Proposed EPA rule would disadvantage minority communities

Soot rule thrusts EPA into spotlight on race

EPA published a proposal in the Federal Register yesterday that critics described as an assault on minority communities coping with the public health legacy of structural racism.

The agency’s plan would mandate changes to the way future rules under the Clean Air Act would weigh the costs and benefits of climate and air pollution regulations.

It’s the first time EPA has attempted such a rulemaking, and critics say the goal is to saddle future administrations with an inflexible set of cost-benefit methodologies that discount benefits from cutting pollutants while stressing cost to industry.

The rule would also bar EPA from giving special consideration to individual communities that bear the brunt of environmental risks — frequently populations of color.

“The rule won’t take into account any benefit that can’t be monetized and quantified, including important things like the effect, say, of a mercury rule on tribal communities that rely on fish and wildlife that are contaminated with mercury or the effect of particulate matter on communities of color and disadvantaged folks who live near the power plants that are being controlled,” said Ann Weeks, legal director of the Clean Air Task Force.

The Obama EPA did give special weight to the benefits that would accrue to specific communities when assessing whether a rule was cost-effective, she said. But this proposal seeks to make that impossible.

“You basically are tying your own hands, if you’re the agency, by saying this is the way you have to do things,” she said.

EPA describes the draft rule as an effort to improve transparency by demanding a strict accounting of costs and benefits for all economically significant air quality and climate change rulemakings promulgated under the landmark environmental law.

But it raises questions about whether a future administration could count so-called co-benefits when drafting regulations. Co-benefits are reductions in pollutants that aren’t the rule’s primary target but that yield public health benefits that EPA has traditionally counted.

Administrator Andrew Wheeler, a former energy lawyer, has long sought to sideline co-benefits, which industry sees as justifying rules whose costs outweigh true environmental benefits.

The co-benefit that has packed the greatest punch in past Clean Air Act rulemakings is fine particulate matter, or soot. Epidemiological studies are chock-full of data linking these tiny particles to pulmonary, respiratory and neurological ailments and death.

So demonstrating that a rule would reduce particulate matter adds to its value — a fact that even the Trump EPA used last year to show that its Affordable Clean Energy rule for power plant carbon dioxide was worth its costs.

‘History of racism’

The proposal comes as communities of color are experiencing some of the worst impacts of the coronavirus, while protests over racism and police brutality continue in cities across the country.

There’s evidence that elevated exposure to soot from highways, industrial facilities and incinerators that have for decades been built in predominantly black, Latino and Asian American communities are disproportionately harming the health of their residents.

“It’s all deeply ingrained in the history of racism and the history of civil rights,” said Sofia Owen, a staff attorney with Alternatives for Community & Environment, an environmental justice group based in Boston. “The siting of these facilities — where our highways are, where incinerators are, where compressor stations or the bus depots and the train depots are — is communities of color and low-income communities.”

The Union of Concerned Scientists released modeling last year showing that Asian Americans are, on average, exposed to particulate matter concentrations from vehicle tailpipes that are 34% higher compared with other Americans.

They weren’t alone. Soot exposure was 24% higher for African Americans and 23% higher for Latinos. White Americans are exposed to 14% less soot from tailpipes than the average American (Greenwire, June 27, 2019).

“It’s primarily the PM2.5 that is responsible for environmental damage and health damage in communities living near highways,” said Maria Cecilia Pinto de Moura, a senior vehicles engineer with UCS, referring to particulate matter 2.5 micrometers or less in diameter. The science advocacy group is now doing similar modeling on proximity to coal-fired power plants by demographic group, she said.

The health impacts of PM2.5 exposure can be severe.

A 2017 study by researchers at the Harvard T.H. Chan School of Public Health and other institutions found that incremental increases in soot exposure below the standards set by EPA can result in significantly more deaths among senior citizens. The study found that black people were three times more likely to die from soot exposure than other Americans.

“We know that when you inhale fine particulate matter, they penetrate very deep into your lungs, and they can actually get into your bloodstream, and they initiate a form of inflammation that can cause pneumonia and cardiovascular disease,” said Francesca Dominici, a professor of biostatistics at the School of Public Health and an author of the 2017 study.

Dominici also co-authored a recent study showing that counties with higher levels of particulate matter experienced more deaths related to COVID-19, the disease caused by the novel coronavirus (Greenwire, April 7).

There’s a link between particulate matter and acute respiratory distress syndrome, she said, which causes COVID-19-related deaths.

“If you’re living in a county and you’re breathing polluted air for a very long time, even absent COVID, we know that your lungs are inflamed,” Dominici said. “After you contract COVID, your ability to respond to the inflammatory nature of COVID is severely compromised because your lungs already have inflammation.”

The result is worse for black and Latino people who contract COVID-19. The Centers for Disease Control and Prevention reported in April that 33% of those hospitalized with the disease were black, as were nearly a quarter of those who died. Eighteen percent of the U.S. population is black.

While racial minorities are more impacted by high soot levels, they’re also responsible for producing less of it.

A 2019 study published in the Proceedings of the National Academy of Sciences found that non-Hispanic whites consume the majority of the goods and services responsible for particulate matter. Black and Latino people on average are exposed to 56% and 63% more soot, respectively, than is linked to their consumption.

The same study estimated that soot caused 131,000 premature American deaths in 2015.

“The long tail of this is that particularly black Americans and Latinx communities have been discriminated against in this country, and because of their poverty, they are forced to live in neighborhoods that are less expensive and more polluted,” said Aaron Bernstein, director of the Harvard Chan School’s Center for Climate, Health and the Global Environment.

EPA’s cost-benefit exercises could consider that history of racial injustice when assessing whether a rule is warranted, he noted.

“If you clean up the air, there is a pretty good likelihood that we’re going to benefit people of color more. And should we in fact prioritize those actions because of historical and, frankly, present-day injustices?” he said. “That is a highly contentious arena right now, but it’s hard to ignore, given what’s going on.”

Progress

The gap between soot exposure levels of white and nonwhite Americans has actually been shrinking in recent years.

A paper released in January that used satellite-based measurements to track air quality across the country found that disparities between soot levels in predominantly minority and white areas fell by nearly two-thirds between 2000 and 2015.

Reed Walker, an associate professor of economics at the University of California, Berkeley, and one of the authors of the study, said this was partly due to white people moving into cities and minorities heading to the suburbs.

But a much larger part of the story, he said, had to do with the Clean Air Act.

Particulate matter standards set under the law — current ones were implemented in 2005 — require counties that fail to meet National Ambient Air Quality Standards to take aggressive action to reach attainment.

“It just so happens that African Americans are overrepresented in these dirty areas,” Walker said, noting that in the last 15 years, counties with large minority populations have reduced particulate matter more than predominantly white counties.

Still, research shows that soot can cause illness and death at levels below federal air quality standards. This year, EPA declined to tighten the standard despite public health advocates’ warnings that an update is long overdue.

And the proposed cost-benefit rule seems to be directed at making tougher rules harder to promulgate in the future.

“Any failure to tighten the standard is going to continue the disproportionate exposures faced by individuals in those communities,” Walker said.

Below you will find the 29-minute video of Council deliberations leading to passage of the resolution.  Changes in the proposed resolution include:

    • Mayor Patterson re-inserted a strong paragraph on Benicia’s Climate Action Plan, goals and past efforts: “WHEREAS, as outlined in the Benicia Climate Action Plan it is the goal of the City to reduce greenhouse gas emissions, create green jobs, and prepare for the impacts of climate change on public health, infrastructure, the economy, ecosystems, and public spaces in our community, and Benicia has repeatedly upheld this mission through resolutions to protect the environment and divest from extractive industries…”
    • Vice Mayor Strawbridge and Councilmember Largaespada added several amendments.  One promotes Benicia business interests and the interests of other Solano County cities,  and two others soften the aspirational language: “actively reduce” rather than “end” Citywide greenhouse gas emissions; and transition to electric vehicles “where economically feasible.”
    • Mayor Patterson and Councilmember Young expressed mild discomfort over some of the amendments, but all suggestions were accepted and the resolution passed unanimously.

US critics of stay-at-home orders tied to fossil fuel funding

ExxonMobil, Koch and Mercer family are past funders of critics of stay-at-home orders as fossil fuel industry struggles amid lockdowns

Dozens of individuals and groups urging states to reopen amid the Covid-19 pandemic have historical financial ties to coal and oil and gas companies and conservative billionaires who have invested in climate disinformation.

Past funders of the current critics of stay-at-home orders include the bankrupt coal company Murray Energy and oil giant ExxonMobil, as well as Koch and Mercer family foundations, according to DeSmog, a group that tracks the money behind anti-climate-action campaigns.

Some of the contributions tallied are recent and others are at least five years old or older. ExxonMobil, for example, had broken ties with two of the groups in this story by 2006. There is no evidence that these companies and foundations are funding ongoing campaigns to reopen businesses.

But Brendan DeMelle, executive director of DeSmog, said the “information echo chamber” of interests downplaying both the climate crisis and the pandemic would not be what it is today without fossil fuel funding.

“While we don’t have direct evidence of specific grant money going for Covid denial, none of these operations would exist without their support over the years,” DeMelle said.

Donations to not-for-profit thinktanks are nearly impossible to track in real time because of a lag in reporting. It could take years to reveal which interests are currently funneling money to the groups helping to organize and expand shutdown protests. Even then, much of the funds could be hidden, donated anonymously through third-party not-for-profits, DeMelle said.

But DeSmog’s research shows many of the calls to end stay-at-home orders are coming from people associated with a wide-ranging network of organizations that together seek to limit the power of government and thwart intervention in business. That web of thinktanks was built years ago on contributions from the fossil fuel industry and conservative philanthropists.

Now, the fossil fuel industry is struggling amid government lockdowns aimed at preventing the spread of the coronavirus, and allowing people to move freely and return to work would help the sector by boosting energy demand.

As Donald Trump has advocated for a quicker reopening, often against the recommendations of his expert advisers, Republican voters’ views on how to handle the coronavirus have shifted substantially.

Just 43% say it is more important for the government to address the spread of the virus than the economy, down from 65% about a month ago. 

Trump’s calls for a quicker return to regular life have grown in popularity as they have been echoed throughout conservative media, often backed by thinktanks connected to the oil and coal industries.

In Wisconsin, where people have protested against a stay-at-home order, the Koch-backed group Americans for Prosperity (AFP) filed an amicus brief with the state supreme court challenging the authority of the governor and the health department to continue to require people to stay home without sign-off from the Republican-controlled legislature. The court last week struck down the state’s order, calling it a “vast seizure of power”.

Charles Koch, the 20th-richest billionaire in the world, runs Koch Industries, which is involved in oil operations and energy-intensive industries. He and his late brother, David, have funded a network of conservative thinktanks.

Phil Kerpen, a Koch political operative, has argued that lockdowns are “unscientific”, and “medieval” and don’t save lives. Kerpen is president of American Commitment, a group that through 2016 has received at least $6.9m from Freedom Partners, which is partially funded by the Kochs, according to DeSmog. He was previously vice-president of AFP until 2012.

An AFP spokesman said the group has been “unambiguous” in its position that “the choice between full shutdown and immediately opening everything is a false choice”, and that it is working with officials and businesses to develop standards to “safely reopen the economy without jeopardizing public health”.

“Past grants do not define our position on reopening the economy – to suggest otherwise is disingenuous,” the AFP spokesman said. “None of the grants referenced have anything to do with stay-at-home orders and some of them were made many years ago.”

The Washington Post has reported that the Convention of States, a project launched in 2015 with money from the family foundation of the billionaire Republican donor Robert Mercer, has helped to coordinate activism against the stay-at-home orders around the country.

The conservative thinktank the Manhattan Institute – which over the years has taken at least $1m from ExxonMobil through 2018, according to the environment group Greenpeace USA, as well as $3.2m from Koch foundations and $2.2m from the Mercer Family Foundation – has published commentary questioning the value of shutdowns.

Brian Riedl, writing in the Manhattan Institute publication City Journal, called the shutdowns unsustainable, saying just a few months “will cost the government and the economy trillions of dollars”.

An ExxonMobil spokesman, Casey Norton, noted the company had not contributed to most of the groups in this story for years and said it was not pushing to lift stay-at-home orders.

“We continually evaluate our memberships and participation in organizations, and we do not contribute to organizations if we are not actively involved,” Norton said.

“As for return to work, our focus right now is on ensuring the safety and health of our entire workforce and to do our part to limit the spread of the novel coronavirus in the community.”

The Daily Caller, a news organization that has received $3.5m through 2017 from Koch foundations through its non-profit, has run articles suggesting Democrats want to kill the economy to keep Trump from getting re-elected.

“The mainstream media, which works for the Democrat party, wanted us shut down more, and for longer,” said opinion contributor Ron Hart.

Often, funding by the fossil fuel industry is less obvious and more difficult to follow. Bits and pieces of financial connections are revealed in regulatory and court filings, but many are hidden behind dark money groups.

One shutdown critic, author Alex Epstein, runs the for-profit thinktank the Center for Industrial Progress. Epstein has said his clients include the president of the Kentucky Coal Association and thecoaltruth.com, a project DeSmog links to employees of Alliance Coal.

Epstein in a podcast compared the coronavirus to the seasonal flu and said “the purpose of the government is not to extend people’s lives. It’s to leave us free to live our lives as we judge best.”

Epstein told the Guardian his clients pay him “solely to advise them on *their* messaging”, and that “none of them have any influence on what I say publicly, on this or any other issue”.

Other critics of reopening are connected with the Competitive Enterprise Institute, the American Council for Capital Formation and the Heartland Institute.

Chris Horner, a former fellow at CEI, in an op-ed in the Washington Times in March warned that “the current ‘coronavirus economy’ could become legally mandated, with no recovery permitted but only worsening, in the name of climate change”. Horner received funding from the coal company Alpha Natural Resources, according to a bankruptcy filing.

Joel Zinberg, of CEI, and Richard Rahn – who is chairman of the Institute for Global Economic Growth and board member of ACCF – have also criticized stay-at-home orders. Rahn has called Covid-19 the “Chinese Communist party virus”.

CEI received $2.1m from ExxonMobil through 2005 and has taken $200,000 from Murray Energy more recently. ACCF has gotten $1.8m from ExxonMobil through 2015 and $600,000 from Koch groups through 2015.

ACCF as an organization “has taken no position on the stay-at-home orders or any prospective timeline for reopening the economy”, said the group’s CEO, Mark Bloomfield.

The Heartland Institute, which denies the severity of anthropogenic climate change, has received $6.7m through 2017 from the Mercer Family Foundation, as well as $130,000 from coal company Murray Energy. The group received $25,000 from a Koch foundation for one specific project and got money from ExxonMobil until 2006.

A Heartland spokesman, Jim Lakely, has argued “leftists” are “stoking Covid-19 panic” and has called lockdown orders unconstitutional.

“What’s the time limit on being labeled ‘Koch-funded’ or ‘Exxon-funded’? A decade? Two? Also, who cares?” Lakely said. He did not respond to questions about Mercer funding.

Train carrying crude oil and propane derails in western NY

East Aurora train contained flammable, explosive materials – Rail company refuses to divulge cargo

BUFFALO, N.Y. (WKBW) — Since Monday’s train derailment in East Aurora sparked fears of “bomb trains” carrying toxic substances, the Genesee & Wyoming Railroad has sought to downplay the danger of the crash, stressing that no one was hurt and damage was limited.

But 7 Eyewitness News has learned that despite the company’s refusal to provide a complete accounting of the train’s contents, dozens of railcars that were pulled by the derailed engine were filled with flammable and explosive materials.

And since the railroad opened back up Thursday, even more cars carrying crude oil and propane have quietly rolled through.

“This was really a best-case scenario,” said East Aurora Fire Chief Roger LeBlanc said of Monday’s derailment. “It should have flopped onto Main Street. There should be a crater in the village.”

LeBlanc said the train conductor soon after the derailment approached him with a manifest of the cargo.

“He showed it to me,” LeBlanc said. “He didn’t give it to me. He had a death grip on that thing.”

7 Eyewitness News has learned that despite a railroad company’s refusal to provide a complete accounting of the train’s contents, dozens of railcars that were pulled by the derailed engine were filled with flammable and explosive materials.

The fire chief said the conductor told him the cargo included 19 propane tankers, between 8 to 10 tankers of crude oil — which has caused devastating explosions like the 2013 derailment in Quebec, Canada that killed 47 people — and at least one tanker of butane.

The conductor had “great concern” on his face when mentioning the propane, LeBlanc said.

“I’m thinking, ‘Oh my God, this thing’s gonna go,’” LeBlanc said, adding that thankfully, there were no explosions because the conductor said multiple cars behind the derailed engine were empty.

A railroad spokesman on Thursday said 66 railcars were empty, including 15 of the 17 derailed cars. But 32 railcars were “loaded with a variety of commodities,” according to Michael E. Williams, vice president of corporate communications for Genesee & Wyoming Railroad Services, which runs the Buffalo & Pittsburgh rail line.

Williams repeatedly declined to answer questions about the contents of the 32 cars, other than to say that two of the cars were carrying lumber.

“Railroads do not share train manifests with the general public for security reasons,” Williams wrote in an email. “The train was carrying what was properly tendered to the railroad to transport under its common-carrier obligation. It is safe for your viewers to assume that the loaded cars in the train were carrying commodities that are integral to modern life.”

Williams stated that the train’s manifest was provided “to the incident commander on site, per standard protocol,” but both LeBlanc and Police Chief Shane Krieger said they did not receive copies of the manifest.

First responders like LeBlanc and Krieger said they came away from the experience thankful that East Aurora, with many wood-frame buildings and 19th century historic structures, did not have to deal with a major explosion.

“If it would have hit any of the buildings or the restaurant, it could have been an ignition point,” LeBlanc said. “There’s a lot of things that could have happened.”

Williams stressed that railroads are “by far the safest means of ground freight transportation – much safer than trucks, which are the alternative.”

Still, the transport of flammable cargo appears to be occurring on a regular basis in East Aurora and other small towns lining the tracks from Salamanca to Buffalo.

Just after 11 p.m. Thursday — hours after Genesee & Wyoming announced the re-opening of the track — 7 Eyewitness News witnessed a string of train cars roll above Main Street through the village.

The tanker cars carried the red hazardous material placards for propane and crude oil.
