Bay Area Air Board emissions plan draws response from Valero

[Editor: The Benicia Herald is one of very few news outlets to cover the Bay Area Air Quality Management District’s far-reaching  and highly significant December 17 initiative on refinery emissions.  The first Herald article just covered the facts, and oddly, is not posted on the Herald’s website.  As a follow-up to that story, our local newspaper either sought out comments from the Refinery or responded to Valero’s overture, not sure which.  Either way, we were treated on Christmas Eve to a front page Valero Benicia promotion of its wondrous efforts to control its emissions, and the supposedly small part Bay Area refineries play in contributing to greenhouse gases.  Note especially Valero’s resolve to “participate in any new rulemaking to ensure rules are reasonable and cost effective.”   Reasonable rules would surely protect community health and safety, no?  And according to whose costs should regulatory effectiveness be weighed?   For other reports on the Air District initiative, see The Contra Costa Times, and the Oil & Gas Journal. Refinery official: ‘Proud’ to contribute to better air quality

The Bay Area Air Quality Management District is hoping its new five-component strategy will reduce emissions from refineries in it geographic area.

The district’s Refinery Emissions Reduction Resolution, approved Oct. 15, sets a goal of 20-percent reduction in refinery emissions — or as much as is feasible — during the next five years.

The Bay Area Air Quality Management District is the regional agency responsible for protecting air quality in the nine-county Bay Area.

The announced strategy would show the Air District how to achieve that goal.

“Our new Refinery Emissions Reduction Strategy continues and reaffirms the air district’s commitment to significantly decrease harmful air pollution in our communities,” said Jack Broadbent, the district’s executive officer.

“This strategy will ensure that refineries are taking the strongest steps to cut emissions and minimize their health impacts on neighboring residents and the region as a whole.”

But refineries are just one industry that contributes to the San Francisco Bay Area’s air pollution and greenhouse gas emissions, according to an official at Valero Benicia Refinery.

“By the district’s own data, Bay Area refineries make up only a small segment of overall emissions in the Bay Area air shed,” said Chris Howe, the refinery’s director of health, safety, environment and government affairs.

“These emissions have continued to decline over the last two decades,” Howe said, data which the Air District also acknowledged.

“We are proud of the significant contributions our refinery has made and will continue to make to improve air quality, especially with the installation of our flue gas scrubber in 2011,” Howe said, citing a major component of the Valero Improvement Project.

In addition, he said, “We will continue to participate in any new rulemaking to ensure rules are reasonable and cost effective when weighed against the many options the district has to regulate emissions in our air basin.”

Broadbent said the Air District’s announced strategy sets overall goals of a 20-percent reduction in both criteria pollutants from refineries and in health risks to area communities, both within the next five years. That is the strategy’s first component.

To do this, the Air District plans to investigate significant sources of those pollutants at the refineries themselves, and to examine a variety of additional pollution controls at those sources, he said. That’s the second component.

He said this would be done under the district’s focused Best Available Retrofit Control Technology program.

“Rulemaking is already under way to reduce sulfur dioxide from coke calciners and particulate matter from catalytic cracking units,” Broadbent said.

“Several other rules to reduce refinery emissions will be developed in 2015.”

The strategy’s third component would be the Air District’s approach to reduce health risks from toxic air pollution, Broadbent said.

He said it would begin with requirements to reduce toxic emissions from such refinery sources as cooling towers and coking units.

Site-wide health risks would be assessed, and sources for further emissions controls would be identified, with an eye toward health benefits, he said.

A fourth component would be evaluation of greenhouse gas emissions at the refineries and their reductions as a result of the cap-and-trade system put in place under Assembly Bill 32.

That bill, signed into law Sept. 27, 2006, requires the California Air Resources Board (CARB) to develop regulations and market mechanisms to reduce California’s greenhouse gas emissions to 1990 levels by the year 2020.

CARB adopted a cap-and-trade program Dec. 17, 2010, allowing some emitters to buy credits at quarterly auctions for additional emissions.

Under the Air District’s strategy, refinery performance would be compared to third-party standards for best practices, with analysis of potential further opportunities for reductions, Broadbent said.

The fifth component concerns continuous improvement in emission reductions, for which refinery operators would be required on a periodic basis to evaluate the sources of most of their emissions to determine if more controls are needed.

Broadbent said the Air District would develop its package of rules in the coming year, and would be working with members of the public as well as refinery industry representatives to make any modifications in the proposed rules and to use the strategy to reach those stated goals.

In addition, the Air District will prepare its Petroleum Refining Emissions Tracking rule that requires updated health risk assessments, additional fence-line and neighborhood monitoring capacity and the compiling of an annual emissions inventory.

Simultaneously, the Air District will write a companion rule to set emissions thresholds and mitigate potential increases at refineries, Broadbent said.

Those rules are expected to be sent to the Air District’s board for adoption in 2015.

The San Francisco Bay Area’s five major oil refineries, including Valero Benicia Refinery, produce air pollution and greenhouse gases in the region, Broadbent said, and “these are already subject to more than 20 specific Air District regulations and programs, and their overall emissions have been steadily decreasing.”

California Bay Area advances plan for enhanced refinery regulations

California’s Bay Area Air Quality Management District (BAAQMD), the public agency responsible for regulating stationary sources of air pollution in the nine counties that surround San Francisco Bay, is moving forward with its plan to impose further emissions cuts on area refiners within the next 5 years.

BAAQMD’s board of directors unanimously voted on Dec. 17 to adopt the proposed emissions reduction strategy, which sets a goal of reducing refinery emissions by 20%, or as much as feasible, by 2020.

Adoption of the heightened emissions-control strategy follows BAAQMD’s October resolution (OGJ Online, Oct. 21, 2014) directing its staff to determine the best way to decrease emissions from area refineries by evaluating a range of approaches against a variety of factors such as reductions of “criteria pollutants” (pollutants for which air quality standards have been established), toxics,  and greenhouse gases (GHGs), as well as impacts on neighboring communities, the agency said in a statement.

“Our new refinery emissions reduction strategy continues and reaffirms [BAAQMD’s] commitment to significantly decrease harmful air pollution in our communities,” said Jack Broadbent, BAAQMD’s executive officer.

“This strategy will ensure that refineries are taking the strongest steps to cut emissions and minimize their health impacts on neighboring residents and the region as a whole,” according to Broadbent.

Implementation of the emissions reduction strategy will involve ongoing work with community and industry participants during 2015 to develop and refine a package of proposed associated rules, BAAQMD said.

As part of the approved strategy, the agency said it will continue preparation of its proposed Petroleum Refining Emissions Tracking Rule (PRET), which would require refiners to provide updated health risk assessments (HRAs), install additional fence-line and neighborhood monitoring capacity, and compile annual emission inventories.

Preparation of a “companion rule” to PRET also remains under way, according to BAAQMD.

Earlier billed by the industry as another iteration of the “baseline rule” removed from a previous draft version of PRET amid a series of legal challenges under California law, the proposed “companion rule” would set emissions thresholds as well as mitigate potential emissions increases from area refineries.

The agency plans to present a final set of proposed rules to BAAQMD’s board of directors sometime in 2015.

While Bay Area’s five refiners plan to continue actively collaborating with BAAQMD on its emissions-reduction strategy, the agency’s goals may be a bit too ambitious within the proposed timeframe, according to the Western States Petroleum Association (WSPA).

“The Bay Area refineries will constructively participate in the strategy’s rule making,” Guy Bjerke, WSPA’s Bay Area region manager, told OGJ.

“Our main concern with the strategy is the 20% reduction by 2020 goal which, given historic reductions over the past 10 years, are likely unachievable and impractical in just 5 years,” Bjerke said.

BAAQMD’s proposed strategy

To achieve its overall goal of a 20% emissions reduction from refineries alongside a 20% reduction in health risks to local communities over the next 5 years, the proposed strategy includes the following components:

• Reduction of criteria pollutants. Under a focused best available retrofit control technology (BARCT) program, BAAQMD will investigate  significant sources at refineries and pursue a variety of additional pollution controls at these sources. Rulemaking is already underway to reduce sulfur dioxide from coke calciners and particulate matter from catalytic cracking units. Several other rules to reduce refinery emissions also will be developed in 2015.

• Reduction of health risks from toxic air pollution. This approach will begin with requirements to reduce toxic emissions from key refinery sources such as cooling towers and coking units. The focused toxics approach will also include site-wide HRAs and the identification of sources for further emission controls, using health benefits as an important evaluative tool.

• Evaluation of GHG emissions. Under this approach, BAAQMD would track emission reductions at refineries incurred as a result of the cap-and-trade system under California’s AB 32 climate law, which requires the state to reduce its GHG emissions to 1990 levels by 2020. Refinery performance would be compared to third-party standards for best practices, with analysis of potential further opportunities for reductions.

• Continuous improvement. To ensure continuous improvement in emission reductions, refiners will be required to periodically evaluate the sources of the majority of their emissions in order to determine if additional pollution controls are needed.

BAAQMD previously acknowledged that overall emissions from the region’s five refineries, which already are subject to more than 20 specific agency regulations and programs, have been steadily decreasing.

BNSF train car derails in Richmond, CA

Burlington Northern Santa Fe car carrying pork derails in Richmond, raising concerns about more hazardous materials

RICHMOND — The derailment Friday of a single rail car containing refrigerated pork is under investigation by Burlington Northern Santa Fe officials, who say it occurred during a low-speed movement within its rail yard and suggests no added risk for the rail transport of more hazardous materials in Contra Costa County.

“This was a very minor incident with a single car going less than 10 mph,” BNSF spokeswoman Lena Kent said. “There are many precautions we take to ensure that 99.997 percent of all hazardous materials we transport reach their destinations without a release caused by an accident.”

The car was being pulled by a locomotive through the yard just west of Richmond Parkway near Pennsylvania Avenue when it tipped over.

Kent said people cut through a chain-link fence soon after and took boxes of refrigerated pork that spilled from the crumpled hull. Empty cardboard Tyson Foods boxes were seen scattered in the neighborhood nearby.

Kent said the incident is under investigation, and she declined to say what may have caused it or whether the line on which the derailment occurred is ever used to transport hazardous materials.

The incident and its aftermath — the car remains broken beside the tracks and will soon be scrapped — has only heightened concerns in a community already on edge over the recent influx of crude-by-rail shipments, much of it from the Bakken region of North Dakota.

City officials last month sent a letter to the Bay Area Air Quality Management District urging the agency to revoke a permit allowing Kinder Morgan to offload Bakken crude and Canadian tar sands oil at its Richmond rail yard, the major draw for local crude-by-rail traffic.

In September, a lawsuit by environmental groups seeking to revoke that permit — which was issued without public notice — was tossed out by a judge on the grounds that it was filed too late.

Kent said BNSF transports two oil-carrying trains per month in California but declined to say exactly where, citing security concerns.

Industry experts expect crude-by-rail traffic to increase in the coming years, as North American oil extraction grows, and the product must be refined in facilities across the United States, including several in Contra Costa County.

Randy Sawyer, Contra Costa County’s chief environmental health and hazardous materials officer, said trains of up to 100 cars travel into Richmond before being transferred to trucks or pipelines to be refined. He noted that cars carrying hazardous materials are more robust than the one that carried the spilled pork, and they would be unlikely to spill in a low-speed derailment.

Nonetheless, “A crude car could tip over also,” Sawyer said. “It’s a possibility.”

Kent said Friday’s derailment does not indicate a wider problem.

“We operate all of our trains with safety as our first priority,” Kent said. “However, when it comes to hazardous material we do have more restrictive operating procedures.”

County Supervisor John Gioia said BNSF officials have told him they are developing “more resilient” cars for crude oil, a development he took to mean that the company expects the crude-by-rail market to continue to grow, and that federal regulators are likely to impose new standards as communities across the country see increased crude-by-rail traffic in their midst.

“Any train derailment concerns me because there could be anything from injury to a larger public safety issue; it’s all important,” Gioia said. “But this new (incident) hasn’t told me anything new other than what we know already based on derailments in other parts of the country: that trains with hazardous materials pose a risk.”

Fenceline Communities Face an Ongoing Invisible Assault of Toxics Emanating from Refineries

Drive past the other-worldly refinery landscape in Deer Park, Texas and you have to lunge for the recirc button to avoid the sickeningly-sweet chemical odors. That’s not an option for the more than 200,000 people living along the petrochemical complex of the Houston Ship Channel; they can’t press a recirc button to avoid exposure to those chemical fumes. Such is the problem for hundreds of thousands of Americans living in refinery fenceline communities that are often plagued by foul odors and safety risks.

Of much greater concern though, are the invisible impacts of the toxic chemicals emanating from all the towers, pipes and tanks of refineries. Called “fugitive emissions,” these are chemicals that leak or escape not just during accidents, but also during every day operations. For many facilities, chemicals are leaking in greater quantities than from exhaust pipes where they are tracked and reported. Here is a summary of what these chemical pollutants are, health impacts that refinery fenceline communities face, and what can be done about it.

The Chemicals That Leak Across Fencelines

Oil refineries release several hundred hazardous air pollutants. Many of these chemical pose serious health hazards even at very low levels of exposure, and some can build up in the environment contaminating fish, soil and even household dust. These chemicals contribute to a wide range of serious health impacts including asthma and respiratory illnesses, developmental impacts like IQ loss, cancer, heart disease, reproductive system impacts including birth defects, damage to a range of organs including the kidneys and liver, and even premature death. Check out a list of fourteen notorious chemicals emanating from refineries below.

The thing about these chemicals leaking out of refineries – you never know if you’re exposed to them, when and how much. Back in 1999, a few visits to Port Arthur, Texas, home of three large refineries, made me wonder about this; each time I left with a sticky residue on the car, a splitting headache and blurred vision. People reported their kids having rashes all the time. This made a little more sense after rooting through a room at the local branch of the Texas environmental agency (TCEQ) filled with cardboard boxes of records for each of the plants documenting refinery upsets, unplanned releases and accidents, seemingly on a weekly basis.  The plants were spewing chemical fumes “by accident” all the time.

Despite the stacks of paperwork though, it was still a mystery who was exposed to what and how much.  One thing was for sure though, a quick look through census data showed that the neighborhoods closest to the refineries and chemical plants were 99 percent non-white and the percent of non-whites in communities much farther away was dramatically lower. Where did the plant managers and other execs live?  This situation is sadly not unique to Port Arthur. It plays out in refinery towns across the U.S. creating hotspots of disproportionate pollution and “cancer alleys” in low income communities of color.

Health Impacts Documented in Refinery Fenceline Communities

Community health surveys have long indicated significantly increased illness and health impacts among residents living near refineries and petrochemical complexes. The surveys are validated by the dozens of rigorous peer reviewed studies that have documented community health impacts of pollution from petroleum refineries, finding increased rates of cancer, preterm births, asthma related hospitalizations, and increased mortality in communities around refineries.

  • Cancer: Many studies have found elevated rates of leukemia and lymphomas in residents living close to petrochemical plants.  One major recent study in the industrial heartland of Alberta, Canada, where many refinery/oil upgrading operations are located, found greatly elevated pollutant levels and notably higher rates of leukemia and non-Hodgkin lymphoma compared to neighboring counties.  Scores of other studies have found higher rates of cancer among residents who live closer to refineries (brain, lung, liver, bone, bladder, stomach, kidney and urinary, and other types of cancer).
  • Asthma: Several studies show increased asthma prevalence, emergency room visits for asthma, respiratory symptoms as well as significantly lower lung function among children and residents living close to refineries.
  • Birth Defects: In 2006, the Texas Department of State Health Services found that Corpus Christi, home of “Refinery Row,” had a birth defect rate that was 84 percent higher than the rest of Texas. A follow-up study found that mothers living near refineries and chemical plants had babies with high rates of life-threatening birth defects.
  • Premature Deaths: A recent major study of air pollution related mortalities in the U.S. found that out of over 5,000 cities evaluated, Donaldsonville, Louisiana has the highest mortality rate from air pollution. Nine refineries in the area contribute to the roughly 81 deaths from cardiovascular disease and lung cancer per 100,000 people.

What Can We Do About it?

This spring, U.S. Environmental Protection Agency is slated to finalize a new refinery rule that could be a major step in reducing pollution and monitoring for leaks. Please support this rule by telling Congress to protect our environmental policies instead of interfering with them.

However, despite the critical need for this rule, the phase in will take many years even if it does get finalized according to a court-ordered schedule. In the meantime we are calling on local authorities to act swiftly to reign in refinery pollution beginning with a 20 by 2020 pledge in the Bay Area. The good news is that the Bay Area Air District voted on October 15th to adopt a policy to prevent increases in refinery emissions that an influx of dirtier, extreme crude oil could cause; and to plan for a 20 percent emission reduction from all refineries by 2020.

The Bay Area refinery clean up policy goes back to the air district board for further consideration on December 17th, in time to provide a happier holiday for fenceline communities… that is, if the Grinch-like oil industry, claiming that it can’t afford to clean up, doesn’t stop it. The air district needs to hear your support to keep the refinery clean up policy on track.  The massive flaring events last week at the Tesoro refinery turned the sky in Martinez orange, reminding everyone for miles how badly we need refinery clean-up policies.

Refinery fenceline communities continue to suffer the ill effects of pollution every day despite ample technology to clean up the mess and a wealthy industry that can surely afford the upgrades.  And we are all fenceline communities when it comes to climate change. Given the stark warning issued earlier this month from the world’s leading scientists in the IPCC report on climate change, noting that we will face “severe, pervasive and irreversible impacts” if we do not act now, it is high time to reign in the super-polluting refining industry.

14 Notorious Refinery Pollutants

  1. Benzene is a known carcinogen (cancer causing agent), associated with childhood leukemia in particular. High exposures can impact the central nervous system leading to drowsiness, dizziness, irregular heartbeat, nausea, headaches, and depression; reproductive impacts, such as smaller ovaries; and potentially developmental effects such as low birth weight, delayed bone formation, and bone marrow damage.
  2. Toluene is especially harmful to people with asthma. It poses reproductive hazards and can cause headaches, impaired reasoning, memory loss, nausea, impaired speech, hearing, and vision, and over the long term, damage to the liver and kidneys.
  3. Ethylbenzene is a carcinogen. Chronic, low-level exposure can result in kidney damage and hearing loss.
  4. Xylenes can cause difficulty breathing, damage to the lungs, impaired memory, and possible damage to the liver and kidneys. Long term exposure is associated with multiple impacts to the nervous system, blood cell abnormalities, abnormal heartbeat, liver damage, genetic mutations, reproductive system effects, and death due to respiratory failure.
  5. Polycyclic aromatic hydrocarbons (PAHs) are a group of over 100 different tar-like chemicals, some of which are mutagens, carcinogens, and developmental toxicants.  PAHs can cross the placenta and harm an unborn fetus, contributing to fetal mortality, increased cancer risk and birth defects. PAHs are also associated with asthma-related symptoms and developmental and cognitive impairment, including lower IQ.
  6. Hydrogen Cyanide exposure at high levels swiftly harms the brain and heart, beginning with rapid breathing, followed by convulsions, and loss of consciousness, and can even cause coma and death. More commonly, low level exposure is associated with breathing difficulties, chest pain, vomiting, blood changes, headaches, and enlargement of the thyroid gland.
  7. 1,3-butadiene causes inflammation of nasal tissues, changes to lung, heart, and reproductive tissues, neurological effects and blood changes; it is a carcinogen associated with cancers of the blood and lymphatic system, and it may also cause birth defects.
  8. Formaldehyde is a carcinogen that can cause asthma or asthma-like symptoms, neurological effects, increased risk of allergies, eczema and changes in lung function.
  9. Arsenic is a carcinogen that poses reproductive and other hazards. In children, in particular, arsenic can cause skin lesions, neurodevelopmental effects like lower IQ, lung disease, and reproductive effects including lower birth weight, spontaneous abortion, and neonatal death.
  10. Chromium (VI) or hexavalent chromium is a carcinogen, primarily affecting the lungs, but also the stomach and intestinal tract. Additional effects include: increased risk of respiratory illness such as pneumonia and bronchitis, gastrointestinal effects including lesions of the stomach and small intestine, hematological effects like anemia, and reproductive effects to males, including lower sperm count and histopathological changes, and complications during pregnancy and childbirth.
  11. Lead is a well-known toxic heavy metal that is particularly hazardous to children, severely impacting development and cognitive functioning, resulting in lower IQ scores, attention deficit problems and other behavioral impacts. Lead exposure is also associated with other neurological, hematological, and immune effects; cancer; cardiovascular and renal effects in adults; and reproductive effects, such as lower sperm counts and spontaneous abortions. There is no safe level of exposure to lead.
  12. Mercuryis a highly neurotoxic contaminant that can bio-accumulate in food such as fish. Health effects of mercury include neurological, developmental, and behavioral problems, such as lower IQ, attention deficit hyperactivity disorder (ADHD), and impaired memory and motor skills. Exposure is also associated with cardiovascular effects including increased risks of heart attacks, increased blood pressure, and thickening of arteries.
  13. Nickel is associated with chronic dermatitis, respiratory impacts and potentially also reproductive impacts. Various nickel compounds are carcinogenic and can also have cardiovascular effects in particulate form.
  14. Hydrogen fluoride or Hydrofluoric acid (HF) is a fatal poison that is highly corrosive and can burn skin or lungs on contact, though symptoms of exposure can be delayed for days. Chronic exposure can lead to lung disease and damaged vision. Other health impacts include nausea, vomiting, gastric pain, low blood pressure, irregular heartbeat, seizures, fluid build-up in the lungs, lung collapse and ultimately death, particularly in situations of accidental release.
