Martinez Environmental Group: Martinez could become hazardous rail car choke point

On May 14, a few members of the Martinez Environmental Group (MEG) attended the Office of Spill Prevention and Response (OSPR) seminar in Vallejo, where the major topics of discussion were petroleum crude oil being shipped by rail and new regulations for rail tank car construction.

Since September 2013, there has been a dramatic increase in the number of petroleum crude by rail derailments and explosions across the U.S. and Canada, due to the expanded market of Midwestern crude oil being transferred to the Gulf and East and West coasts. This has hazardous materials specialists and first responders nervous, and looking for local, state and federal regulation on rail car inspection, labeling, speed controls in residential areas, car construction, overloading, and offload monitoring.

Currently, Phillips 66 in Rodeo, Valero in Benicia and Shell and Tesoro in Martinez, receive highly volatile and explosive Bakken crude oil by rail, ship, and/or pipeline. There are no regulations in place for the DOT 111 rail tank car which has a tendency to split apart when derailed or comes into contact with other surfaces. The Department of Transportation (DOT) and the U.S. Pipeline and Hazardous Safety Administration (PHMSA) have drafted a proposed regulation regarding construction, transportation, and usage of DOT 111′s  that will be recommended to the refiners and shippers. This will be a recommendation, not a mandate.

The DOT 111 rail car was originally designed to haul corn syrup but now hauls crude oil, ethanol, butane, propane, a wide variety of hazardous chemicals such as hydrochloride and sulfuric acids, and non odorized liquefied petroleum gas (LPG).

Phillips 66 Refinery in Rodeo proposed a propane recovery project that will capture excessive butane and propane from refining Bakken crude oil. This process will increase rail tanker car traffic through downtown Martinez as Bakken crude oil moves west for refining and liquified petroleum gas moves east after refining. This project’s Environmental Impact Report (EIR) states 24 LPG cars per day will come out of the refinery which – added to the 100 plus LPG cars that regularly sit on rail sidings east and west of our downtown – are turning Martinez into a DOT 111 rail car choke point.

June 3 at 9 a.m. in the County Building at 651 Pine St., Martinez, the Contra Costa County Supervisors are scheduled to respond and decide on the Phillips 66 Propane Recovery Project EIR.

This hearing has been postponed several times because of inconsistencies and omissions in the EIR. If you have concerns about the increase of  hazardous materials in unsafe, deteriorating rail tank cars being moved through your downtown, or the effects on your health the Phillips 66 refinery project will inflict by refining dirtier crude oil, there is time on the agenda for public speaking. We encourage you to attend and be heard.

Additional note: at the June 3 meeting, the Supervisors will also be considering Shell’s request for an EIR consultant on their proposed changes to the Martinez Refinery, so we encourage you to come and ask questions about the project, as well.

Crude by Rail Isn’t the Way Forward

We’re mobilizing to oppose new crude by rail proposals that threaten our communities, our watersheds, and our climate. To put it simply, it is unacceptable that unsafe, outdated tank cars would be carrying extremely explosive oil through towns and cities across North America.

We look to the town of Lac Megantic, Quebec, where an oil by rail disaster killed 47 people, and we say never again. We will stop a similar tragedy before it starts by speaking up against crude by rail and demanding that it ends.

How did crude by rail become such a dangerous issue in the first place? Well, tar sands pipelines like Keystone XL, or Enbridge and Kinder Morgan in Canada, are hotly debated issues in today’s political arena. To stop the toxic oil, we’re talking to each other, organizing town hall meetings, and attending rallies. We’re building a wave of resistance to dirty energy. The outcry over pipelines and tankers has left big oil companies scrambling to find new ways of moving oil.

In enters oil by rail, the ugly kid brother of pipelines, that’s sprouting like a teenage weed and hoping that no one will notice. In North America oil by rail has grown a whopping 4,100% since 2008. There’s been enormous growth but little public debate, or even awareness.


Most citizens and elected officials haven’t even had a chance to talk about oil by rail. Not to sound like a teenager, but that’s totally unfair.

We’re willing to bet that a small-town, salt-of-the-earth family is much more likely to be impacted by a rail catastrophe than an oil executive. With communities on the front lines, communities need to have their voices heard.

So we’re leading the charge to halt new crude-by-rail terminals, as proposals spring up all along the West, Gulf, and Atlantic coasts of North America. But we won’t be able to do this without help and input from people like you.

We’re holding events up and down West Coast, and we’re petitioning our public officials. Are you in?

Martinez to Benicia: Oil Refinery Protest Draws About 100 Demonstrators

East Bay Oil Refinery Protest Draws About 100 Demonstrators

Accompanied by a four-kayak flotilla and a fifth-generation Martinez resident on horseback, about one hundred environmental activists marched seven miles from Martinez to Benicia on Saturday to protest the local toxic pollution and global climate impact of Bay Area oil refineries. The march was spearheaded by a Bay Area group affiliated with Idle No More, an organization of Canadian First Nations people fighting development of the tar sands oil fields in Alberta and other environmentally destructive projects on their traditional lands.

Specific targets of the protest were proposed expansion projects at the Chevron (Richmond), Valero (Benicia), and Phillips 66 (Rodeo) refineries, a crude oil transportation terminal in Pittsburg planned by energy infrastructure company WesPac, and the major investment of Shell (Martinez) in the Canadian tar sands mines. The Saturday march was the second of four planned Refinery Corridor Healing Walks — the first, from Pittsburg to Martinez, was held in April, and future walks are planned for June and July, ending up at Chevron in Richmond. The series of walks aims to “connect the dots” to “bring awareness to the refinery communities, invite community members to get to know one another, and to show support for a just transition beyond fossil fuels,” according to the group’s website.

At a gathering at the Martinez Regional Shoreline before the march, a winner of this year’s Goldman environmental prize, South African Desmond D’Sa, described the high rates of leukemia, cancer, and asthma in his home town of Durban and the community’s struggles against Shell Oil there, urging the crowd to “fight them (refineries) wherever they are.” Penny Opal Plant, of the East Bay Idle No More group, said she only recently began to conceive of the refinery corridor as a total area suffering from the “immense devastation” caused by oil refineries.

Richmond residents have long protested pollution from Chevron, most recently the toxic explosion that sent 15,000 seeking medical treatment in August 2012. Benicia residents have also organized to oppose environmental hazards. In the last year, local groups have also formed in Pittsburg, Crockett-Rodeo, and Martinez to protest refinery expansion and transportation plans, including major increases in the amount of crude oil to be carried by rail through the Bay Area and beyond.

Describing the dangers of mining, refining, and transporting oil, and looking ahead to a future free from fossil fuel, Opal Plant said, “We are Mother Earth’s immune response awakening. We’re born at this time to do this thing.”

The group’s route first went through the Shell refinery, then over the bridge to Benicia, with a view of the Valero refinery there. From a hilltop vista point next to Carquinez Strait, Benicia activist Marilyn Bardet pointed out refineries and planned oil industry project sites, as well as the environmentally Suisun Marsh. Railroad tracks leading to the Valero refinery, she said, go right through the marsh. A spill of tar sands crude oil, she added, would be impossible to clean up because the oil is so heavy it would sink and cause irreparable damage.

The next Refinery Corridor Healing walk is scheduled to go from Benicia to the Phillips 66 refinery in Rodeo on June 14.
