Top 10 Questions About Oil Trains: Industry Lobbies for Weak Rules While Derailment Fire Rages

On Friday, March 6, while an oil train explosion in Illinois was still sending flames and black smoke into the air, railroad agents were in Washington, DC lobbying to weaken new train safety standards. Safer brakes are “extremely costly…” they told White House officials, and explained in great detail why speed limits are impractical. Like the auto industry resisting seatbelts, the rail industry is on the wrong track when it comes to safety.

In the last month, there have been six derailments of crude oil trains in the U.S. and Canada — three of them ignited, sending flames and mushroom clouds hundreds of feet into the air. Luckily, these were in relatively remote locations and no one was killed.

These disasters are not an aberration — oil train traffic is skyrocketing, which means more derailments and more explosions. The oil and rail industries hope to increase further the amount of crude oil barreling down the tracks in the coming years. Before that happens, ForestEthics has some questions we’d like to see the Obama administration ask the army of lobbyists who are trying to push the bar on safety even lower than it already is:

When did trains start exploding?
Rail transportation of crude oil is growing rapidly and dangerously — from fewer than 10,000 carloads in 2008 to nearly half a million in 2014 — for two reasons: Bakken oil from North Dakota and Canadian tar sands. The North American boom means oil companies are trying to tails and mine more of this extreme oil, crude that is high in carbon, difficult and expensive to produce, and dangerous to transport.

Are cities and towns with rail lines safe?
With the exception of Capitol Hill (the rail industry seems to be sparing Washington, DC) most routing is done specifically throughout cities and towns. No, the oil and rail industries are probably not purposely targeting us, it’s just that the rails in populated places tend to be better maintained and rated for heavier cargoes. The sane thing to do would be to stop hauling crude oil if it can’t be transported safely. A far distant next best is to make these trains as safe as possible and require rerouting around cities and water supplies.

What is the government doing?
Not nearly enough. While 100-plus car trains full of an explosive crude roll through our towns, the U.S. government is barely moving, bogged down by nearly 100 of Washington’s most expensive K-Street lobbyists. In fall 2014, ForestEthics, Earthjustice, and the Sierra Club sued the Department of Transportation to speed up new safety standards on oil trains. We called the trains an imminent danger to public safety. The federal government responded by once again delaying their decision on new rules that have been in the works for years.

What is the slowest speed at which an oil explosion could happen?
An oil tank car can catch fire and explode in an accident at zero miles per hour. Assuming a slightly raised rail bed, an oil car that tips over while standing still (this can and has happened on poorly maintained rails) will strike the ground going approximately 16 miles per hour — more than fast enough to breach the tank, spark, and ignite if it hits a rock, a curb, any hard protrusion.

Do firefighters know when and where oil trains are moving?
First responders do not know when, where, how much oil, and what kind is coming through their town. The US Department of Transportation ordered that railroads and oil companies make this information public. But only for trains carrying more than a million gallons of Bakken crude, and even this information is not being made public on a consistent basis.

How do you extinguish oil train fire?
You don’t put out an oil train fire; nobody does. Oil fires require specialized foam, which fire departments do not have in nearly sufficient supply to fight the fire from even a single 30,000 gallon tank car. All firefighters can do is evacuate those in danger, move outside the one mile blast zone and let the fire burn out, which can take days. In Illinois, firefighters unloaded their equipment to fight an oil train fire, realized the danger and left behind $10,000 in equipment getting out of harm’s way. You can prevent these fires by banning oil trains — but you can’t fight these fires once they happen.

The older oil cars are definitely unsafe, what about the newer ones?
The antiquated DOT-111 tank cars make up 80 percent of the fleet in the U.S. — U.S. rail safety officials first called them “inadequate” to haul crude oil more than 20 years ago. The jury is now in on the newer CPC-1232 tank cars and they are not much safer. The derailments and explosions in West Virginia and Illinois were 1232s traveling at or below the speed limit. In fact, the former head of the federal rail safety agency said in a radio interview that the recent derailments and fires were “the last nail in the coffin” for the CPC-1232 as an alternative to DOT-111 for oil transport.

We know that Bakken crude explodes; does tar sands explode?
Ordinarily it might not, but to move tar sands by rail (or pipeline for that matter) you have to mix in highly flammable, toxic diluents (light petroleum products like propane.) So if it’s on a train or in a pipeline the flashpoint for tar sands crude is lower than for Bakken oil. The oil train explosion on February 16, 2015 in Ontario, Canada occurred in -40 degrees F weather — proving that this stuff can ignite even in arctic cold. So not only is tar sands the dirtiest oil on Earth, but also it may well be the most dangerous too.

Do I live in the Blast Zone?

What’s the solution?
The solution is to ban oil trains. If you can’t do something safely, you shouldn’t do it at all. This cargo is too dangerous to our families, our cities, our drinking water, our wildlife and our climate. The extreme crude carried on trains is only a tiny fraction of the oil we use each day as a nation. So while we transition our economy to clean energy and get beyond all oil, we should leave this extreme oil from Alberta and North Dakota in the ground.

To the Editor of The Benicia Herald, and published there on Mar. 12:

Many thanks to Dr. James Egan for his thoughtful letter of March 10, “Timely decision on crude by rail warranted: Deny Valero’s application.”  His local voice amplifies a growing national sentiment, that crude by rail is simply too dangerous at this time.

As Mollie Matteson, a senior scientist with the Center for Biological Diversity wrote this week, “Before one more derailment, fire, oil spill and one more life lost, we need a moratorium on oil trains and we need it now.  The oil and railroad industries are playing Russian roulette with people’s lives and our environment, and the Obama administration needs to put a stop to it.”

Even as officials in Washington DC are dealing with this crisis (much too slowly), Benicia has a powerful role to play.  We can do our part by denying Valero’s permit.  In fact, Valero can do its part – by acknowledging the horrendous piling up of recent derailments and explosions, the failing infrastructure and the unsafe tank cars, and withdrawing their application for the time being.  That would show real leadership in the oil industry.

Dr. Egan covered most of the issues extremely well, but didn’t mention that the tar-sands crude produced in Alberta Canada has proven volatile on trains as well, with two recent derailments resulting in spills and huge fires within 23 miles of each other outside Gogama, Ontario.  Tar-sands crude starts out as a sticky thick bitumen, and must be diluted with volatile and toxic fluids in order to be pumped into rail cars, a mix that can explode and burn just as Bakken crude explodes and burns when a tank car is ruptured.  The first train exploded outside Gogama on Feb. 14, and the second on March 7.  Those poor folks in Gogama are holding their breath, as the track runs right through town, and the First Nation people who live even closer to the derailments are in shock.  Valero has admitted that it wants permission to ship Bakken crude and tar-sands dilbit by train.

In addition to those two crashes in Ontario, we have seen conflagrations in West Virginia on Feb. 16 and in Illinois on Mar. 5.  You can’t have missed those.  Four “bomb train” explosions in three weeks!

In January 2014, I started a personal blog to keep an eye on crude by rail in the news.  At first, there wasn’t much beyond our local efforts to stop Valero’s proposal “in its tracks.”  Increasingly, the regional and national media have awakened to the health and safety issues that can destroy communities along the rails.  You can’t imagine the absolute flood of media coverage this last three weeks.  I can’t keep up anymore.  I’m picking and choosing which stories to repost [at BeniciaIndependent.com].

The economy of Benicia may very well take a tumble if Valero’s proposal is permitted: housing values may fall and businesses may look to safer locations and relocate.  According to Valero’s own analysis, the few jobs created by introducing oil trains here will be taken up by residents of other Bay Area towns.  New hires will spend most of their money where they live, not here in Benicia.

We need to take the long view – Valero can continue to process crude oil brought in on ships.  The multi-billion dollar industry will weather this minor setback.

Center for Biological DiversityGOGAMA, Ont.— An oil train derailed and caught fire early this morning in Ontario near the town of Gogama, the second such incident in Ontario in three weeks, and the fourth oil train wreck in North America in the same time period. Since Feb. 14, there have also been fiery oil train derailments in West Virginia and Illinois. The Illinois wreck occurred just two days ago, and the fire from that incident is still burning.

“Before one more derailment, fire, oil spill and one more life lost, we need a moratorium on oil trains and we need it now” said Mollie Matteson, a senior scientist with the Center for Biological Diversity. “The oil and railroad industries are playing Russian roulette with people’s lives and our environment, and the Obama administration needs to put a stop to it.”

In the United States, some 25 million people live within the one-mile “evacuation zone” of tracks carrying oil trains. In July 2013, a fiery oil train derailment in Quebec resulted in the loss of 47 lives and more than a million gallons of oil spilled into a nearby lake. A report recently released by the Center for Biological Diversity also found that oil trains threaten vital wildlife habitat; oil trains pass through 34 wildlife refuges and critical habitat for 57 endangered species.

Today’s Ontario accident joins an ever-growing list of devastating oil train derailments over the past two years. Oil transport has increased from virtually nothing in 2008 to more than 500,000 rail cars. Billions of gallons of oil pass through towns and cities ill-equipped to respond to the kinds of explosions and spills that have been occurring. Millions of gallons of crude oil have been spilled into waterways. In 2014, a record number of spills from oil trains occurred.

There has been a more than 40-fold increase in crude oil transport by rail since 2008, but no significant upgrade in federal safety requirements. The oil and rail industries have lobbied strongly against new safety regulations that would help lessen the danger of mile-long trains carrying highly flammable crude oils to refineries and ports around the continent. The Obama administration recently delayed for several months the approval of proposed safety rules for oil trains. The proposed rules fall short because they fail to require appropriate speed limitations, and it will be at least another two and a half years before the most dangerous tank cars are phased out of use for the most hazardous cargos. The oil and railroad industries have lobbied for weaker rules on tank car safety and brake requirements.

The administration also declined to set national regulations on the level of volatile gases in crude oil transported by rail, instead deciding to leave that regulation to the state of North Dakota, where most of the so-called “Bakken” crude originates. Bakken crude oil has been shown to have extremely high levels of volatile components such as propane and butane but the oil industry has balked at stripping out these components because the process is expensive and these “light ends” in the oil bring a greater profit. The North Dakota rules, which go into effect next month, set the level of volatile gases allowed in Bakken crude at a higher level than was found in the crude that set the town of Lac Mégantic, Quebec on fire in 2013, or that blew up in the derailment that occurred last month in West Virginia.

The crude involved in today’s accident may be another form of flammable crude, called diluted bitumen, originating in Alberta’s tar sands region. The Feb. 14 derailment and fire in Ontario on the same rail line involved an oil train hauling bitumen, otherwise known as tar sands.

“Today we have another oil train wreck in Canada, while the derailed oil train in Illinois is still smoldering. Where’s it going to happen next? Chicago? Seattle?” said Matteson. “The Obama administration has the power to put an end to this madness and it needs to act now because quite literally, people’s lives are on the line.”

In addition to its report on oil trains, the Center has sued for updated oil spill response plans, petitioned for oil trains that include far fewer tank cars and for comprehensive oil spill response plans for railroads as well as other important federal reforms, and is also pushing to stop the expansion of projects that will facilitate further increases in crude by rail.

Derailed Train in West Virginia Had Safer Tank Cars

The fiery derailment of a train carrying crude oil in West Virginia earlier this month is one of three in the past year involving tank cars that already meet a higher safety standard than what federal law requires – leading some to suggest even tougher requirements that industry representatives say would be costly.

Hundreds of families were evacuated and nearby water treatment plants were temporarily shut down after cars derailed from a train carrying 3 million gallons of North Dakota crude on Feb. 16, shooting fireballs into the sky, leaking oil into a Kanawha River tributary and burning down a house nearby. It was snowing at the time, but it is not yet clear if weather was a factor.

The train’s tanks were a newer model – the 1232 –designed during safety upgrades voluntarily adopted by the industry four years ago. The same model spilled oil and caught fire in Timmins, Ontario this month, and last year in Lynchburg, Virginia.

A series of ruptures and fires have prompted the administration of President Barack Obama to consider requiring upgrades such as thicker tanks, shields to prevent tankers from crumpling, rollover protections and electronic brakes that could make cars stop simultaneously, rather than slam into each other.

If approved, increased safety requirements now under White House review would phase out tens of thousands of older tank cars being used to carry highly flammable liquids.

“This accident is another reminder of the need to improve the safety of transporting hazardous materials by rail,” said Christopher Hart, acting chairman of the National Transportation Safety Board.

Oil industry officials had been opposed to further upgrading the 1232 cars because of costs. But late last year they changed their position and joined with the railway industry to support some upgrades, although they asked for time to make the improvements.

According to the Association of American Railroads, oil shipments by rail jumped from 9,500 carloads in 2008 to 500,000 in 2014, driven by a boom in the Bakken oil patch of North Dakota and Montana, where pipeline limitations force 70 percent of the crude to move by rail.

The downside: trains hauling Bakken-region oil have been involved in major accidents in Virginia, North Dakota, Oklahoma, Alabama and Canada, where 47 people were killed by an explosive derailment in 2013 in Lac-Megantic, Quebec.

Reports of leaks and other oil releases from tank cars are up as well, from 12 in 2008 to 186 last year, according to Department of Transportation records reviewed by The Associated Press.

Just two days before the West Virginia wreck, 29 cars of a 100-car Canadian National Railway train carrying diluted bitumen crude derailed in a remote area 50 miles south of Timmins, Ontario, spilling oil and catching fire. That train was headed from Alberta to Eastern Canada.

The train that derailed in West Virginia was bound for an oil shipping depot in Yorktown, Virginia, along the same route where three tanker cars plunged into the James River in Lynchburg, Virginia, prompting an evacuation last year.

The train derailed near unincorporated Mount Carbon just after passing through Montgomery, a town of 1,946, on a stretch where the rails wind past businesses and homes crowded between the water and the steep, tree-covered hills. All but two of the train’s 109 cars were tank cars, and 26 of them left the tracks.

Fire crews had little choice but to let the tanks burn themselves out. Each carried up to 30,000 gallons of crude.

One person – the owner of the destroyed home – was treated for smoke inhalation, but no other injuries were reported, according to the train company, CSX. The two-person crew, an engineer and conductor, managed to decouple the train’s engines from the wreck behind it and walk away unharmed.

The NTSB said its investigators will compare this wreck to others including Lynchburg and one near Casselton, N.D., when a Bakken crude train created a huge fireball that forced the evacuation of the farming town.

No cause has been determined, said CSX regional vice president Randy Cheetham. He said the tracks had been inspected just three days before the wreck.

“They’ll look at train handling, look at the track, look at the cars. But until they get in there and do their investigation, it’s unwise to do any type of speculation,” he said.

State officials do have some say over rail safety.

Railroads are required by federal order to tell state emergency officials where trains carrying Bakken crude are traveling. CSX and other railroads called this information proprietary, but more than 20 states rejected the industry’s argument, informing the public as well as first-responders about the crude moving through their communities.

West Virginia is among those keeping it secret. State officials responded to an AP Freedom of Information request by releasing documents redacted to remove nearly every detail.

There are no plans to reconsider after this latest derailment, said Melissa Cross, a program manager for the West Virginia Division of Homeland Security and Emergency Management.
