Stop Fooling CAYesterday we celebrated the 45th anniversary of Earth Day.

And you can’t think of the earth without thinking about the way Big Oil’s business model is based on exploiting resources that belong to us all.

Case in point: Kern County’s depleting oil fields is a symptom of ecological overshooting. And Big Oil adds insult to injury when they contaminate our precious water supply with their toxic waste.
Perhaps actor Ed Begley, Jr., summed it up best, “I don’t understand why when we destroy something created by man we call it vandalism, but when we destroy something created by nature we call it progress.”

Standing Against Big Oil’s Crude-by-Rail Push

Franz MatznerOver the last few days, we’ve seen a series of grassroots victories that prove we’re not stuck with Big Oil’s plan to foist dangerous fossil fuel infrastructure on communities across the country.

Just last week, TransCanada (of Keystone XL infamy) confirmed that it is dropping a marine crude oil export terminal in Quebec due to environmental concerns, a move that will delay the target opening date for the massive Energy East tar sands pipeline by at least two years.

Across the continent, Big Oil was also dealt two blows against its attempts to import extreme crudes into California by rail. In the face of strong community opposition, midstream oil company WesPac has abandoned its plan to build a rail terminal that would have brought dirty crude oil into the San Francisco Bay Area.

A few years ago, WesPac proposed a rail and marine terminal that would transport 242,000 barrels per day of crude oil–nearly a third of the capacity of Keystone XL–through Pittsburg, CA, a small community of 60,000 residents and then on to Bay Area refineries. The problems with WesPac’s proposal are myriad: it would expose Pittsburg’s population, largely communities of color and low-income communities, to the risks of exploding trains and increased air pollution, and it would require a massive investment in fossil fuel infrastructure at a time when we should be moving toward clean energy solutions.

The project was so ill-conceived that, following comments by NRDC and others, the California Attorney General wrote a letter finding “significant legal problems” with the project’s environmental review documents. Accordingly, the city decided to put the project on hold and revisit its environmental review process. That’s where things stood for over a year, until last week, when WesPac announced that it would drop the rail terminal aspect of the project altogether.

As community and environmental advocates have repeatedly pointed out, oil trains pose serious risks–risks that were highlighted by a series of fiery accidents over the last few weeks. (Notably, some recent accidents have involved Canadian tar sands crude, in addition to a bevy of dangerous mishaps involving North Dakota’s Bakken crude, which has long been known to be highly volatile and has been the culprit in most oil train disasters.)

This win in Pittsburg follows a recent decision by another Bay Area city, Benicia, to withdraw and revise its environmental review documents for a proposed crude-by-rail terminal at Valero’s Benicia refinery. As NRDC and others, including the California Attorney General, pointed out in legal comments, the terminal would pose serious safety and health threats to Benicia and to residents along the rail line. Momentum is also building against another crude-by-rail proposal up for consideration further south in San Luis Obispo County.

These victories show the power of local communities to stop Big Oil in its tracks.

The battle, however, is far from over: Valero is still trying to push forward with its rail terminal, and WesPac’s proposed marine terminal would have significant impacts on the fragile San Francisco Bay Delta and nearby residents. In fact, WesPac’s plans may still include the renovation of long-dormant storage tanks to stockpile large volumes of volatile crude oil, even though those tanks are literally a stone’s throw from homes, churches, and a school.

Some critics have used the boom in crude oil trains as evidence that we should allow more pipelines. They offer the false choice of risk from pipelines or risk from oil trains. The truth is more sinister. Big Oil wants more of both. Pipelines and rail serve different geographic areas and often carry different types of oil. The problem is that both forms of transportation have risks, and both bring fossil fuels perilously close to our communities. Clean energy investments do the opposite: they eliminate the dangerous risks of spills and bomb trains, while cutting carbon pollution.

It’s time our elected leaders follow the example of communities across the country by saying “no” to Big Oil and “yes” to clean solutions that accelerate fuel efficiency, electric vehicles, clean fuels, and renewable energy such as solar and wind.

Residents should demand clean air

As host to one of the biggest petroleum refineries in California, Richmond needs its residents to remain vigilant. The Bay Area Air Quality Management District is considering new refinery regulations that would require Chevron to disclose and measure the toxic emissions of its Richmond refinery and reduce them if they rise above stipulated limits, as has often occurred in the past. The air district held public workshops last week in Richmond, Martinez, Benicia and San Francisco. I urge concerned citizens to submit additional comments to the district before its March 27 deadline.

We need citizens to stand up because Big Oil doesn’t give up. The oil industry is spending tens of millions of dollars to derail our state’s landmark climate-change law, AB32. And it’s using some of the same sneaky tactics that Chevron deployed against me when I ran for Richmond City Council. Telling the truth is too risky, I guess: The vast majority of Californians want clean air and a livable climate.

Chevron, the oil giant that ranks by assets as the 18th biggest company in the world according to Forbes, spent some $3 million on advertising against me and other candidates when we ran in November’s election.

Despite being outspent by 20 to 1, my team and I fought back with a grassroots campaign that showed how people power still can triumph over big money. And I can tell you, standing up to a bully feels good, especially when you win.

The industry’s battle plan was revealed in a slide deck prepared by its lobbying arm, the Western States Petroleum Association, which was leaked to Bloomberg BusinessWeek. Instead of engaging in open public debate about clean energy and climate progress, the association has created and funded front groups that appear to consist of ordinary people — who just happen to share the industry’s point of view.

Oil companies also invoked the bogeyman of higher taxes. “Stop the Hidden Gas Tax” proclaimed countless billboards, TV and radio ads for weeks before Jan. 1, 2015, the day transportation fuels came under the AB32 emissions cap.

There was no hidden tax. Nor has the industry’s broader claim — that AB32 would weaken California’s economy and drive away businesses — proved true. In fact, California’s economy has grown since AB32 began. We have the largest advanced energy industry in the United States, employing more than 430,000 workers, and the Golden State’s manufacturing sector leads the nation in total output. The U.S. Bureau of Labor Statistics announced that California vaulted over Texas as the state with the largest job growth during the past year. All this growth — and our per capita carbon emissions have dropped 17 percent since 1990.

To be sure, this increased prosperity still hasn’t reached all Californians. But the solution is not to gut our clean air laws; it is to accelerate our development of renewable energy sources and improved energy efficiency — labor-intensive activities that employ more people than drilling for oil and gas.

We need to keep shining a light on the activities of opponents to clean energy.

As a resident and public official in Richmond, I care about petroleum use for another reason as well. In 2012, an explosion at Chevron’s Richmond refinery led some 15,000 people to seek hospital treatment. The refinery’s typical emissions also take a terrible toll, as I witnessed during my 18 years as an elementary school teacher. So many students were afflicted with asthma that our school founded an Asthma Club to help kids, teachers and parents cope. That should not be.

Californians deserve clean air, a stable climate and public policy that prioritizes those goals. We should strengthen, not weaken, AB32. Tell the air district that.

A U.S. federal court has ordered a halt in proceedings until May in a case centering around oil-by-rail tankers pitting the Sierra Club and ForestEthics against the U.S. Department of Transportation (DOT). As a result, potentially explosive DOT-111 oil tank cars, dubbed “bomb trains” by activists, can continue to roll through towns and cities across the U.S. indefinitely.  

“The briefing schedule previously established by the court is vacated,” wrote Chris Goelz, a mediator for the U.S. Court of Appeals for the Ninth Circuit. “This appeal is stayed until May 12, 2015, or pending publication in the Federal Register of the final tank car standards and phase out of DOT-111 tank cars, whichever occurs first.”

Filing its initial petition for review on December 2, the Sierra Club/ForestEthics lawsuit had barely gotten off the ground before being delayed.

That initial petition called for a judicial review of the DOT‘s denial of a July 15, 2014 Petition to Issue an Emergency Order Prohibiting the Shipment of Bakken Crude Oil in Unsafe Tank Cars written by EarthJustice on behalf of the two groups. On November 7, DOT denied Earthjustice’s petition, leading the groups to file the lawsuit.

Initially, DOT told the public it would release its draft updated oil-by-rail regulations by March 31, but now will wait until May 12 to do so. As reported by The Journal News, the delay came in the aftermath of pressure from Big Oil and Big Rail.

“In a joint filing, the Association of American Railroads (AAR) and the American Petroleum Institute (API) contend the tank car industry doesn’t have the capacity to retrofit the estimated 143,000 tank cars that would need to be modernized to meet the new specifications,” wrote The Journal News. “Nor can manufacturers build new tank cars fast enough, they say.”

The “bomb trains” carrying volatile crude oil obtained via hydraulic fracturing (“fracking”) from the Bakken Shale, then, will continue to roll unimpeded for the foreseeable future. They will do so in the same DOT-111 rail cars that put the fracked oil-by-rail safety issue on the map to begin with — the July 2013 deadly explosion in Lac-Mégantic, Quebec.

And as DeSmogBlog has reported, industry promises to phase-out DOT-111s on a voluntary basis have rung hollow.

“The courts and the administration are dragging their feet on common sense safety steps that will take the most dangerous oil tanker cars off the tracks, slow down these trains, and help emergency responders prepare for accidents,” Eddie Scher, communications director for ForestEthics, told DeSmogBlog.

“We filed our lawsuit because the DOT is not moving fast enough on safety. This court’s decision ignored the imminent threat to the 25 million Americans who live in the blast zone and the communities around the nation that don’t have the luxury of waiting for DOT and the rail and oil industry lobbyists to finish their rule.”
