Half a Million California Students Attend School In Oil Train Blast Evacuation Zones

A new analysis by the Center for Biological Diversity finds that 500,000 students in California attend schools within a half-mile of rail tracks used by oil trains, and more than another 500,000 are within a mile of the tracks.

“Railroad disasters shouldn’t be one of the ‘three Rs’ on the minds of California school kids and their parents,” said Valerie Love with the Center. “Oil trains have jumped the tracks and exploded in communities across the country. These dangerous bomb trains don’t belong anywhere near California’s schools or our children.”

Current safety regulations for first responders dealing with oil trains recommend evacuating everyone within a half-mile of any incident with an oil train. This wasn’t much of a problem for the most recent oil train accident in July in Culbertson, Montana because there were only 30 people within the half-mile radius area. However, in populated areas like California, potential scenarios could involve large-scale evacuations and casualties.

In addition to the threat posed to California’s students, the report Crude Injustice on the Rails released earlier this year by ForestEthics and Communities for a Better Environment, pointed out that in California the communities within the half-mile blast zones were also more likely to be low-income minority neighborhoods.

As more communities across the country become aware of the very real risks these oil trains pose, opposition is mounting to new oil-by-rail projects as well as challenges to existing facilities.

This past week in California, the Santa Clara County board of supervisors voted to keep oil trains out, citing an “unacceptable risk to our community.”

In Minnesota, Sen. Al Franken (D-MN) held a hearing on the subject and heard from concerned residents like Catherine Dorr, as reported by the local CBS station.

We’re in the 100 foot blast zone,” Dorr said. “My house and 60 townhouse residents are going to be toast if there’s an explosion.”

In Albany, New York which is the largest oil-by-rail hub on the East coast, this week a coalition of groups announced their intentions to sue the oil company transporting Bakken crude through Albany and challenge the validity of the air quality permit the company received in 2012.

And even in remote places like North Dakota, where much of the oil originates, the U.S. military is concerned about the proximity of the oil train tracks to nuclear missile facilities.

With all of this concern about the dangers of oil trains, a new report by the Associated Press (AP) paints a troubling picture about the preparedness of populated areas to respond to an oil-by-rail incident. The report was based on interviews with emergency management professionals in 12 large cities across the U.S.

It concludes, “The responses show emergency planning remains a work in progress even as crude has become one of the nation’s most common hazardous materials transported by rail.”

As noted on DeSmog, one of the reasons that the oil trains pose such a high risk is that the oil industry refuses to stabilize the oil to make it safe to transport. And the new regulations for oil-by-rail transport released this year allow for older unsafe tank cars to be used for another 8-10 years.

While the regulations require modernized braking systems on oil trains in future years, the rail industry is fighting this and a Senate committee recently voted to remove this from the regulations.

The reality is that unless there are drastic changes made, anyone living within a half mile of these tracks will be at risk for years to come.

And while oil production isn’t increasing in the U.S. right now due to the low price of oil, industry efforts to lift the current ban on exporting crude oil could result in a huge increase in fracked oil production. In turn, that oil will be put on trains that will head to coastal facilities and be loaded on tankers and sent to Asia.

Despite all of the opposition and the years-long process to complete new regulations, as the Associated Press notes, it isn’t like the emergency first responders are comfortable with the current situation.

“There could be a huge loss of life if we have a derailment, spill and fire next to a heavily populated area or event,” said Wayne Senter, executive director of the Washington state association of fire chiefs. “That’s what keeps us up at night.”

And even the federal regulators expect there are going to be catastrophic accidents. As reported by the AP earlier this year, the Department of Transportation expects oil and ethanol trains “will derail an average of 10 times a year over the next two decades, causing more than $4 billion in damage and possibly killing hundreds of people if an accident happens in a densely populated part of the U.S.”

With the known risks and the number of accidents, so far communities in the U.S have avoided disaster. But as Senator Franken pointed out, that has just been a matter of luck.

We’ve been lucky here in Minnesota and North Dakota and Wisconsin that we’ve not seen that kind of fatalities, but we don’t want this to be all about luck,” Sen. Franken said.

As over 1,000,000 students in California start a new school year in schools where they can easily hear the train whistles from the oil trains passing through their communities, let’s all hope we keep this lucky streak going.

Scientists’ Warnings Come Too Late to Shape State’s Weak Fracking Regulations

SACRAMENTO, Calif.— A study released today by the California Council on Science and Technology warns that fracking and other oil extraction techniques emit dangerous air pollution and threaten to contaminate California’s drinking water supplies. Millions of Californians live near active oil and gas wells, which exposes them to the air pollutants indentified in the report.

The troubling findings come a week after Gov. Jerry Brown’s oil officials finalized new fracking regulations that do little to address such public health and water pollution risks.

“This disturbing study exposes fatal flaws in Gov. Brown’s weak fracking rules,” said Hollin Kretzmann of the Center for Biological Diversity. “Oil companies are fouling the air we breathe and using toxic chemicals that endanger our dwindling drinking water. The millions of people near these polluting wells need an immediate halt to fracking and other dangerous oil company practices.”

Last week the state’s Department of Conservation began implementing new fracking regulations and finalized an assessment of fracking’s health and environmental risks, even though the science council had not finished evaluating fracking’s dangers. The science council is an independent, nonprofit organization that advises California officials on policy issues.

Today’s report concludes that fracking in California happens at unusually shallow depths, dangerously close to underground drinking water supplies, with unusually high chemical concentrations. That poses a serious threat to aquifers during the worst drought in California history.

Air pollution is also a major concern. In the Los Angeles area, the report identifies 1.7 million people — and hundreds of daycare facilities, schools and retirement homes — within one mile of an active oil or gas well. Atmospheric concentrations of pollutants near these oil production sites “can present risks to human health,” the study says.

But Gov. Brown’s new fracking regulations do not address deadly air pollutants like particulate matter and air toxic chemicals. A recent Center analysis found that oil companies engaged in extreme oil production methods have used millions of pounds of air toxics in the Los Angeles Basin.

Among the science council’s other disturbing findings:

  • California places no limits on how close oil and gas wells can be to homes, schools or daycare facilities, which can expose people to dangerous air pollution from fracking and other oil extraction procedures.
  • Serious concerns are raised over the oil industry’s disposal of fracking waste fluid and produced water into open pits and the use of oil waste fluid to irrigate crops.
  • The health and water pollution impacts of fracking chemicals that could be present in oil waste that’s dumped into open pits “would be extremely difficult to predict, because there are so many possible chemicals, and the environmental profiles of many of them are unmeasured.”
  • Wildlife habitat can be fragmented or lost because of fracking and other oil development – and fracking-related oil development in California “coincides with ecologically sensitive areas” in Kern and Ventura Counties.
  • Confirmation that many oil industry wastewater injection wells are close to active faults — a practice has triggered earthquakes in other states. The science council identified more than 1,000 active injection wells within 1.5 miles of a mapped active fault — and more than 150 are within 656 feet.

“These troubling findings send a clear message to Gov. Brown that it’s time to ban fracking and rein in our state’s out-of-control oil industry,” Kretzmann said. “California should follow the example set by New York, which wisely banned fracking after health experts there concluded this toxic technique was just too dangerous.”

SACRAMENTO, Calif – A new report says hydraulic fracturing can contaminate groundwater when the excess water is not properly disposed of, but is not linked to earthquakes in California.

In January, a study by the Seismological Society of America linked a series of earthquakes in Ohio to fracking, and there have been similar claims in other states as well.

The new study released Thursday comes from the California Council on Science and Technology and the Lawrence Berkeley National Laboratory. Jane Long, the lead scientific researcher, says hydraulic fracturing poses some safety concerns but they’re manageable.

“A lot of things people were concerned about are things that are not as big a problem as they think they are,” says Long. “And some of the practices are things that need to change and need more attention.”

The report says the oil companies should phase out percolation ponds used to dispose of excess water because toxic fracking chemicals can get into the aquifer. And it recommends companies put aside about a third of the chemicals currently in use because there’s not enough data about them.

The Center for Biological Diversity points to the finding that oil operations can pollute the air in their immediate vicinity. Long is optimistic that the report will spur further reforms.

“Some of them are going to be recommendations that will be very easy to act on right away and I think they will be acted on and some of them are going to require some process,” she says.

The report was required by the 2013 passage of State Senate Bill 4, which established new safety measures for fracking, rules that went into effect on July 1.

Communities Fight to Prevent ‘Bomb Trains’ from Passing by the L.A. River

Church bells rang 47 times last Monday in Lac-Mégantic as locals came together to remember each of the victims of a horrific rail disaster in the Quebec town two years ago. Aside from the cost to human life, all but three of the buildings in downtown had to be demolished due to petroleum contamination when an unmanned 72-car train rolled downhill and derailed, spilling and igniting six million liters of carrying volatile fracked shale oil from the Bakken region of North Dakota.

These trains have become known as “bomb trains” due to their destructive track record. At any given time about 9 million barrels of crude oil are moving over the rail lines of North America. In less than a decade, there has also been 43 times more oil moved through U.S. railways, increasing the likelihood of tragic explosions and spills.

SoCal environmentalists are trying to prevent the same type of tragedy from happening in Los Angeles and by the Los Angeles River, an area slated for a $1-billion facelift in the coming years.

“We don’t need to put our water sources and communities at risk from bomb trains when we can invest further in public transit, more efficient cars that would run from solar power or advanced biofuels, heating and cooling using renewable energy sources,” says Jack Eidt, urban planner and environmental designer. He is also the publisher of Wilder Utopia and directs Wild Heritage Planners.

He, along with about thirty organizations such as Burbank Green Alliance, Center for Biological Diversity, ForestEthics, Sierra Club, SoCal 350 Climate Action, and Tar Sands Action Southern California, are working hard to oppose the Phillips 66 Santa Maria Refinery crude expansion, which would extend the existing rail track by 6,915-foot east on the Union Pacific rail mainline and install equipment needed to enable rail delivery of North American crude oil. It would up the volume of oil transported via rail through major cities on its way to Philips’ Santa Maria Refinery, a 1,780-acre property adjacent to State Highway 1 on the Nipomo Mesa.

They are holding a Stop Oil Trains Day of Action at Union Station this July 11, as part of the National Week of Action to Stop Oil Trains. Environmentalists, community organizers, people from the indigenous community, as well as poets and musicians, will be present to educate the public about this looming issue.

They’re hoping that the Los Angeles City Council will join in the chorus of over 30 city and county governments to stop this project expansion. “We would love to see Councilmember Huizar sponsor the measure, because his district encompasses many neighborhoods that could be affected by a rail accident,” says Eidt.  Resolutions have already been introduced and approved Mar Vista Community Council, as well as the Echo Park and Silver Lake Neighborhood Councils the City to take action.

With the extension, the company to plans to move 20,800 crude tankers to and from their Nipomo facility every year. These can be 80-car trains that stretch a mile-long.

Environmentalists worry this would jack up the risks for communities that exist along the Union Pacific Rail lines. “Maps in the EIR show these trains proposed to pass back and forth between Colton and the Central Coast, passing right through downtown, along the L.A. River and out toward Chatsworth in the San Fernando Valley,” says Eidt, “In the future, we are sure that the trains would also be running south toward the Port of Los Angeles.”

The project’s required environmental review offered no reassurance either. A document released last November garnered 20,000 comments from organizations and individuals across the state opposing the project. The review showed that more than 20 significant and unavoidable adverse impacts to the environment, including rail accident risks along the main line that could result in oil spills, and fires and explosions near populated areas.

There have already been six major accidents across North America in this year alone, including one last week in Tennessee when a train carrying hazardous material derailed and caught fire. Five thousand people living within a mile and a half of the site had to be evacuated.

Atwater Village residents will remember the oil spill last year, when above-ground pipeline burst in the 5100 block of West San Fernando Road. It sent a geyser 20 to 50 feet into the air. Quick action prevented the oil from spilling into the Los Angeles River, but we might not be so fortunate the next time.

“The project is part of a wider expansion to bring tar sands crude from Alberta, Canada, into West Coast ports for processing and export,” says Eidt. “Because activists, like our coalition, have fought hard to stop projects like the Keystone XL tar sands pipeline across the middle of the U.S., the oil industry has turned to shipping crude by barge and rail.”

Though the project isn’t in the city, “this is a health and safety issue for the City of Los Angeles,” says Eidt. “The P66 Santa Maria EIR stated that emergency responders would not be equipped to deal with a derailment or explosion of a 100-car train carrying toxic crude. We need to focus on optimizing our rail transportation network with high-speed rail and Metrolink/Amtrak, which will use the same right-of-way/rails respectively. Metrolink has had a difficult history of accidents that have caused a significant toll on communities. Factor in volatile crude oil into the mix and we are looking at trouble.”

Rather than invest in these projects, Eidt says we should find more sustainable methods of transportation, heating, cooling, and manufacturing. Eidt recommends looking at Mark Z. Jacobsen’s Solutions Project and Amory Lovins’ Rocky Mountain Institute, both of which say we can transition to an economy that doesn’t degrade the environment, but uplifts it. For example, if cars were made out of fiber composites as opposed to 19th century steel, it would keep them moving faster and longer.

“Crude oil, natural gas, and coal need to be phased out today, and the workforce must be retrained, our consumer choices must be more informed and in most cases curtailed,” says Eidt. “We should consider eating lower on the food chain, we must pass a carbon tax to get the fossil fuel companies to pay for their pollution, and that dividend should be given back to households to meet the cost of a just transition off fossil fuels.”

California Environmental Groups Sue to Stop Fracking

LOS ANGELES – California environmental groups filed suit Wednesday to block a Bureau of Land Management (BLM) plan to allow fracking and oil drilling on more than one million acres of public land.

According to Patrick Sullivan with the Center for Biological Diversity, the BLM environmental assessment was inadequate.

“We think the federal government needs to go back to the drawing board and take a really hard look at fracking pollution threats to water, air and public health,” he says.

The environmental lawfirm Earthjustice filed the suit on behalf of the Center for Biological Diversity and Los Padres ForestWatch. Oil companies named in the suit maintain their operations are safe and comply with all regulations.

Sullivan says fracking and oil drilling put the environment and nearby residents at risk.

“The EPA has found instances in which fracking has contaminated drinking water across the country,” he says. “Here in California we know oil companies have dumped waste fluid into protected underground aquifers.”

The federal lands in question stretch across the San Joaquin Valley, southern Sierra Nevada and along the Central Coast in Ventura, Santa Barbara and San Luis Obispo counties.
