BNSF has responded by offering to meet with emergency responders.
“I believe the threat is so significant in the heart of Seattle that I am not sure what is enough,” Scoggins said.
Asked if he has seen any comprehensive emergency response plan from the railroad, the chief added: “What I am saying is I haven’t seen it.”
The oil train issue has been burned into the national consciousness by a series of accidents in the last two years. Lac-Magnetic was the worst. A big explosion took place early last year outside New Casselton, N.D. A CSX train derailed and caught fire and forced evacuations in Lynchburg, Va.
In recent weeks, almost simultaneously, a CN train derailed and caught fire in Ontario, and a train caused a mushrooming fire along a riverbank in West Virginia. Luckily, neither accident took place in a population center.
Seattle saw a minor derailment of tank cars under the Magnolia Bridge last July. Each was carrying 17,000 gallons of Bakken Crude.

From Washington state to D.C., fears of oil train risks on rise

Exploding oil trains are a hot topic in the United States and Canada, spurred by a recent spate of accidents and a prediction by the U.S. Department of Transportation last year that there are many more to come – 10 a year over the next two decades.
The oil boom in North Dakota and insufficient pipeline capacity have put a record number of cars hauling crude on the tracks, each capable of carrying more than 30,000 gallons of highly combustible oil when fully loaded. For a 100-car train that’s 3 million gallons.
A sampling of recent developments:
• An association of Washington Fire Chiefs requested Burlington Northern Santa Fe Railway provide worst-case scenarios for potential crude oil train emergencies in selected areas of the state. They also want to see evidence of the levels of catastrophic insurance the railroad has purchased; comprehensive emergency response plans for specific locations in the state; and route analysis documentation and route selection results.
“Normally, we would be able to assess the hazard through right-to-know and other public documents,” a letter to BNSF said. “However, your industry has sought and gained exemptions to these sunshine laws. This exemption does not mean that your industry is exempt from taking reasonable steps to ensure catastrophic incidents do not occur.”
• Seattle vendors and former Mayor Mike McGinn joined forces at a news conference March 20 to highlight the potential destruction from an explosive oil train accident under Pike Place Market. The BNSF tunnel that runs under downtown Seattle passes under a corner of the market. An accident threatens the safety of 10 million annual visitors and the iconic market itself, the vendors said.
BNSF said it’s going to great lengths to make the tunnel safer, including spending $10 million in recent years to replace the tracks.
McGinn called the railway’s assurances “absolutely not sufficient for safety.”
• Four Democratic senators introduced an act Wednesday that would immediately bar the use of older, riskier tankers and set standards for volatility of gases in tank cars so they don’t explode as easily. The Crude-By-Rule Safety Act would set standards for new tankers that require thicker shells, thermal protection and pressure relief valves.
“Every new derailment increases the urgency with which we need to act,” U.S. Sen. Maria Cantwell, D-Wash., said. “Communities in Washington state and across the nation see hundreds of these oil tank cars pass through each week. This legislation will help reduce the risk of explosion in accidents, take unsafe tank cars off the tracks, and ensure first responders have the equipment they need.”
• The American Petroleum Institute and the Association of American Railroads announced at a teleconference Wednesday they will jointly fund additional training for local first responders along railroad tracks to deal with crude shipment accidents.
There are initial plans for sessions in 15 states, beginning this weekend in Nebraska and Florida. The AAR last year dedicated more than $5 million to training at its Security and Emergency Response Training Center near Pueblo, Colorado.
• Noting that a fiery oil train wreck in downtown Spokane could lead to the evacuation of 20,000 people, city officials requested and on Thursday were granted a seat at the table in discussions to open an oil terminal in Vancouver, Washington.
BNSF supports the terminal and said it’s “more than prepared” to handle the increased loads through northern Montana, Idaho and Washington.
“Our northern route is perfectly positioned geographically as we run through the Bakken region and to the Northwest destination points,” BNSF spokesman Gus Melonas told the Spokesman-Review’s Nicholas Deshais in early March.
Jerry White, leader of the Spokane Riverkeeper, was not convinced. He referred to the fiery Feb. 16 of a BNSF train in West Virginia.
“When I was watching that disaster, something struck me,” White told Deshais. “The fire chief in that little town said they were just backing off and letting that oil burn. I projected that onto Spokane. Can you imagine this happening in the downtown corridor and the fire crews saying the only thing we can do is back off and let them burn?”
• A state official warned Minnesotans living along tracks carrying North Dakota crude oil to prepare themselves for an emergency.
“People need to take some personal awareness of what’s around them,” Kevin Reed of the Minnesota Homeland Security and Emergency Management Division told Don Davis of the Forum News Service. “How do I get out of the way before the fire department gets here?”
Last week, the Minnesota Department of Transportation reported that 326,170 Minnesotans live within half a mile of railroad tracks with trains carrying Bakken oil. A state report indicated an average of 6.3 oil trains a day cross Minnesota.
Gov. Mark Dayton said those numbers highlight the need for safety improvements on the railroads.
“It just underscores the risk factor and why it’s imperative that we do everything we possibly can to prevent these derailments and the catastrophes that can result from them,” Dayton said.
• The U.S. Department of Energy is studying crude volatility and whether it should be treated to remove dissolved gases before transport, an official testified Wednesday at a House Appropriations subcommittee budget hearing.
Rep. Mike Quigley, D-Ill., asked why the more volatile crude transported from the Bakken couldn’t be stabilized before being loaded into tank cars in the same way crude from Texas is stabilized.
Timothy Butters, acting administrator of the Pipeline and Hazardous Materials Safety Administration, said that’s what the study seeks to determine. Results should be in by fall.
Future Blast Zones? How Crude-By-Rail Puts U.S. Communities At Risk

The transport of petroleum via rail is now a well-known and unwelcome sight in many other U.S. communities. Its long distance rail transport has resulted in five major train fires and explosions in the last 16 months alone.
Richmond, California began life more than a century ago as a sleepy little railroad town. It was the second place on the eastern shore of San Francisco Bay where a transcontinental rail line connected with ferries, to transport freight and passengers to San Francisco. Now a diverse industrial city of 100,000, Richmond is still crisscrossed with tracks, both main lines and shorter ones, serving its deep-water port, huge Chevron oil refinery, and other local businesses.
Trains just arriving or being readied for their next trip, move in and out of a sprawling Burlington Northern Santa Fe (BNSF) rail yard located right next to the oldest part of town. Some train formations are more than 100 cars long. The traffic stalls they create on nearby streets and related use of loud horns, both day and night, have long been a source of neighborhood complaints. Persistent city hall pressure has succeeded in cutting horn blasts by about 1,000 a day, through the creation of several dozen much appreciated “quiet zones.” No other municipality in California has established so many, but only after many years of wrestling with the industry.
Despite progress on the noise front, many trackside residents continue to experience “quality of life” problems related to the air they breath. Some of their complaints arise from Richmond’s role as a transfer point for coal and petroleum coke (aka “pet coke”) being exported to Asia. As one Richmond official explained at a community meeting in March, these “climate wrecking materials” wend their way through the city in open cars—leaving, in their wake, houses, backyards, and even parked cars covered with a thick film of grimy, coal dust. Coal train fall-out has become so noisome in Richmond that its seven-member city council—now dominated by environmental activists— wants the Bay Area Air Quality Management District (BAAQMD) to mandate the use of enclosed cars.
This would seem to be a no-brainer, public health-wise. But the track record of this particular governmental agency—in any area related to public health and safety—has not been confidence inspiring lately. The BAAQMD is already complicit with the creation of Richmond’s most troubling new fossil fuel hazard in recent memory. For the last year, that threat has been on display, as far as the eye can see, at BNSF, which is owned by Nebraska billionaire Warren Buffett. Buffett’s rail yard has been filled with hundreds of black, tubular metal tank cars containing a particularly volatile form of crude oil that’s come all the way to Richmond from the new energy boomtowns of North Dakota.
Buffett’s Bomb Trains
The arrival of this highly volatile petroleum product is now a well-known and unwelcome sight in many other U.S. communities. Its long distance rail transport has resulted in five major train fires and explosions in the last 16 months alone. In addition to these spectacular non-fatal accidents, mostly occurring in uninhabited areas, North America’s most infamous crude-by-rail disaster took the lives of 47 people in July, 2013. That’s when a runaway train—improperly braked by its single-man crew—barreled into Lac-Megantic, Quebec, leveling all of its downtown.
Despite this alarming safety record, the BAAQMD has allowed Kinder Morgan, a major energy firm, to store up to 72,000 barrels per day at a Richmond facility leased from the BNSF; from there, it’s loaded tank trucks bound for the Tesoro Golden Eagle Refinery in Martinez, CA., (which has been shutdown recently due to a nationwide strike by the United Steel Workers). Before issuing the necessary permit for bringing Bakken crude into Richmond, the BAAQMD gave no prior notice, held no public hearings, and conducted no review of any possible environmental or health impacts.
Aided and abetted by regulatory lapses at multiple levels of government, this stealth approach has served the oil industry well. The precipitous drop in petroleum prices has recently made rail transport of Bakken crude less cost effective (leading to a curtailment of Bay Area shipments). But, prior to that temporary reprieve, the number of rail cars commandeered nationally for this purpose jumped from 9,500 six years ago to 500,000 last year. As labor and environmental critics have pointed out, the Achilles Heel of crude-by-rail everywhere is the aging condition and structural weakness of most tank cars, designed and used, in the past, for hauling less hazardous rail cargo.
Even newer, supposedly safer tank cars have failed to protect the public from the consequences of oil train collisions, rollovers, tank car ruptures, and spills. The total amount of oil spilled in 2013, due to derailments, was greater in volume than all the spills occurring in the U.S. during the previous forty years. On February 17, a major accident in West Virginia triggered a fire that burned for five days, forced the evacuation of two nearby towns, and seriously threatened local water supplies.
Trackside communities like Richmond lack sufficient legal tools to avert such disasters in the future, because rail safety enforcement rests with the federal government. Among its other foot-dragging, the U.S. Department of Transportation has failed to mandate tank car modernization and upgrading in timely fashion. As for the BAAQMD, according to Communities for a Better Environment (CBE) organizer Andres Soto, that agency may be “legally responsible for protecting Bay Area air quality but it really just acts as a tool of industry.”
A Contested Permit
CBE, the Sierra Club, and Asian Pacific Environmental Network filed suit last year to block Kinder-Morgan’s operation in Richmond. A superior court judge in San Francisco ruled that their challenge to the BAAQMD’s permit-granting authority wasn’t timely, a decision still under appeal. The Richmond City Council supported the permit revocation and urged Congress to halt all Bakken crude transportation by rail until tougher federal safety rules were developed and implemented
In the meantime, concerned citizens of Contra Costa County began fighting back, first by educating themselves about the dangers of crude by rail and then mobilizing their friends and neighbors to attend informational meetings and protests. Last March, Richmond’s then mayor, Gayle McLaughlin, a California Green, hosted a community forum that featured Marilaine Savard from the Citizens Committee of Lac-Megantic, and Antonia Juhasz, a leading writer and researcher about oil-related hazards. “The oil industry is far too powerful,” Savard told 150 people packed into the storefront headquarters of the Richmond Progressive Alliance. “The first duty of government should be to protect citizens, not shareholders.”
Since that event, CBE organizer Soto has been on the road, sounding the alarm before audiences throughout the county. In his power-point presentation, he highlights maps illustrating how big the “blast zones” would be in Richmond and other refinery towns if crude-by-rail triggered a fire and explosion on the scale of Lac-Megantic’s. Last September, direct actionists from the Sunflower Alliance and other groups took the fight directly to Kinder Morgan’s front door. Eight activists locked themselves to a gate leading to the facility; along with other supporters, they succeeded in disrupting truck traffic for three hours. After negotiations between Richmond police and BNSF security personnel, the protestors were allowed to leave without being arrested for trespassing.
Rail Labor And Environmentalists Meet
In the wake of recent high-profile oil train wrecks in West Virginia and Illinois, Richmond played host last weekend to more than 100 railroad and refinery workers, other trade unionists, community organizers, and environmentalists. They were attending the first of two regional strategy conferences sponsored by Railroad Workers United (RWU) and allied groups. RWU is national rank-and-file organization that seeks to build greater unity among rail industry craft unions long prone to bickering, back stabbing, and estrangement from potential non-labor allies.
“As railroaders,” the RWU declares, “we know that the safest means of transport is the railroad—far safer than roads and highways, inland waterways, and even pipelines. But the rail industry has taken advantage of a lax regulatory environment, conservative pro-business governments and weakened unions across North America to roll the dice on safety. It’s time for railroad workers, community, and environmental activists to come together and take a stand.”
One joint project discussed at the March 15 conference is the fight against single employee train crews. After Lac-Megantic was destroyed, the Canadian government banned one-person crews on trains hauling hazardous materials. In the U.S, carriers, big like BNSF continued to seek union approval for staffing reductions (while insisting that transport of crude oil, ethanol, or other flammable cargo would still require two person crews). To stop any further rail labor slide down this slippery slope, RWU rallied conductors to reject a deal their union negotiated with BNSF last year that would have permitted one-person crews.
Other safety concerns raised at the Richmond meeting included crew fatigue and railway attempts to cut labor costs by operating trains that are longer, heavier, and harder to stop in emergency situations. “Recent oil train derailments are directly linked to the length and weights of trains,” argued Jeff Kurtz, a railroad engineer from Iowa who spoke at the Richmond meeting. “The railroads know how dangerous it is to have 150-ton tank cars running on a 8,000 foot train.” Kurtz expressed confidence that “we can address these problems in a way that would improve the economy and the environment for everyone, “ if labor and climate change activists continue to find common ground.
RWU organizers are holding a second educational conference on March 21 in Olympia, Washington. According to Seattle switchman-conductor Jen Wallis, this kind of “blue-green” exchange, around rail safety issues, has never been attempted before in the Pacific Northwest. “Rail labor hasn’t worked with environmentalists to the degree that steelworkers and longshoreman and teamsters have, “ Wallis says. “It’s all very new.”

State rail regulators: Fine BNSF for not reporting leaks immediately

Washington state regulators have recommended BNSF Railway be fined up to $700,000 for failing to properly report more than a dozen hazardous materials spills in recent months despite the fact state staff had reminded the company how to do so last fall.
On Thursday, March 19, the state Utilities and Transportation Commission staff announced it found BNSF had failed to report 14 releases of hazardous materials, including crude oil leaks, within a half hour of learning about the leaks, as required by state law.
In one case, crews at BP Cherry Point refinery found crude oil had leaked onto the sides and wheels of a tank car, which was found to be 1,611 gallons short. That was on Nov. 5, but the UTC didn’t find out about it until Dec. 3, when it got a copy of the report BNSF sent to the U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety Administration. Railroads have 30 days to file that type of report.
When contacted about the incident by a McClatchy reporter in January, BNSF said the train was “not in transit, not on our property and not in our custody” when the spill was detected, and the company had submitted the required reports to state and federal regulators.
In another case from Jan. 12 and 13, a train hauling 100 cars of Bakken crude oil from North Dakota to the Tesoro refinery in Anacortes had more than a dozen leaking cars discovered in multiple stops as it crossed the state.
Although the UTC sent an investigator to look at the leaking cars as part of a Federal Railroad Administration investigation, BNSF didn’t report the incident to the state’s 24-hour hotline at the Emergency Management Division until two weeks later. The hotline duty officer is in charge of alerting the various state agencies that might need to respond to a spill.
When asked by The Bellingham Herald in February why the January incident was reported more than a week later, BNSF spokeswoman Courtney Wallace replied that BNSF staff members thought they were following proper protocols, and had amended their Washington reporting policy following discussions with the UTC in January.
But the investigation released by the UTC on Thursday shows that on Oct. 22, 2014, the UTC had emailed a copy of the state’s reporting requirements to Patrick Brady, BNSF’s director of hazardous materials and special operations, in an effort to make sure BNSF knew how to report accidents.
As copied into the body of the Oct. 22 email to Brady, the state law regulating accident reports ( WAC 480-62-310) lists the hotline number, which types of incidents must be reported, and states that railroad companies must call within 30 minutes of learning of the event.
On Dec. 3, Brady emailed the UTC again asking, “Can you send me the regulatory reference to spill notification to the UTC?” Staff members again emailed Brady the state law on reporting requirements, according to emails included in the investigation.
From Nov. 1, 2014, to Feb. 24, UTC staff found BNSF committed 700 violations of the reporting requirement. Every day an incident goes unreported counts as a separate violation, per state law.
In addition to the leaking crude oil incidents, the UTC announcement lists a variety of leaks that occurred throughout the state: a tank car dripping gas/oil from a bottom valve in Spokane Valley on Dec. 8, 2014; cars leaking “primary sludge” found in incidents in Seattle, Vancouver and Everett in December; two 100-gallon spills of lube oil from locomotives in December and January, among others.
The commission could opt to fine the company $1,000 per violation of the reporting law, but no fine has been issued yet. The commission will set a final penalty after BNSF gets the chance to have a hearing.
“When a company fails to notify the (state Emergency Operations Center) that a hazardous material incident has occurred, critical response resources may not be deployed, causing potential harm to the public and the environment,” the UTC announcement states.
BNSF was still reviewing the report when contacted for comment on Thursday.
“In regards to reporting releases in Washington state, we believed we were complying in good faith with the requirements from our agency partners,” BNSF’s Wallace wrote in a statement. “Following guidance from the UTC in January 2015, BNSF reviewed its reporting notification process and amended its practices to address concerns identified by the UTC. We will continue to work closely with the UTC moving forward on this issue.”
BNSF is the largest railroad company operating in Washington.
