Before I start, here’s a reminder that ON MARCH 5 AT 6 PM THE BENICIA CITY COUNCIL WILL HEAR A BRIEF REPORT ON A COUNCIL SUBCOMMITTEE’S PROGRESS IN CRAFTING AN INDUSTRIAL SAFETY ORDINANCE (ISO) FOR BENICIA. THIS PRESENTS A CHANCE TO SPEAK OUT IN FAVOR OF A STRONG ISO THAT WILL ENABLE THE CITY TO BETTER PREVENT, MONITOR AND ADDRESS DANGEROUS EVENTS AT TEXAS-BASED VALERO’S REFINERY HERE, RANGING FROM POISONS IN THE AIR TO POTENTIAL EXPLOSIONS AT THE FACILITY. By the way, a big thanks to Benicia Fire Chief Josh Chadwick and our Fire Department for their efforts to alert Benicians about Saturday’s incident at the Valero Refinery, particularly since it resulted in the release of the dangerous neurotoxin Hydrogen Sulfide (H2S) into our air. While, as suggested below, the incident and the reporting more than ever demonstrate the need for an ISO, those efforts are nonetheless appreciated.

Thanks, too, to the Valero personnel who labored to clean up that mess, perhaps at risk to their own health. Of course, this does not let the Valero refinery or the corporation’s Texas headquarters off the hook for this dangerous event  – or for many other accidents and violations. But the workers who work to mitigate such harm merit praise. In fact, an ISO could benefit them as well as the rest of us.

So far, based on some very good reporting by Benicia Herald editor Galen Kusic and other sources, we have some initial knowledge about what happened. But dozens of questions remain.

For now, I’ll just address a few questions mainly raised by Kusic’s February 28 article and data shared by the Benicia Community Air Monitoring Program (BCAMP), a local non-profit that (as its website states) “has been established to monitor local air quality in real-time, operate a website, and provide education on health as related to air quality.” (For more information on BCAMP, here’s the group’s site: bcamp.argos-scientific.com).

  1. As Kusic’s article states, “It isn’t clear as to why alerts went out at 7:40 a.m. when H2S was discovered on Tank 1738 at 6:08 a.m. and H2S was detected in the air as early as 4:30 a.m.” In fact, as noted by BCAMP, Valero’s own monitoring system indicated alarming levels of H2S in the air as early as 4 a.m. And BCAMP data indicates a spike in H2S hours earlier than that.

So why the delay in alerting the public?

  1. What’s more, the current (and quite weak) City of Benicia – Valero Cooperation Agreement incorporates the requirement that the Benicia Fire Department must be notified immediately if there is a release or a threatened release of a hazardous substance that could harm people’s health. It certainly does not sound like Valero provided immediate notification – which to my simple mind, means as soon as possible.

Why was that the case?

  1. As stated in the Herald article, when asked about the delay, “Valero Benicia Refinery Director of Community Relations and Government Affairs Paul Adler responded, ‘In order to answer your first question, I suggest that you review the Public Information website along with that policy which defines the requirements of notifications.’”

I don’t know about you, but I’d prefer a straightforward answer to a straightforward inquiry about an urgent public health matter, rather than being shunted off to a website.

Why not provide that?

  1. Did the first information the Fire Department received about the incident come from the public reporting the “rotten eggs” odor of H2S in the air or from Valero? And if not Valero, why was that the case?

5.  BCAMP data reported an alarming spike in H2S in the air during the late afternoon on Saturday, supposedly after the worst of the incident had passed. Were we safe at that time?

I’ll note that I know one individual whose asthma was apparently greatly aggravated by this incident (though this is not a matter of medical certainty) and two others who reported feeling ill, all on the west side of town. Not scientific proof of danger, but not something to be ignored.

Again, these are just a few questions prompted by Valero’s release of H2S on Saturday. Coming on top of many Valero violations and other incidents, they point to the need for a far stronger way of protecting the safety and health of our kids, our seniors and our entire community. We can start by showing support for an ISO at the City Council meeting on March 5.

On February 7, 2024 the Benicia Herald printed an Op-Ed from the Benicia Historical Society on the proposed building height increase in Downtown Benicia. The Benicia Planning Commission on February 8, 2024 considered amending the development standards in the Town Core Zone in the Downtown Mixed Use Master Plan (DMUMP) to allow a height of up to four stories (50 feet) with a use permit. The Planning Commission did not adopt the proposed amendment and recommended that the City Council direct staff to conduct public outreach on this important issue.

We would like to thank the dozens of people who attended the meeting in person and Zoom and spoke passionately on this issue. Your attendance and comments, along with the comments of the Historical Society made a difference in the outcome of the proposed height increase. We would also like to thank the Planning Commissioners for listening to the public and the concerns that were raised, and their thoughtful deliberation of the issue. It was a testament to public participation.

If you attended any of the Q&A meetings on the city’s financial challenges, you would have heard that increasing the height limit in our Historic Downtown to four stories would allow for hotel development.  At the Q&A session on February 27, at the Southampton Fire Station, Mayor Young reiterated that a four story hotel with a roof top bar was proposed for the corner of First and East D St. (the Avant Garden site). He further stated that additional hotels could be built on First Street similar to the hotel boom in American Canyon along Highway 29.

What hasn’t been discussed or presented is that the increase in the height limit to four stories (from 2.5 and 3 for housing opportunity sites) would apply to all buildings and vacant parcels in the Town Core Zone. Once approved, the development standards in the Town Core Zone to allow for four stories (50 feet) with a use permit will cause property values to rise and place economic pressure to redevelop, increasing the potential for demolition of existing buildings including historic buildings. It would also allow for four story buildings adjacent to residential homes on the side streets.

The Historical Society is concerned that the character and historic fabric of our Historic Downtown will unravel as development occurs with higher building heights. Our history is the city’s richest asset; it sets us apart from other Solano County cities, and downtown entices visitors to its small scale and walkability. Visit California, which markets California in partnership with the state’s travel industry, states this about Benicia. “As one of the oldest cities in California—and the third city to have served as the state’s capital, from 1853–54—Benicia is filled with vintage architecture and historic landmarks that date back to the Gold Rush, the Wild West, and the completion of the Transcontinental Railroad.” Our historic downtown matters and is our best marketing tool. If First Street is lined with multiple four story buildings overwhelming historic structures and disrupting the continuity of our small scale walkable downtown, who will be staying in the hotels?

On Tuesday, March 5, the Benicia City Council will hold a public hearing to adopt the resolution amending the height limit of the Town Core in the DMUMP allowing for four story (50 ft.) buildings on every parcel along First Street south of K Street. The staff report on this item mentions the Planning Commission recommendation to conduct further public outreach, but fails to propose any action on the recommendation.

We are all aware at this point of the financial issues of the city. We are aware that change will occur, as it always has, but what we need is thoughtful consideration of how change is allowed in our downtown which still reflects much of our history left by earlier generations. We are in favor of compatible development that follows existing zoning and complies with the Downtown Historic Conservation Plan. We need to value the historic integrity of downtown and be assured that our ability to market and attract visitors to our stores and restaurants will not be diminished. This can only happen with additional public involvement.

1000 Friends Protecting Historic Benicia filed our Opening Brief this week to protect the nationally important history of Jefferson Ridge Officers Row in Benicia Historic Arsenal.

You will see that the proponents of two housing developments are attempting to build 138 units of housing in buildings so huge and so close to the historic houses that in some places they could stand higher than the historic buildings.  They would put dozens of parked vehicles across the streets, would destroy the views to and from the historic area, and so would destroy the history and structure of this most important Benicia place.

This historic area is a gem that would be coveted by any other city, for its tourist attraction, its economic benefits, and its unique historic status.  Logically that history should be strongly protected by Benicia’s city government.   But as you will see, it appears the City failed to take actions that could better inform the public, better inform city decisions, and thus could better protect these sites.  We allege that the city attempted short-cuts, ignoring city ordinances and state laws, including its refusal to prepare an Environmental Impact Report.

Officers Row has been placed on the National Register of Historic Places, confirming its historic value for the citizens of all the states, not just for Benicia, and not just for California.  That National Register status will almost certainly be withdrawn if these projects proceed.  Please help spread the word about this threat and join the 1000 Friends in their event celebrating the connection of Abraham Lincoln to Benicia Arsenal, scheduled for April 19th.  Watch for our publicity.

And please remember that if the history of Benicia Arsenal is lost, we have made Benicia a less worthy place for the entire nation and for all our nation’s descendants, not just for Benicia.   And while housing laws and priorities can and do frequently change, and while housing can be built in dozens of places in the city, if the historic Officers Row is lost to these two projects, that historic Benicia site cannot ever be recovered. Once its gone, its gone forever.

I will be voting for Jackie Elward for District 3 state senator because what I see of the overall records and positions of the candidates, hers adds up to show me that she’s the most progressive candidate.  On environmental issues, Valero’s targeting her highlights the progressivity.  Along with other oil companies, the toxic polluter is co-financing a million-dollar televised smear campaign against Elward, distinguishing her from all her opponents.  She also has the endorsement of California Environmental Voters, a state environment group that views what legislators can do from the perspective of the state capitol.

On local planning, a KQED piece showed Elward as our only state senate candidate to unequivocally call out California Forever as an, “existential threat” to neighboring communities.  On workers’ rights, she has the support of the Working Families Party as well as the California Labor Federation.  The federation’s top agenda item is helping California workers gain the fruits of collective bargaining.  Among district 3 state senate candidates, they’ve assessed Elward as their best bet for support in this work.

Elward’s accomplishments as Rohnert Park mayor provides a track record of progressivity on affordable housing and police reform.  Rohnert Park was successful in gaining Project Homekey funds to build 60 units of low-income housing.  She also oversaw that local police received training against bias and for sensitivity and de-escalation.

Jackie Elward not only brings the perspective of a historically black college graduate, the compassion of an immigrant organizing relief for homeless children in Kinshasa where she grew up, she brings an environmental, local planning, labor, housing, and police reform record that make her stand out as a state senate candidate who would well serve progressive policymaking in the capitol.
